Msaada; regulation or law governing opharnage operations in Tanzania.

    Naomba msaada kwa yeyote mwenye nazo au anayefahamu wapi naweza kudownload regulations au sheria inayoongoza uendeshaji wa vituo vya watoto waishio katika mazingira magumu. na kama hizo regulation pia zinazungumzia mambo ya mishahara na marupurupu mengine ambayo wanapaswa watumishi wa hivi vituo wapate.

    Nimejaribu kuangalia ile minimum wage order iliyotolewa na serikali ya mwaka 2007, aina hii ya organisation haipo, nimewasililianan na wizara ya kazi - kitengo cha wage board kinachohusika na kutengeneza hii mishahara na marupurupu mengine wakaniambia ni kweli hiyo sector bado haijatungiwa guideline yeyote.

    Nimejaribu pia kusurf kwenye web ya ministry of health and social welfare nikitumaini labda nitakuta maelezo yeyote kuhusu welfare department kwa sababu ninadhani kuwa hivi vituo inabidi vifanye kazi chini ya wizara hii (kutokanan nan jina la wizara) pia sikufanikiwa.

    Ninaomba anaeweza kunisaidia afanye hivyo.

    Sidhani kama kuna sheria tofauti na hii ya Jumla ya Ajira na Mahusiano Kazini (Employment and Labour Relations Act, 2004). Vituo vingi huwa vinaendeshwa kama mashirika yasiyo ya Kiserikali (NGOs) na kwa hilo taratibu zao zainsimamiwa na Sheria ya NGOs, 2002. Lakini suara la ajiri za watumishi sina shaka kuwa linasimamiwa na Sheria za jumla za kazi kama hiyo ELRA, NSSF, nk nk ambapo waweza kukuta pia kuna vituo vinaandaa na miongiozo yao ya Ajira na utumishi (Staff Regulations) ambamo humo unaweza kukuta very specific employment issues za kila Organisation ambapo kiutaratibu hazipaswi kwenda kinyume na Sheria za nchi.

    Ila sifahamu lengo lako hasa ni nini kwenye hili lakini kama ukitaka kupata some laws za TZ na kwengineko duniani kama ni suala la utafiti waweza kucheki kupitia Word Law Guide kwenyehttp://www.lexadin.nl/wlg/

    tatizo langu kubwa ni kuwa, kwenye sheria ya sasa hivhi ya ajira pamoja na minimum wage order haitoi muongozo NGOs mishahara yake na marupurupu yanapaswa yaweje, na sijaona popote ambapo kuna guidancec haswa kuhusu swala la marupurupu mfano leave allowance house allowance kama inavyoainishwa kwenye hiyo order kwa sector zingine. kwa ufupi hii ni sehemu ya kazi yangu katika hii organisation ninayo fanya lakini nakwama kutoa maamuzi fulani fulani kwa sababu ya kushindwa kujua nisimamie wapi.

    Nikusaidie kwa hii attached fact sheet ya KEPA:

    "NGO Work in Tanzania
    Highlights of relevant facts, policies and laws"

    Inazungumzia pia watumishi wa NGOs na kuekeza muongozo wa kisheria kuhusu mishahara na marupurupu kwa mujibu wa "wage Order (The Labour Institutions (Regulation of Wages and Terms of Employment) Order, 2007 GN. No 223/2007 ). Nadhani kama ni msingi wa kisheria utapata hapa na ukisoma vyema.

    Aidha, kama ni Mwanasheria sina shaka kusema unajua kuhusu "rules of construction" pale kwenye "lacuna" , ...kanuni ya jumla ni kutumia "common sense approach " . Hivyo, utahitaji kufanya utafiti wa kina kupata misingi (justification) kupitia miongozo inayotumika na Mashirika mengine yenye muundo kama hilo la kwenu ili kuishawishi kwa mifano hai hiyo Manejimenti yenu.
