    Wanajanvi hasa hili la sheria naomba msaada wenu muhimu.
    Babu yangu anamiliki ardhi na shamba la miti hapo hapo.Kuna taasisi ambayo inataka kujenga chuo hapo kijijini na tayari imenunua viwanja na mashamba ya watu lakini babu yangu amekataa kuuza kwani anasema pesa ni kidogo anayolipwa.
    Sasa kinachotokea ni kwamba ambao hawajakubali kuuza watanyanganywa na serikali itapatifisha.Je serikali au watu wanaweza kumlazimisha mtu kuuza mali yake bila kukubaliana na sheria inasemaje kuhusu hilo?

    serikali that means rais anaweza na ana mamlaka kisheria kuchukua ardhi for the public interest yani kwa manufaa ya umma.yeye rais ndio mmiliki wa ardhi yetu hapa tz yani ni trustee.specific section to that effect angalia Land act.kwa watu binafsi hawezi kumlazimisha only president can.
    sasa basi kama ikionekana kwa rais kujenga chuo ni for the public interest hapo babu yako hana chake but atakua compasated accordingly.hiyo compasation inabid iwe reasonable.
    angalizo.yani kujenga chuo nadhani na ninavyomjua rais wetu atawapa tu coz kwake ni for the public interest kama ameweza kuuza eneo la mahakama kuu kwaajili ya maegesho ya magari sembuse hapo kiwanja kilicho na miti?

    Duh kumbe Tanzania hakuna property rights mh nilikua siwajui vizuri sasa huyo babu anawezadhulumiwa na serikali you have to change the constitution baana.

    as a general rule property right ipo tz but as you know every general rule has got exceptions.na hapo ndio ardhi kama property inakua na exceptional.hapo waliangalia mbali kuweka exception katika baadhi ya property coz kwamfano wetu huo wa babu ambaye hataki watu wawekeze kwenye ardhi yake kama angekua na propert right inayomprotect basi kila mtu angefanya anavyotaka na kungekua hakuna maendeleo.unajua hata suala la kuuza viwanja inabidi mwenye kiwanja auze according to the market value sio ku-undervalue au ku-over value,hapo ndipo wale wanaofanya valuation wanapoingia na kufanya kazi yao.

    Mkuu umenipa mwanga lakini naomba nikulize swali inamaana nchi kama Uganda,Kenya and S.Africa wenye property right and private property ambayo inatenganisha collective ownership hawezi pata maendeleo. Je kama hiyo sheria inaongelea public land ownership au private and communal land ownershi?
    It seems Tz you are still under Ujamaa village land ordinance even though I read some article written by Shivji on land law reforms but I think this didnt matter.
    Je ikitokea kuwa huyu mtu ameweka rehani ardhi hiyo Benki so as to secure a loan serikali italipa hiyo loan pamoja na kumpa fidia huyo mtu?

    ok mkuu.suala la maendeleo tusiangalie kwa upande mmoja tu huo wa ownership.hapa kuna vitu ving sana.mfano s.Africa hao unaosema wametuzidi maendeleo though unasema inatenganisha collective ownership etc it is not bcoz ya kutenganisha property right na collective.Tz waliona kwa ardhi ndo big deal but still hamna kitu.
    sheria inazungumzia ardhi kuweza kumilikiwa co-ownership,tenancy in common(hapa kidogo inabid darasa )
    kama mtu amemortigage ardhi yake bank kama ulivyosema kupata loan na serikali(RAISI)by using his power ikaona ardhi husika ni kuimilikisha kwa mtu mwingine for the public interest itafanya compasation kwa lika kitu.yani hapa nazungumzia fidia kwa kila mtu ktk ardhi husika.
    WHAT AMOUNT TO PUBLIC INTEREST?yani hapa ndo kazi kubwa inapozuka to define what is public interest.the president has wide power on to decide what is public interest.

    So where does the president get power an legitimacy if not from the outdated and oldfashioned constitution?What is the cost of allowing people to decide on how to their properties by adhering to the law than the state to use its illegal power an injustices to take away people's rights?Mkuu nadhani we should not exhaust much on what u said kwamba inataka darasa.
    Let us base on this devine right,absolute and premier power of the state and president.It will come the day that if you have an expensive car while many people arround you are poor the state may decide to sell it so has to empower the poor.
    Tanzania need along journey to make changes because it is clear you are still using the ex-colonial system like that of British governor in British Africa Colonies and this shows there is no limit of state's to the citizens.
