    Wadau salaam!mim nimeingia matatizoni na mwenye nyumba yangu juu ya suala la upangaji,mkataba wangu uliisha mwishoni mwa mwezi july 2012,na mkataba wa awali ulikua wa miezi sita,baada ya kuongea na muwakilisha wa mwenye nyumba tulikubaliana kua ningeongeza mkataba wa miezi minne kwa kua natarajia kuhama mkoa mwishoni mwa mwaka,tulikubaliana nikamtumia mwenye nyumba kiasi cha shilingi 340,000 na kuahidi kummalizia 60,000 pindi atakaponikabidhi mkataba wangu,cha ajabu juzi amenipigia simu na kuniambia kua amepata mpangaji mwingine atakaempa tshs 120,000 kwa mwezi,hivyo nimruhusu huyo mpangaji mpya kuingia ndani kukagua vyumba na natakiwa niwe nimehama ndani ya siku tatu naye angekata hela niliyokaa kwenye nyumba na kunirudishia iliyobaki,maelezo hayo alinipa kwenye simu bila maandishi,mimi sijamjibu lolote mpaka sasa,naomba msaada wenu kisheria wadau,je hakuna sheria inayonilinda mimi kama mpangaji katika suala ili!asanteni

    Kama ndio hivyo basi una haki ya kupewa notice ya siku 90 kabla hujatolewa.
    The second thing ni kwamba mikataba mingi huwa haijakamilika kisheria kwa sababu mwenye nyumba halipi kodi na hajasajiriwa kama mfanyabiashara. Kwa hiyo hata kupeleka kesi mahakamani inakuwa ngumu na kesi zinaishia kwenye mabaraza ya serikali za mitaa yanayoongozwa kwa asilimia kubwa na rushwa. Kwa hiyo kama mwenyewe hauko present physically usishangae ukikuta vitu vyako vimetolewa nje illegally.

    Mkuu unachoongea ni sahihi kabisa,so mfano mtu ukifikwa na janga kama la ndugu yetu hapo,unatakiwa kuanzia wapi,maana mabaraza ya serikali za mitaa kweli ni rushwa tupu

    Cha kwanza ni kuhakikisha kuwa mwenyewe unakuwepo physically eneo la tukio. Pili kuwa mkali na mwenye nyumba na umwambie kuwa una mali za thamani zikipotea utamshitaki mahakamani. Mara nyingi mwenye nyumba akiona mpangaji ana uwezo wa kumtunishia msuli anaogopa kwa sababu asipoangalia in the end atatumia pesa nyingi kuliko pesa atakayopata kwenye nyumba. Mtu mjeuri inatakiwa kudeal naye kijeuri tu. Kwenye chemistry wanasema "like dissolve like"

    ZeMarcopolo, nimependa point yako hapo juu kuhusu contracts za nyumba kutokuwa legally binding. unakuta mda mwingi tunavyopangisha nyumba unapata mkataba ambao una *legal holes* nyingi, kwa mfano kuhusu eviction, length of lease, rent increase na zinginevyo. nina mkataba wangu specially drawn for me and my landlord na inanilinda + kumlinda (which is what a good contract should).

    mie sio mtaalam wa law (naijua but not enough to call myself a lawyer of any type) na ninaweza chora a good tenant-landlord lease ila ningekuomba kama we mwanasheria uchore a kind of lease ili watu waone how a good and binding contract should look like.

    Asante kwa kunifumbua macho mkuu,ila kuna mambo mawili ambao nina shaka nayo labda unisaidie kiushauri mkuu,kama nilivyosema,katika hiyo hela ya miezi minne,alikua ananidai 60,000 ambayo ilikua nimmalizie siku ya kunipa mkataba,je hawezi kunigeuka na kuchukulia kama ni kigezo cha kusema ameamua kunitoa na kunikata hela ya mwezi mmoja na kunirudishia iliyobaki??pili ni kweli ulichogusia juu ya rushwa kwenye baraza za serikali,na huyu mwenye nyumba wangu anajuana sana na hao watu wa serikali za mitaa,je kuna sehemu nyingine ambayo naweza pata haki,na je akitaka kuni evict kwa nguvu sheria inasemaje?

    Kimsingi chombo cha kulinda sheria na mali zao ni Polisi. Unbatakiwa kutoa taarifa Polisi kuwa mwenye nyumba wako anadalili za kukutenda vibaya. Polisi watakushauri nini cha kufanya lakini more importantly watakuwa wameshajua kuhusu hilo. Mjulishe mwenye nyumba kuwa Polisi wanafahamu. Changamoto nyingine ni kwamba Polisi hawako rushwa free ingawa hapa ni tofauti kidogo.
    Kama mwenye nyumba ana bad intention, the more atakuona uko aggressive the more atapunguza kukusumbua.

    Asante sana mkuu,kwa kweli umenisaidia sana,nilikua nina wasiwasi anawaza ni evict kwa nguvu,ila je kuhusu hiyo 60,000 ambayo ndio ingekamilisha 4 months awezi kuchukulia kua ndio kigezo cha kunibana kua nimevunja mkataba?maana nimemuambia aje kuchukua na tuwekeana mkataba amekataa,anang'ang'ania nihame na anirudishie hela iliyobaki

    Japo me si mjuvi wa sheria,ila sidhani kama ana uhalali wa kukuondoa ndani ya nyumba kwa kua haujammalizia hiyo 60,000 na ukizingatia kua yeye ndie aliyeikataa,eviction uwa si moja kwa moja hata kama ungekua umepitisha mwezi bila kulipa kodi,uwa kuna procedure,ila kwa kua wengi hatujui haki zetu ndio maana wenye nyumba uwa wanafanya watakavyo!labda Zemarcopolo na Leh wanirahihishe hapo kama sipo sahihi
