Naomba msaada wa kisheria

    Ndugu zangu naomba msaada juu ya suala lifuatalo:
    Kuna mdogo wangu alikuwa anafanya kazi na moja ya makampuni ya kigeni hapa nchini kwetu, na wakati anaajiriwa alibahatika kupata mkataba wa kudumu(Permanent contract), na alikuwa na takribani miaka 2 anafanya kazi na kampuni hiyo bila matatizo yoyote kazini. Kampuni iliamuwa kuuza tenda ya kitengo cha operations (ma-engeneer wote) kwa kampuni nyingine ya kigeni ambayo yenyewe aina ya mikataba yake ni ya ku-renew kila mwaka, sasa nataka kujua je kisheria

    1. Huyu mwajiriwa alitakiwa kupata benefits gani kutoka kwa mwajiri wa mwanzo aliyevunja mkataba pasina kuwepo matatizo yoyote ya utendaji kazi wa huyu dogo?.

    2.Huyo Mwajiri baada ya kuvunja mkataba na huyu dogo wakamsainisha contract ya mwajiri mpya ambayo ni ya ku-renew kila mwaka, hii iko je kisheria?

    Kama amesha sign huo mkataba mpya inaweza ikawa ngumu maana kama ni kampuni ya maana watakuwa wamefikiria hayo na kuyaweka wenye mkataba mpya.
    So ninashauri msome mkataba mpya vizuri kwanza kuona makubaliano ni nini.

    Dogo mkataba ali sign wa mwajiri wa pili lakini kuna changes nyingi sana ziliondoshwa. sasa nataka kujua kisheria mtu akipatwa na kesi kama hiyo anatakiwa kulipwa vipi hasa nataka kujua upande wa mwajiri wa mwanzo alivunja mkataba.

    kampuni ya mwanzo ambayo inasitisha mkataba wake walipaswa kuwa-layoff wafanyakazi wao kabla ya kuhamishia mkataba kwa outsourced service. na huwa terms zinakua negotiable. sina hakika rates,lakini ukiuliza ofisi yoyote ya kazi(labour office) ambazo ziko chini ya wizara ya kazi utapata ushauri bure kutoka kwa wanasheria.

    japokua sasa kwa hiyo contract ya mwaka kila mwisho wa mwaka lazma mpeane gratuity/kiinua mgongo. na hiyo ni lazima iwepo kama sehemu ya mkataba na iseme kabisa ni asilimia ngapi,na yaweza kubadilishwa (kwa maana ya kuongezeka tu na si vinginevyo) kila mwaka.

    Kiinua mgongo ni Severance allowance ambayo ipo kisheria sio Gratuity mbayo inaweza kutolewa kwa discreation ya mwajirin (hana obligation)
