    Salama wana JF!Niliuziwa kiwanja mbele ya adv. Kwa kupitia bank, kumbe hakina njia (sala2,DSM)nikatoa adv.20m,muuzaji amenizungusha,sasa sikitaki nataka mwanasheria atakaye recover hy pesa nimpe 2m.

    Mzee ulinunuaje mali pasi kutafiti eneo husika?? kurecovery inategemea na masharti ya makubaliano katika Mkataba wenu wa mauzo na iwapo taarifa za hali jhalisi ya kiwanja kulifichwa na kwa ufahamu wako hukuweza kuelewa (misrepresenation)..Nadhani huyo Adv aliyekusaidia angekuwa mzuri zaidi pia kukueleza sheria na kama kuna tatizo juu ya Makataba wenu ni vyema ungemjulisha shida ilipo ili kama anaweza akusaidie kwa kuzingatia na "facts" kamili ya issue yako.

    Kwa ushauri tu, kitaaluma, haishauriwi wala kuruhusiwa kwa Mwanasheria kupokea fedha ya Mteja katika suala linalohusu mabishano katika madai au kesi ya Mahakamani (contentious matters) kwa makubaliano kuwa atashinda. Vinginevyo utadanganywa tena. Hakuna Makubalina kama hayo kwani asipoweza ku recover hiyo hela yako, utamdai?? au ikiwa italazimika kufikishana Mahakamani, hiyo 2M itatosha kushughulikia kesi??..

    Mkuu, mkataba unasemaje? Nani aliyeandaa huo mkataba? Je ulikagua hicho kiwanja kabla ya kusaini hati ya makubalino? Je, muuzaji alikuwa na wajibu wa kukupatia njia kulingana na makubaliano yenu? Je umenunua kiwanja pamoja na njia au umenunua kiwanja pekee? Mkataba unasemaje? Ukiyajibu haya maswali basi utaweza kujua umesimama wapi katika madai ya marejesho ya hiyo 20 milioni.

    Pole, kanunue eneo uweke njia, ukienda mahakamani ndugu ni soo, kama wewe sio kina Chenge au Marehemu Dito kesi itakaa miaka kibao utafikiri mtoto, mie na kesi ya design hiyo toka 2003 mpaka leo, kwa mwaka inatajwa mara 4 tu kati ya hizo 2 mawakili hawapo, 1 hakimu ana udhuru hiyo 1 ndiyo inasikilizwa na unakuta kuna PO. Yaani unaweza ukafungwa wewe kwa hasira

    Mwisho mimi sihitaji kwenda mahakamani ila kwa wanaojua sheria nina imani wakitumia ujuzi wao wana nafikiri wanaweza kujua kama wataweza hiyo kazi au la na sihitaji kuua mtu kupata haki.

    Mh.Ngoshwe( a) nimeishalijibu wakati namjibu Ndugu Shadow,ni bahati mbaya kumbe ilibidi na Advocate niingie naye mkataba wa kujua hiyo pesa ninayomlipa ni ya shughuli gani,maana sasa ananionyesha kuwa kama hii si kazi yake-na sisi tusiojua sheria tunawaamini hawa wanasheria kama ma padri kuwa kila analokutendea analifanya kwa haki na kukutetea wewe,kumbe wakati mwingine inakuwa sivyo ( b)Hapa mimi fundi mchundo sikukuelewa kabisa,ila kwa lugha rahisi mimi nataka mtu amabaye nitaingia naye mkataba kuwa akikomboa hiyo pesa moja kwa moja nampa hiyo 2M,sidhani kama nahitaji kutoa 2M kabla sijapata hiyo haki,itakuwa kama nilivyotoa pesa nyingi kwa huyo mwanasheria wangu kabla ya ku own hiyo land.

    Mwenye eneo(njia) anadai hata kama nikitoa 100M hatoniuzia hiyo njia wala kuniruhusu kuitumia ndio maana naona si vyema nikaishi na majirani wa hivyo. Kesi?unachosema ni kweli na sina subira maana pesa yenyewe nilikopa benki nikijua nimemaliza jambo moja kumbe ndio nimezua balaaa maishani,sasa nakatwa benki kila mwezi.

    Pole inaonekana eneo lako halijapimwa, kama sikosei muuzaji aliongea na jirani aache wazi ili tu wewe ununue, au jirani alitaka kumuuzia njia akakataa, ilinikuta hii, ila badala ya makelele mfuate taratibu huyo jirani muombe akuuzie hiyo njia, then leta watu wa ardhi upimiwe na alama. Huko kwa advocate na mahakama naona kama unakosea kwa stage uliyopo muuzaji kakuachia soo tu, bembeleza upate njia, mie ilinichukua mwaka nimeuziwa 1.5m.
