    Kampuni ya kufua umeme ya Dowans Tanzania Limited imeiomba Mahakama Kuu Kitengo cha Biashara ikatae maombi ya Shirika la Umeme Tanzania (TANESCO) dhidi ya kuuzwa kwa mitambo yake ya kufulia umeme nchini.

    Mbele ya Jaji Robert Makaramba juzi, Wakili wa Dowans Abduel Kitururu alidai kuwa maombi ya Tanesco hayana msingi wowote kwa kuwa shirika hilo limewasilisha mahakamani maombi yake kwa kutumia kifungu kisichokubalika katika kuwasilisha maombi hayo.

    Katika maombi yake, Tanesco inaiomba mahakama iizuie Kampuni ya Dowans kuuza mitambo yake kwa namna yoyote hadi shauri lililowasilishwa na Kampuni ya Dowans kwenye Mahakama ya Usuluhishi ya Kimataifa iliyoko Paris, Ufaransa, itakapotolewa uamuzi.

    Kwa namna nyingine, Tanesco inaiomba mahakama iiamuru Dowans iweke mahakamani asilimia 10 ya dola 109,857,686 za Marekani kama dhamana, kutokana na gharama zitakazotumika katika kesi hiyo.

    Katika hoja zake zilizowasilishwa mahakamni hapo kupinga maombi hayo, Wakili Kitururu alisema Tanesco imepeleka maombi hayo kwa kutumia kifungu 95 cha sheria ya mwenendo wa madai na Ibara ya 23 (2) ya sheria inayojulikana kama International Chamber of Commerce Rules.

    Kwa mujibu wa hoja hizo, ibara hiyo haiwezi kuipa mamlaka Mahakama ya Tanzania kushughulikia maombi kama yaliyowasilishwa na Tanesco nchini, bali kipengele hicho cha sheria kinaweza kutumiwa na upande husika katika shauri kwenye mahakama ya kimataifa kutafuta amri ya zuio kabla kesi ya msingi haijamaliza kusikilizwa.

    Alisema pia kuwa hata kifungu cha sheria kilichopo chini ya mwenendo wa madai nacho hakiipi mahakama kujielekeza mamlaka yake kusikiliza na kutolea uamuzi wa maombi yaliyowasilishwa mbele yake na Tanesco.

    Wakili huyo alisema kuna uamuzi uliowahi kutolewa na mahakama ya rufaa nchini na nje ya nchi ambayo yanabainisha kuwa maombi yoyote yanayoletwa na mwombaji bila kutumia kifungu cha sheria kinachotakiwa, hayawezi kutiliwa maanani na mahakama na hutupiliwa mbali.

    Wakili Alex Nguruma anayeitetea Tanesco, atatakiwa kuwasilisha hoja zake za majibu Mei 6 mwaka huu. Juni 23, 2006 Tanesco iliingia makubaliano ya usambazaji wa umeme wa dharura na Kampuni ya Richmond, ambayo ilielekeza majukumu yake kwa Kampuni ya Dowans Holding SA. Baadaye, Dowans Holdings ilielekeza majukumu yake kwa Kampuni dada ya Dowans Tanzania Limited.

    Baada ya mapitio ya makubaliano hayo na upungufu uliojitokeza Juni 30 mwaka jana, Tanesco iliiandikia Dowans ikieleza kuwa uhamishaji huo wa majukumu ya kiutendaji haukuwa halali. Novemba 2, 2008 Dowans ilifungua kesi katika mahakama ya kimataifa ikidai dola 109,857,686 kama gharama za huduma za umeme ambazo zilikuwa hazijalipwa.

    Kwa upande wake,Tanesco iliwasilisha maombi ya kutaka iongezwe muda wa kuwasilisha utetezi Novemba 11,2008, katika mahakama hiyo, lakini kabla kesi hiyo haijafikia mwisho, Dowans ilitangaza kuuza mitambo yake. Kitendo hicho kilikuwa na lengo la kuvuruga namna ukazaji wa hukumu itakayotolewa na mahakama hiyo ya kimataifa juu ya gharama za kuendesha kesi hiyo kwa upande wa Tanesco.

    Serikali ya TZ ipo mfukoni mwake watamfanya nini? Ndio maana sheria zipo lakini watendaji wanajifanya hawazioni. Wana uwezo wa kuchunguza sheria zipi zinaweza kumtia hatiani Mengi kwa kuwatuhumu watu kuwa ni mafisadi papa lakini kwa RA hakuna mwenye uwezo wa kutafuta sheria yoyote itakayowezesha kutaifishwa kwa mitambo ya Dowans.

    Kama kweli serikali ina meno wangeitaifisha hii mitambo ingawa itakuwa tishio kwa wawekeaji wote kwa ujumla.....maana watatafsiri vibaya....utaifishwaji huo ila itakuwa fundisho kwa wasanii wanaokuja kuchuma TZ ki ujanja ujanja ebooo..JK kama kweli wewe kidume na huna ubia kwenye urais wako taifisha Dowans haraka sana.

    CAG: 6.8bn/- wrongly dished out to Dowans

    The controversial Dowans Tanzania Limited was wrongly paid a staggering $4,865,000 (approx. 6.8bn/-) under dubious circumstances, the latest audit report by the Controller and Auditor General (CAG) has revealed.

    The newly-released CAG report for the 2007/08 financial year uncovered the anomaly in the financial records of the state-owned Tanzania Electric Supply Company Limited (TANESCO).

    It is stated that TANESCO paid Dowans the amount as reimbursement for costs incurred by the private company in airlifting electric power generation equipment and accessories to Dar es Salaam.

    However, the CAG report notes that the government and TANESCO made the huge payment to Dowans without actually being contractually obliged to do so.

    According to the auditors, Dowans invoiced TANESCO on November 17, 2006, demanding reimbursement of $4,865,000 spent to bring in three electric power generation turbines and other consumables and accessories for its emergency power plant in Dar es Salaam.

    The audit report says TANESCO's management acknowledged that the payment was made under an agreement reached by the negotiation team comprising government and DOWANS company representatives.

    ''However, minutes of the negotiation meetings do not categorically state whether the stated amount is subject to be paid, and by whom,'' says part of the audit report.

    ''...It appears that the amount was wrongly paid by the government,'' the report adds.

    It further requests TANESCO to either justify the payment, or recover the wrongly-paid amount.

    In its previous audit report, the CAG found that Dowans had failed to commission at full capacity of 100MW power generation on the agreed commercial operation date.

    TANESCO was thus advised by government auditors to ensure payment of liquidated damages with interest.

    However, the latest CAG audit report notes that the recommendation has not been implemented by TANESCO.

    Dowans inherited the power generation contract from the equally-dubious Richmond Development Company (RDEVCO) LLC under mysterious circumstances.

    Dowans was later slapped with a $10,000-per-day penalty notice for failing to beat the power generation deadline.

    The penalty led to Dowans owing the government an accumulated fine of $2,430,000 (approx. 3.4bn/-).

    The government was forced to terminate the power purchase agreement with Dowans following revelations that fraud was committed in the contract.

    A parliamentary probe committee chaired by Kyela member of parliament Dr Harrison Mwakyembe came to the conclusion that the Richmond/Dowans deal was fraudulent, hence rendering it null and void.

    Several prominent public figures were implicated by the scathing parliamentary probe report in connection with the Richmond scandal.

    They included the then prime minister, Edward Lowassa, cabinet ministers Nazir Karamagi and Dr Ibrahim Msabaha, and Igunga member of parliament Rostam Aziz.

    Lowassa, Msabaha and Karamagi were all forced to resign their government posts as a result of the report's findings.

    The government's procurement watchdog � the Public Procurement Regulatory Authority (PPRA) � also slammed the Richmond/Dowans deal as fraudulent

    Nimelala nimeamka bado jinamizi la Dowans linanisumbua na hatma ya tatizo la umeme Tanzania bado haijulikani Serikali iko busy kutoa matamko juu ya ugomvi wa watu binafsi..! aaargh nji hii.....!!!!
