    wana jf naombeni eilimu juu ya haya
    1.kuna madhara gani nikipangisha nyumba bila mkataba.
    2.je mkataba wa kupangisha nyumba nautoa wapi-je naubuni tu mwenyewe.na kama nikiubuni tu mwenyewe utakuwa na nguvu za kisheria?.
    3.je nikienda kwa wakili anaweza kuniandaloa mkataba-gharama zake vipi mimi mwananchi wa kawaida ntazimudu.
    Nambeni ufafanuzi juu ya haya.

    Mkuu kukujibu swali la kwanza
    Ni madhara sana kupangisha nyumba bila Mkataba maana in case of anything au mwenye nyumba akikufanyia lolote huna la kushika wala huna haki maana huna document yoyote kuthibitisha kuwa wewe ni mpangaji katika nyumba ile. Mkataba unakupa haki wewe kama mpangaji kujua mipaka yako ni ipi kwenye nyumba ile unapaswa kufanya nini na kipi ambacho hupaswi kufanya. Mkataba unakupa muda wako wa kukaa katika nyumba ile bila kubughudhiwa na mwenye nyumba na kiasi cha kodi unachotakiw akulipa kw amuda wako wa mkataba. Unakupa pia haki zako kama mpangaji na majukumu ya mweney nyumba inapotokea nyumba yake ipemata damage ya aina yoyote. Verbal contract ni mbaya sana kwa kuwa hutakuwa na haki yoyote mwenye nyumba akikukfukuza au akikupandishia kodi au akifanya lolote kwenye nyumba husika. So mkataba ni muhimu sana

    2> Mkataba wa upangishaji wa nyumba nenda kwa wakili yoyote anaweza kukuandalia sio gharama sana inategemea na muda wa upangaji wako kwenye nyumba husika na kodi yako kwa mwaka ila sio ghali sana. Huo wa kubuni mwenyewe mkuu una madhara yake iwapo kutatokea matatizo yoyote kati yako na mwenye nyumba maana huo wa kwako hautakuw ana muhuri wowote wa wakili kuthibitisha kuwa ni real agreement. Ila kama una utaalam na mambo ya sheria unaweza kuutengeneza na then ukampelekea wakili akusaidia kuufanya uwe na nguvu kisheria na auangalie kama hautakuwa na matatizo au hautakubana sana wewe au kumpa haki nyingi mwenye nyumba.

    Kama wewe ni mwenye nyumba (Lessor) kama nimekuelewa vizuri nafikiri badilisha tuu maelezo yangu yawe in your favour na yasiwe in the favour ya mpangaji 9Lessee)
    Yaani Mkataba uwe in favour ya Lessor usiweke masharti sana ya kumuumiza mpangaji (Lessee) na vile vile uwe na masharti ya kutekkelezwa na Mpangaji (Lessee)

Go to mwanasheria for less than 50,000 atakupa mkataba mzuri utakaokulinda wewe na pia utakaomfanya mpangaji wako kushikwa na uoga kuwa utamshitaki atakapoharibu nyumba na hivyo kuifanya nyumba yako itunzwe vizuri.
