    Je mpangaji katika nyumba analindwa vipi na sheria dhidi ya wenye nyumba wanaopandisha kodi za nyumba kiholela?. Endapo mpangaji anaamini kwamba mwenye nyumba amepandisha kodi kwa kiwango kikubwa je alalamike wapi

    Kama ulishampa mkataba na amekupandishia kodi kwa rate amabayo ni kubwa unampeleka kwenye baraza la ardhi la kata na kumlalamikia. Sheria inakulinda na kukupa haki kama mpangaji.

    Katika hali ya kawaida kisheria mwenyenyumba ana haki ya kupandisha kodi ya nyumba yake apendavyo. Sasa basi kama mmeingia kwenye mkataba wa kupanga wa miezi sita au mwaka, na mkataba hauna kipengele kuhusu kuongeza kodi, basi mwenye nyumba hawezi kisheria kuongeza kodi mpaka mkataba uishe. Kama kipengele cha kuongeza kodi kipo basi uongezwaji wa kodi utafuata masharti ya mkataba.

    with due respect sio kweli kwamba mwenye nyumba anayo haki ya kupandisha kodi apendavyo kuna vigezo anatakiwa kuangalia kama location ya nyumba yenyewe, market forces na ubora pia wa nyumba.
    Kwa sasa hapa nchini hakuna sheria inayoguide maswala ya rent baada ya serikali kuifuta Rent Restrictions Act ndio maana wenye nyumba wanajifanyia wanavyotaka.
    Sasa kama mwenye nyumba wako amekuongezea kodi kwa kiwango ambacho huridhiki nenda peleka maombi yako Katika District Land and Housing Tribunal ukitoa sababu kwanini hukubaliani na hilo ongezeko na kuomba apunguze hiyo kodi aliyoongeza. Usiende kwenye baraza la kata hawatatoa sound decision after all kata ni usuluhishi tu ndio unafanyika na hilo suala lako sidhani kwmaba linahitaji usuluhishi kwani sio kwamba umepewa notisi kwamba kodi itapanda bali ameshapandisha.

    Inawezekana ana mkataba lakini hauna kipengele kinachohusu kodi si unajua mikataba mingi sio standard watu wajiandikia tu alimradi.

    Kama "hakuna sheria inayo guide maswala ya rent," tusaidie kujua unavyosema mwenye nyumba hana hana haki ya kupandisha kodi atakavyo authority yako ni nini?

    Soma Land Act ina vipengele vya hahusiano kati ya mpangaji na mwenye nyumba. Vile vile mahusiano yapo katika mkataba wa upangaji. Katika ongezeko la kodi mwenye nyumba ana haki ya kuongeza kodi baada ya kutoa notice ya siku 30.

    Daisy inategemea unaongelea sheria za wapi ila Tanzania kama ulivyosema Rent Restriction Act ilifutwa na hakuna sheria inayomzuia mwajiri kupanga kodii ya nyumba yake, na kama hakuna sheria inayomzua ina maana kwamba anaweza kupanga kodi atakavyo.

    Hatuongelei "mwajiri" hapa, tunaongelea upangishaji nyumba, sio sheria za kazi.

    Amendment ya 2005 iliyofuta Rent Restriction Act ili introduce new guideposts limiting payable rent.

    Misc Amend. 11-2005 (15)

    In determining the amount of rent payable under a
    lease, regard shall be had to:

    (a) size of the land;
    (b) use of the land;
    ( c) value of the land as evidenced by leases in the
    market in the area where the land is located;
    (d) location of the land; and
    (e) condition of the land or building.

    (4) For purposes of determining the amount of rent payable,
    it shall be taken into account that the lessor will pay:

    (a) the land rent under a granted right of occupancy;
    (b) the premium for insuring the land;
    (c) the property tax and other rates leviable upon the
    land under any law; and
    (d) any repairs for which the lessor is liable by
    agreement or customs or any law."
