Mtuhumiwa kubadilishiwa kosa ni rukhsa?

    Wanasheria naomba mnijuze hili. Jana nilikuwa High Court ila jambo moja limesumbua akili yangu! Kuna mtuhumiwa alifunguliwa charge ya MURDER, aliposomewa shtaka lake mbele ya jaji akakana.

    Wakili upande wa Serikali akaomba Mahakama mtuhumiwa abadilishiwe charge badala ya MURDER iwe MANSLAUGHTER na jaji akakubali. Mtuhumiwa aliposomewa akakubali.

    Mwisho jaji kamnyeshea miaka 10. Je, nauliza hiyo kubadilisha charge kutoka MURDER to MANSLAUGHTER ikoje and under which provision of the law? And what the essence of the accused to plead guilty for a later offence while the former one of MURDER pleaded no guilty?

    Mkuu Matola kanda za mahakama kuu ziko nyingi inawezekana hakuwa ulikokuwa wewe.

    Tukirudi kwenye issue yako ni kweli unaweza kuwa umeshitakiwa kwa kosa la kuua. Polisi na mahakama wanatakiwa wajiridhishe kweli kuwa kosa la kuua limefanyika. Lazima like kosa lionyeshe kuwa there is a malice on the part of the accused.

    Kuwa alitenda kosa hilo akiwa amekusudia kabisa kuua. Na unajua kesi za murder ni lazima uproove beyond any reasonable doubt. Yaani uondoe doubt zozote kuwa kweli kosa lilitendeka accused akiwa intention ya kuua.

    Sasa mauaji mengine yanatokea kwenye ulevi au kupigana au kufumaniana au kunyang'anyana pesa au ugomvi mdogo mdogo wa kudhulumiana pesa.

    Haya yanatokea kukiwa na excessive force on the part either of the part in question.

    Sasa cases kama hizi mawakili kwa kushauriana na judge na baada ya upelelezi kukamilika na kwa kusaidiana na waendesha mashtaka wa serikali wanaona kuwa case ya murder ambayo ni kuua kwa kukusudia au with malice aforethought haiwezi kusustain ila case ya manslaughter ambayo ni kuua bila kukusudia inaweza kusustain.

    Nafikiri ndo maana ukaona kosa liliondolewa kutoka murder to manslaughter.

    Kuna kitu kinaitwa prosecutorial discretion. Kwamba, waendesha mashitaka wana mamlaka kamili ya kuchagua kumshitaki mtu kwa kosa lolote (au hata kutokumshitaki) pale ambapo wanaona kuna ushahidi wa kutosha kumshitaki mtuhumiwa.

    Pia kuna jambo la plea bargaining. Hapa mtuhumiwa anakiri kosa ambalo adhabu yake si kali kama ya lile kosa alilolikana. Na hilo hasa ndo nadhani lililotokea kwenye hiyo kesi unayoizungumzia wewe.

    Kesi ya kuua kwa kukusudia adhabu yake ni kali kushinda ile ya kuua bila kukusudia.

    Nashkuru sana my learned brother kwa ufafanuzi mzuri wa kisheri. Lakini kuna provision of the law inayoexpress hiyo kitu? If yes, can you let it out? Its a matter of correction, mie sikuwa Dodoma town bali hiyo case ilikuwa Kondoa. Thanks.

    Mimi nanamtizamo tofauti kidogo. What i know is charge lazima iwe ya murder na itabaki kuwa ya murder... Swala la mansloughter linakuja baada ya mahakam kusikilza ushahidi wa pande zote mbili, baada ya mahakama kujiridhisha bila shaka kuwa ushahidi ilitolewa haukidhi for murder the conviction can be brought on mansloughter, that is the law.

    yap , UNDER THE CPA, kuna alternative verdict, where by the court can impose alternative vertidic for some offencence if the evidance adduce doesnt prove the alleged offence, and on alternative verdict the the alternative offence most be lesser offence. Example, rape to attempted rape, murder to mansloughter, killing by a mother of an infant to simple arbortion, this alternative verdict under court discreation not prosecution.

    Are you an attorney?

    So is it fair to say that ours is a system of mandatory prosecution and not that of prosecutorial discretion?
