Msaada kwenye sheria za upangaji nyumba

    Wasalaam wanajamii!!!

    Mimi ni mpangaji katika nyumba ambayo nalipia pango kwa tzs 200,000/= kwa mwezi.
    Niliingia mkataba wangu trh 24/12/2011 wa miezi sita, wa jumla ya TZS 1.2ml, ambao kwa mahesabu unaishia trh 23/6/12.

    Lakini katika pesa nilizozilipa kwa mwenye nyumba ni tzs 1.35ml yaani ziada ya tzs 150,000/=
    Dhamira yangu ni kuendelea na mkataba, ila kutokana na sababu zilizo nje ya uwezo ambazo ninamatarajio kuzitatua kipindi ndani ya wiki kutoka sasa, sikua nimelipa baki ya tzs 1.05ml kwa ajili ya kuendelea na mkataba yaani kuanzia trh 24/6/12-23/12/12

    Lakini katika hali ya kutia shaka na kushtua mwenye nyumba wangu jana nimekuta amenipa barua ya notice ya siku nne, yaani kuanzia trh 4-7-12 hadi 7-7-12 niwe nimeshahama la sivyo atatupa vyombo vyangu nje.

    Nikamueleza (kwa njia ya cm) kuhusu nafasi ya kuongeza pesa katika kipindi kisichozidi wiki moja, yeye akasema hayo ndio maamuzi yake na ameshapata mtu mwingine na ameshachukua kodi...kinachotakiwa ni kufanya kama alivyoamua.na atanipa hiyo laki yangu na nusu iliyo zidi.

    Naomba msaada wa kisheria kama ndivyo ilivyo kwenye sheria za upangaji kuwa mwenye nyumba anayo maamuzi ya kivyo.

    Sheria haimruhusu mwenye nyumba kutoa notisi fupi namna hiyo.Notisi lazima iwe ni ya siku 30 na ieleze kinagaubaga sababu za kutaka kuvunja mkataba,na isiwe notisi ya kuvunja mkataba(notice of termination)bali iwe ni notice ya lengo la kuvunja mkataba (notice of intention to terminate).Pili,mwenye nyumba hana haki ya kurusha vitu vyako nje bila utaratibu.

    Thanks Mayenga, kama niliyoeleza kwenye thread yangu...mimi mkataba wangu tuliosainishana uliishia trh 24/6/12 na kukawa na ziada iliyokuwa upande wake, ya 150, ila maelewano ilikuwa ni mimi kuongeza...ila kabla sijaongeza ndo akasema hayo.
    Je hawezi kutumia kipengele hicho na kinaweza kuniathiri kwa kiasi gani kwa uelewa wako.

    Hata kama mkataba umeisha haujalipa,eviction is not automatic.
