    Ndugu zanguni; tarehe 30 Jan, 2012 niliasaini mkataba wa ajira inayoanza tar. 31 Jan hadi 31 JAN 2013. Jamani kazi ilikuwa ni project ambayo nilitakiwa kwenda kuripori mkoani tarehe 31 Jan, 2012. ilikuwa kazi ya kufundisha IT kwenye chuo flani Iringa. Project hiyo ilihusisha pande tatu, yaani kampuni iliyoniajiri na chuo ninachokwenda kufundisha na mimi mwajiriwa. Hivyo tar. 31 Jan, niliondoka na kwenda kuriport kituoni.

    Nilivyofika ilionekana kwamba chuo hakikuwa na mpango wa kuendesha project hiyo kwa mwaka huu kutokana na sababu mbali mbali. Hivyo nilitoa taarifa ofisini kwangu (yaani kwenye kampuni iliyoniajiri) kuhusu yaliyotokea. Kwa kweli walinihudumia kwa kila kitu kuanzia nauli, chakula na malazi. Baada ya kutoa taarifa ofisi iliwasiliana na chuo kujua kulikoni na wakati huo nilisubiri takribani wiki moja na kidogo wakati nasubiri muafaka. hata hivyo ofisini wakanitaka nirudi kwanza ambapo nilirudi Jumamosi tar 11.2.2012 na kuripot ofisini jumatatu. hata hivyo wakaniambia j4 tar.14 kutakuwa na kikao. so niende baada ya kikao.

    Baada ya kufika waliniambia kwa vile hali halisi nimeiona na nia ilikuwa ni njema tu ya kufanya kazi na mimi ila imekwama kama nilivyoona nikae tu nyumani kama watafikia mwafaka na chuo watanijulisha niende tena nikaripot kwa kazi kituoni la hasha nisubiri project nyingine itakayoanza mwezi wa tano vinginevyo nikipata kazi kabla ya mwezi wa tano niwajulishe ili watafute mtu mwingine.

    Kuhusu mkataba wa sasa na kipindi chote tangu kuaza kwa mkataba hadi leo 14.02?? niliuliza, wakaniambia hali halisi yenyewe umeiyona tunaomba tu uchukuliane na sisi maana hatuna cha kukulipa.

    Hujasema terms za mkataba wako. Kwa haraka haraka tu mktaba huo kwa lugha ya kisheria unajulikana kama Special contract employment.Kila mkataba una terms zake ambapo unaoonyesha haki za mkataba huo kwa upande wa mwajiri na mwajiriwa. Ebu upitie vema mkataba wako kisha utuambie vipengele vilivyokiukwa na mwajiri wako kinyume na makubaliano yenu ndani ya mkataba.

Ulitakiwa kutueleza hizo sababu ili tujue kama zilikuwa kwenye ufahamu wao au zilitakiwa kuwa kwenye ufahamu wao au la, maana mkataba unaweza kufika mwisho kwa sababu zisababishwazo na frustration na hapa hakuna wa kulaumiwa.[/FONT]

    Ulipewa mkataba ? au ndiyo simple contract umeitwa na kupewa maagizo kwa mdomo na ku saini fedha!!! hiyo itakuwa ni Void!!!

    Mkataba wa "mdomo" bado ni mkataba, verbal contract.

    Anyway mimi nadhani wakufidie kwa kipindi kati ya mwanzo wa mkataba wenu hadi walipokuambia kuwa hakuna hiyo project tena, ila mkataba wako ndo unatakiwa udefine kitu gani kitokee kama project ikiwa canceled kabla ya kuanza.

    Sheria ya Ajira na Mahusiano Kazini No6 ya 2004 imeanisha aina kuu tatu za mikataba, ambazo ni:-
    1. Mkataba wa kazi maalumu (contract of specific task)
    2. Mkataba wa muda muda maalumu
    (contract of specific period of time)
    3. Mkataba wa usiokuwa na muda
    maalumu(unspecified period of time)

    Sasa kati ya hiyo tueleze wako uko je??

    Alafu, Mkataba ni makubaliano ya pande mbili ilikuwaje wa kwako unahusisha pande tatu????,

    Lkn hata hivyo inabidi utambue kwamba mkataba unaweza kushindwa kutumizwa kutokana na mazingira fulani fulani, mfano ni kama wewe ulivyojionea.( Contract seemed to be Frustrated)

    Kawaida, mwajiri akivunja mkataba gafla mwajiriwa hanabudi kulipwa fidia ya mshahala wa miezi 12 nakuendelea( compensation not less than 12months salary), Notisi(1month salary in leu of notice)

    Yote kwa yote angalia mazingira yenyewe kama unaona kuna hali ya kufanyiwa zengwe ili ukose hiyo ajira basi fika Ofsi za CMA au Wizara ya Kazi na Ajira kwenye ofisi za Idara ya kazi utapata ufafanuzi, na hapo kama utakwama ni PM.

    Kisheria una haki ya kulipwa mshahara wa mwezi mmoja na nauli ya kukurudisha ulikotoka lakini kazi hukufanya unataka ulipwe kwa lipi?Jaribu kuwaelewa kama walivyokuomba lakini ukianza hayo mambo ya kutafuta pesa ya mwajiri bila kufanya kazi utaishia pabaya

    Ni kweli mkuu inabidi uweke vizuri mkataba wako ulivyo. Inawezekana wewe una mkataba na mwajiri wako ambaye ndiye alikuwa na mkataba na huyo uliyetakiwa ukamfanyie kazi. cheki kama terms zinakupa nguvu wewe au mwajiri wako. Ni sawa na mimi nikimiliki kampuni yangu nakupa kazi ukafanye mkoani hapo ujue kuwa wewe una mkataba na mimi na sio kule unakoenda kufanyia kazi. Kuna mambo hapa ya privity of contract na contract for/or service ingawa suala zima ni la sheria ya ajira nadhani wanasheria watatusaidia ukiweka mambo sawa hapa

    Kama ulipewa mkataba ebu peruzi Termination clauses maana wengi huwa wanatoa mshahara wa mwezi mmoja ingawa its mostly to confirmed employees

    Fikiria kama mwenzako aliacha kazi yake ya awali ili akafanye hii si familia yake itakuwa matatani? Ila mhusika hakuweka wazi maana hiyo ilikuwa ndani ya probation period na mkataba kamili ulikuwa haujaanza anastahili kulipwa mshahara wa mwezi mmoja.

    hiyo kampuni iliyokupa kazi nadhani unaongelea job agency wanaosaidia kumpatia mtu kazi sasa wao lazima wana vipegele vyao soma contact yako kama ulisaini vizuri. ila wao lazima wana yao kuhusu wao na wateja wao kama hao ila nadhani wao lazima pesa walizotumia watarudishiwa wajuavyo wao na hicho chuo.

    fata walivyokushauri kwa sasa ila soma vipengele vyao wao vinasema nini juu ya wateja na watu wanaowatafuta kama nyie.
