    Baada ya Dr Slaa kutaja orodha mpya ya Mafisadi, Nape Nnauye mmoja wa wajumbe wapya wa Sekreterieti ya CCM amejitokeza hadharani na kuiita orodha hiyo mchezo wa kuigiza. Search iliyofanyika katika tovuti ya CCM inashiria ni kweli CCM inafanya mchezo wa kuigiza na dhana nzima ya "Kujivua Gamba" kwa kuwa majina ya Lowassa, Chenge na Rostam yanaonekana kuwa miongoni mwa wajumbe waliochaguliwa na Halmashauri Kuu ya CCM iliyoketi tarehe 10 Aprili 2011 huko Dodoma ili wawe miongoni mwa wajumbe 38 wa Kamati Kuu mpya ya CCM.

    Vile vile kuthibitisha kuwa Sekreterieti ya Wilson Mukama na Nape inafanya michezo ya na akili za watanzania, miniti za kikao cha Halmshauri Kuu ya CCM cha tarehe 10 Aprili 2011 zilizopostiwa katika tovuti ya CCM azionyeshi popote kufikiwa kwa mamuzi ya kuwapatia wanachama wa CCM wanaotuhumiwa kuwa Mafisadi siku 90 kujipima wenyewe na kujiondoa katika nafasi zaoa ua ndani ya CCM. ibara ya 5 ya Maamuzi ya NEC ya Tarehe 10.04.2011 hapo chini yahusika

    5. KUHUSU TATHMINI YA UCHAGUZI MKUU 2010

    Halmashauri Kuu ya Taifa baada ya kujadili taarifa ya Tathmini ya Uchaguzi Mkuu wa 2010, imeagiza mambo yafuatayo:-

    (a) Halmashauri Kuu ya Taifa imetoa Shukurani kwa wana CCM na wananchi kwa jumla kwa kukiunga mkono Chama Cha Mapinduzi wakati wa uchaguzi kwa kukipigia kura nyingi zilizokipa ushindi na hatimaye kuunda Serikali ya Muungano na Serikali ya Mapinduzi ya Zanzibar. Wananchi wanaombwa kuendelea kukiunga mkono Chama Cha Mapinduzi katika chaguzi zingine zijazo.

    (b) Serikali zote mbili, ya Jamhuri ya Muungano wa Tanzania, na Serikali ya Mapinduzi ya Zanzibar, zimetakiwa zitekeleze ipasavyo Ilani ya CCM ya 2010-2015 kwa kadri Chama kilivyoahidi wakati wa kampeni; kama zilivyo tekeleze kwa ufanisi mkubwa Ilani iliyopita iliyopita ya Uchaguzi ya 2005-2010.

    (c) Serikali zote mbili ziongeze kasi ya kushughulikia matatizo ya wananchi ili kuwaondolea kero zinazowakabili, hasa tatizo la kupanda kwa gharama za maisha.

    (d) Chama Cha Mapinduzi na Serikali zake kiongeze kasi ya mapambano dhidi ya viongozi na wanachama wanaojihusisha na rushwa. Aidha viongozi na wanachama wanaotuhumiwa kwa vitendo vya rushwa wajenge tabia ya kuwajibika wenyewe kwa maslahi ya Chama wasipofanya hivyo Chama kiwawajibishe kwa maslahi ya Chama na nchi.

    Mbona majina yako yamejirudia au ni watu wawili wanaitwa Makinda na Kinana. Lakini si waliambiwa wajiuzulu wenyewe kabla ya chama hakijawawajibisha. Nafikiri bado mda upo lakini vilevile ujue hakuna majina yaliyotajwa zaidi hizo ni conclusions zako

    Usanii unakuja from the fact kwamba Kamati Kuu ya CCm ilijiuzuru halafu ikachguliwa ingine, sasa iweja hawa Mafisadi warejee katika Kamati kuu mpya. Labda tungesema ni typing error au website haijawa updated. Mbone Katibu Mikuu, wajumbe wengine wa CC wapya na Sekreterieti wamekuwa updated? Hapa nilazima kuna kamchezo kanachezwa na Top Brass ya CCM

    Wahuni tu!hamna chochote cha maana walichofanya kwenye zoezi lao la kujivua gamba,kwa sababu kwanza walipaswa kuwaainisha wale wenye tuhuma za ufisadi alafu wangewaondolea haki ya kugombea na kupigiwa kura kisha ndio wawape hizo siku 90 za kuamua wenyewe kujiondoa.Sasa wao hawakufanya hivyo hivyo na matokeo yake wametinga tena,huu ni usanii mtupu walioufanya!

    Siamini kama kweli tovuti inasema hivyo!!! Naifungua sasa hivi nione. Kama ni kweli basi itakuwa ni ajabu kwelikweli. Lakini pia Mkuu NEC inaonekana haijataja hao mafisadi sasa hawa akina Nnauye wanayapata wapi haya majina? Au wanaiwekea NEC maneno kinywani?

    Kitendo cha CCM-Gamba kuamua kuwabandua tu akina Edward Lowassa, Rostam Aziz, Andrew Chenge na wengine wachache tu huko ni katika muendelezo wa chama hiki kutania Umma wa Tanzania na kufanya kila kitu kwa mzaha tu.

    Ni wasiwasi wangu mkubwa sana kwamba endapo CCM-Gamba chenyewe hakina fikra za kujibandua jumla pamoja na mwenyekiti wake ambaye anatajwa saaaana katika hili na lile basi wananchi huenda tukaanza kukosa amani zaidi na kuanza kuwabandua mmoja baada ya mwingine hukuhuku makwetu kitaaa.

    Hivyo wale wanaojitambua ugamba wao kwa ustawi wa taifa hli anzeni kuchukua hatua mapema ili msije mkalazimika kuomba ulinzi kama Meya feki wa Arusha maana Nguvu ya Umma wa nchi hii ni kwamba wenzetu mmechangia mno kutufanya tuaibike sana kimaisha, kudhalilishwa sana bila uwezo wa kuwatelezea jamii zetu wajibu kwao na kupunjwa sana maendeleo shauri ya maoni na misimamo yetu kisiasa nchini.

    Hakika Gamba walilolichokoza ilikuwa ni hoja-mtego itakayokimaliza kabisa CCM. Maana yake ni kwamba endapo mnyama mkubwa kama tembo mwili wake wote ni magamba sasa akianza kujivua gamba moja baada ya nyingine basi matokeo yake ni kwamba hata atakapofikia saizi ya mwili sawa na dawa ya piritoni bado haja ya kujivua gamba zaidi itakua inaendelea tu.

    CCM katika hii dhana ya 'Kujivua Gamba' hapo ndipo kunasa kwenu jumla kwenye ndoano rahiiiiiiisi mno!!! Vueni hiyo migamba enyi wana-CCM mnaoelemewa na mizigo ya kutupora kila kitu nchini.

    Katika hili nadhani Watanzania tuchange ili tukajenge Mi-jela zaidi ya kuwafungia wana-CCM endapo kweli kutakwepo na haja mioyoni mwao kujirudi na kweli kila mmoja wao 'Kujivua Magamba' sugu ya miaka nenda rudi kwa kuwaibia Watanzania.

    Hili ni kutokana na ukweli kwamba katika kila kundi la Wana-CCM 10 utakaokutana nao 8 ni GAMBA SUGU tena wezi wa mali ya umma ama kuendelea kufaidika nazo bila ustahili wowote ambao ndio waliotufikisha hapa tulipo kwenye umasikini wa kupindukia kitaifa.

    Hiyo ndiyo Website Rasmi ya CCM, la sivyo kama ni feki, tuonyeshe hiyo "Website Rasmi" ya ukweli ya CCM ipo wapi? Tokea lini CCM wakawa savvy & sophisticated kwenye lolote zaidi ya kuiba hela za umma? Hata kwenye Website yao wanatumia software za dezo, na usishangae ukakuta hiyo "Kampuni" (aka mtoto wa kigogo wa CCM) iliyo-design hiyo tovuti uchwara ishalipwa tenda ya dola milioni 1.5

    Nafikiri ulitak mkusema kupadate. Kama ndio hivyo akina Wilsonn Mukama, Nape na Janury Makamba wameingiaje katika orodha hiyo. Hii ni dalili ya vita vya chinichini katika makundi hayo. Kama ambavyo walichakachua matokeo ya kura kwa kutumia mtandao sasa hivi wanachakachua hata matokeo ya uchaguzi wa Hamashauri Kuu yao

    NA HII IMEKAAJE JAMANI.....Tanzania has lost 500bn/- over the sale of Zain Africa to Bharti Airtel of India through tax avoidance. The whopping sum was lost as a result of existing loopholes in the Income Tax Act of 2004 which does not cater for transactions similar to those carried out by the Zain proprietor.
    The transaction which was conducted between Zain Africa, a multinational Corporation and Bharti Airtel saw the 60 percent shares held in Zain Tanzania by Zain Africa directly or through a subsidiary being transferred to Bharti Airtel directly or through an undisclosed subsidiary.
    The big question is, how could the Tanzania Revenue Authority (TRA) Director General, Harry Kitilya, say Tanzanian assets did not change hands to necessitate taxation?, Why has it taken TRA so long to determine that Tanzania Income Act is weak compared to Nigerian, yet the said 60 percent shares have shifted hands several times?
    As rightly noted by the Kigoma North MP (Chadema), Mr Zitto Kabwe, there is a ghost company between Zain Africa and Zain Tanzania that is responsible for keeping the 60 percent shares in what was Zain Tanzania.

    According to Lusaka Times, a Zambian electronic news platform, the government of Tanzania announced in June 2010 that it would receive 11.2m US dollars from the sale of Zain Africa to Bharti Airtel while it maintains its 40 percent shares in Zain Tanzania.
    In fact this assertion was confirmed by the then Minister for Higher Education, Science and Technology, Professor Peter Msolla when he addressed the National Assembly in Dodoma in July 2010.
    The minister disclosed that the government was holding discussions with Bharti Airtel on the sale of Zain.
    Presently nothing is known about the end result of the reported discussions between the government and the Indian company and what became of the 11.2m US dollars.
    And to make matters worse, the Permanent Secretary for the Ministry of Finance and Economic Affairs, Mr Ramadhan Khijjah was sometime back quoted complaining that Zain Tanzania did not fully inform relevant government authorities of the sale.
    Mr Kijjah's position differs with that of Professor Msolla on the same issue and appears to be in line with the recent statement by Mr Kitilya who is quoted to have said that the Zain transaction were conducted in the Netherlands.
    This implies that somebody somewhere wanted to keep the Tanzanian government out of the loop as far as the transactions were concerned.[​IMG]
    Such contradictory statements from different, but very important players in the government does not only show that the left hand does not know what the right hand is doing, but also raises very serious questions over the ability and credibility of Tanzanian leaders.
    The question is, is it true that no one in the Tanzanian government was aware of the sale of the Zain to the Indian company?
    And if one is to believe on the foregoing, then what is the work of institutions that include the mother ministry, the ministry of foreign affairs and international cooperation which supervises Tanzanian embassies abroad and of course, the Tanzania Intelligence and Security Service (TISS)?
    When President Jakaya Kikwete first came to power early in 2006, one of his first acts was to direct officials of Tanzanian embassies abroad to help the country economically by serving as a link between their homeland's economic institutions (individuals and companies) and their respective stations abroad.
    Unfortunately six years later, a major transaction takes place abroad in a country where Tanzania has an embassy and the best those Tanzanian officials can do is to help in keeping their own country out of the loop!
    While a glance at what is unfolding may simply be interpreted as stemming perhaps from lack of knowledge and experience on the part of Tanzania government officials.
    However, there is a school of thought that has recently been making rounds in the country to the effect that given the increased number of such incidents, Tanzanian government officials involved in such murky deals may after all not be so doom as the nation may want to believe!
    That such murky transactions/contracts are a result of well worked out deals that ensure such Tanzanian government officials fat pay packets!
    The telephone companies' mother ministry recently noted that it was easy to conduct the Zain transactions at international level, hence behind Tanzania's back because the East African country does not have local laws that cover such transactions.
    While the foregoing argument makes sense, but the question is when Tanzania decided to go international by inviting foreign investors, were government officials not aware of the existence of such problems?
    Unfortunately this is not the first transaction that has left Tanzania once again on the losing end.
    One of earlier transactions involved the sale of Celtel Africa to Zain Africa, and like the latest transaction, there is no evidence to show that Tanzania benefited from the transaction in terms of taxation.
    The present argument over the country's loses in the course of transaction was raised during the period by a section of Tanzanians who have the interest of their country at heart.
    One had then hoped that government officials vested with the task of playing oversight role, as far as foreign mobile phone companies are concerned, would have taken measures to plug the loopholes.
    Other transactions that raise similar questions include the recent sale of majority Vodacom shares to Vodafone, the sale of other telecom companies and government owned hotels to multinational hospitality gurus.

    Another controversy unearthed by the Parastal Organizations Accounts Committee, POAC, is the non submission of the share certificate of the government shares in AIRTEL.
    This as they say, makes it difficult for one to prove not only what the government has in that corporation, but also what it gets every year as dividends from its shares.
    As all this goes on, it should be noted that it's just recently, in 23rd March 2011, that President Kikwete in his visit to the Ministry of Communication, Science and Technology directed that the 35 percent of AirTel shares in TTCL should be bought so as to make TTCL a 100 percent government corporation.
    The President however, cautioned that the government's 40 percent shares in Airtel should not be exchanged with the 35 percent Airtel shares as they differed in value.
    POAC reached the 308m US dollars Loss figure following the sale of four million Tanzania subscribers at 252 US dollars each.
    It was expected that at least 30 percent of the whole amount would go to the government as a holder of 40 percent shares in the company.
    It is therefore high time that the government, through its ministries, agencies and authorities become proactive and act on loopholes in the laws and policies that cost the nation.
    It is foolhardy on the part of the government to continue to wait for assistance of Parliamentary Committees and the CAG to come and tell them things that they already know.
    Otherwise we will be forced to believe that their inactiveness is caused by bribes they receive from private companies that benefit from such loopholes.
    [​IMG]The Income Tax Act of 2004 has been cited several times as providing loopholes for those who have ill designs for our nation.
    Therefore the POAC's directives on the dire need for the government to amend the law should be implemented immediately.
    The committee that the Deputy Minister for Communications, Science and Technology promised its establishment to review the Act should include people from different sectors so as to make sure that all shortfalls are captured and amended.

    Tanzania fails to account for 24bn/- in mineral revenues [​IMG] [​IMG] [​IMG]The Tanzania government has failed to comply with requirements that would have made her a compliant member of the Extractive Industry Transparency Initiative, EITI.

    For a country to qualify for EITI compliant membership, it must exercise transparency and accountability in revenues that accrue from its resources such as oil, gas and minerals.

    Other conditions require that the country passes through what is referred to as the sign up stage, preparation, disclosure and dissemination stages.

    Tanzania's failure to comply with the EITI's requirements followed its failure to account for over 24bn/- earned through its mineral resources among other factors.

    Had Tanzania been cleared, it would have joined the six new EITI compliant countries which are the Central African Republic, the Kyrgyz Republic, Niger, Nigeria, Norway, and Yemen.

    The six countries were declared compliant by the EITI Board during its meeting held in Paris in March this year after complying with the body's requirements.

    Old compliant members include Ghana, Azerbaijan, Liberia, Mongolia and Timor-Leste.

    This makes the number of compliant states to 11 while 35 other countries that include Tanzania, remain candidates as they await fulfillment of compliance conditions.

    The validation was conducted on Tanzania after the country had gone through the two year period of accomplishing the four sign up phases which ended on February 15th 2011.

    On November 18th 2008, President Jakaya Kikwete issued a statement on his country's intention to join the EITI process so as to promote transparency and accountability in oil, gas and mineral revenues.

    It is suspected that the president's push for the EITI membership was a result of the public's outcry on the Buzwagi mine saga in 2007 as advocated by the Kigoma North member of parliament from Chadema (Chama cha Demokrasia na Maendeleo) opposition party, Mr Zitto Kabwe and also pressure that was brought to bear on the government by the country's key donors.

    The EITI which is an international standard for transparency in the extractive industry revolves around reconciliation/auditing between companies' payments and government receipts with the resultant report being made public.

    Tanzania's first report issued on February 8th 2011, revealed a major difference between what the companies claimed to have paid the government and what the latter declared to have received.

    What was more, the government could not explain the where about of the missing 24bn/- (not inclusive of the discrepancy in PAYE and NSSF) in mineral revenues, hence its failure to qualify for the EITI membership.[​IMG]

    In his speech to the EITI 5th Global Conference in Paris, France during the first week of March, 2011, President Kikwete said Tanzania's discrepancy in its earnings from mineral resources was to the tune of 36m US dollars (55bn/-). This amount includes the discrepancy in PAYE and NSSF amounts which are not taxes directly accruing from the extractive industry.

    The reconciliation report which was prepared by the Hart Group and BDO East Africa for the EITI Multi stake holder Group (MSG), covered revenues received by the government from foreign and local companies involved in oil, gas and minerals from July 1st 2008 to June 30th 2009.

    The report further points out that over 60 percent (45bn/-) of the revenue received by the government came from various forms of taxes levied against workers in the mining sector under review.

    This is shocking to say the least, especially when one considers that a sector that is supposed to give the government a lion's share in taxes compared to other sectors in the economy is deliberately left out by the government.

    The problem is compounded by claims that when the foreign mining companies first arrived in the country and established very high salary structures for their local employees, the government is alleged to have discouraged them, arguing that salaries should not be very much different from those from the government and other private sectors in the country!

    According to the report, El Hillal Mineral Ltd, the only Tanzanian large scale mining company that was covered by the report, declined to respond to the template that it was required to respond to and instead handed out a schedule that indicated the amount of royalties it had paid under the reconciliation period, ignoring other payments to the government that it was required to report.

    This leaves more questions than answers over those likely to be behind the company's arrogance in a country where cases of bigwigs both in the government and the ruling party are known to have owned companies which masquerade as foreign owned!

    CTS's investigations revealed that El Hillal Mineral Limited is Chaired by one, Hillal Hamad Hillal and received a diamond mining license in 2003 that covers an area of 38 square kilometers in Mwadui, Shinyanga Region.

    The company is reported to have invested over 20m. US dollars (30.8bn/-) and in 2008, the company got 12,875.15 carats of diamond worth 2.9m. US dollars (4.47bn/-) and paid royalties worth 143,500 US dollars (220,990m/-).

    The company was expected to get about 49,500 carats of diamond in 2009 alone, which was supposed to yield 10.9m. US dollars in earnings by then (16.78bn/-).

    It is therefore shocking for a company that earns a lot like El hillal to decline, with the exception of royalties, in revealing what they paid to the government.

    This leads to a possible suggestion that they might not be paying other taxes such as corporate tax and local government levies among others.

    Serious doubts are further raised by the fact that the company under review was associated with a dubious purchase of a public plot that was under the Parastatal Sector Reform Commission (PSRC) in 2007.

    The transaction not only shocked some government officials but some of them were quick to associate it with involvement by some of their friends in the government.

    Other shocking findings the CTS unearthed from its sources is the failure to be included in the EITI process of Tanzania Royalty Exploration Corporation-TRE a public Company registered in US stock exchanges.

    This company has over 132 prospecting licenses and it operates in the entire lake Victoria Greenstone belt and Kabanga/Kagera Nickel belt regions.

    The company is under the Chairmanship of one, James Sinclair who is said to be a close friend to President Kikwete.

    While this company has declared a loss that will be deducted from its profits until 2030 for income tax purposes in Tanzania, it recently recorded an unusually high trading volume at a US Stock Exchange where about 745,390 shares changed hands.

    Although the company undertakes exploration, it also receives royalties from five companies that have taken over its projects.

    The report shows that, Tanzania has been receiving revenue mostly and only from royalties as other taxes have not been rewarding due to several reasons.

    For example out of the 11 companies covered by the report, only five companies reported to have paid income/corporate tax.

    Other salient features accruing from the report include the government's lack of commitment in supporting the initiative as manifested by its failure to capacitate TEITI as an institution and also reluctance of buildin[​IMG]g the capacity of other government institutions such as TRA, MEM etc as they are expected to be involved in the transparency process.

    So far no law is in place to support the existence of TEITI and to oblige companies such as El Hillal Minerals Ltd to provide the required information.

    Not even the newly enacted mining law of 2010 provide for TEITI, this renders the initiative a toothless dog watching over the misdeeds of its boss, the Ministry of Energy and Minerals.


    In fact the disqualification of Tanzania comes not as a surprise to the public as the government has despite its bragging about its commitment in upholding accountability, has miserably failed in other transparency and accountability indexes.

    Such instances include the 2010 Transparency International Report, East Africa TI Report and the Revenue Watch Index of 2010 where Tanzania ranked 5th from the bottom out of 41 countries.
