    Baada ya chama cha CUF nchini Tanzania kumfukuza uwanachama Mbunge Hamad Rashid , Mbunge huyo aibuka na kusema yeye bado mwanachama halali wa chama hicho. Anaeleza mambo yakiwa mabaya zaidi upande wake ataanzisha chama kipya cha siasa.

    Alianza kuharibu wakati ule alipotaka kanuni za bunge zibadilishwe kuhusu kambi rasmi ya upinzani bungeni, kwani hapo ndipo alipojionyesha kuwa ni mroho wa madaraka,kwani kile alichokuwa anawalalamikia Chadema ndicho hicho na wao Cuf walichokifanya wakati ule wakiwa na viti vingi bungeni na Nccr wakifuatia. Wakawatosa Nccr wakawakaribisha Udp. Hii ni dhambi kubwa sana, ona hapati saport ya kutosha toka kwa wanamageuzi na wananchi wa kawaida, japo kweli yaweza kuwa ameonewa

    MBUNGE wa Wawi, Hamad Rashid Mohamed, amepinga uamuzi wa Baraza Kuu la Uongozi la Chama Cha Wananchi (CUF) kumvua uanachama, akisema ni batili na umekiuka amri ya Mahakama.​

    Wakati Hamad akitoa tamko hilo, Msajili wa Vyama vya Siasa nchini, John Tendwa amekilipua CUF, akisema uamuzi wake wa kumfukuza uanachama Hamad, haukuzingatia maslahi ya wapiga kura wa Jimbo la Wawi, bali matakwa ya wachache ndani ya chama hicho.

    Licha ya kuwepo zuio la mahakama, juzi Baraza Kuu la Uongozi la CUF, lilimvua uanachama Hamad Rashid na washirika wake watatu ambao ni Mjumbe wa Baraza Kuu (Tanga), Doyo Hassan Doyo, Mjumbe wa Baraza Kuu (Pemba), Shoka Khamis Juma na Juma Saanane ambaye ni Mjumbe wa Baraza Kuu Unguja.

    Hatua hiyo ilimfanya Hamad kuitisha mkutano na waandishi wa habari jana na kutoa tamko kuhusu uamuzi huo ambao aliuita kuwa ni batili kutokana na kukiuka amri ya Mahakama kuzuia mkutano.

    Alisema muda mfupi kabla ya tangazo la kufukuzwa kwao uanachama, Mahakama Kuu Kanda ya Dar es Salaam ilitoa amri ya kuzuia kuendelea kwa kikao cha Baraza kuu, lakini baraza hilo lilikaidi na kuwafukuza.

    Mbunge huyo alisema: "Niliwaomba wanipe muda wa kujitetea kama wao walivyochukua muda wa kunihukumu, wakakataa. Kikao kile kilikuwa na watu wazito kama Waziri wa Sheria wa Zanzibar, Jussa, Taslima na Makamu wa Rais wa Zanzibar, wote wakiwa wanasheria, lakini wameshindwa kufuata sheria."

    Hamad Rashid alihoji, "Kiongozi wa Serikali kama Maalim Seif anakataa kutii amri halali ya mahakama? Akija kuwa rais itakuwaje? Nimeogopa sana?"

    Hata hivyo, Hamad na wenzake walisema wataendelea kupigania haki yao ndani ya CUF mpaka ipatikane."Tunaheshimu uamuzi wa Mahakama. Kwa amri hiyo uamuzi wa Baraza Kuu ni batili. Bado sisi ni wanachama halali..., bado mimi ni mbunge na tuna mashiko ya kuendelea kufanya kazi za chama," alisisitiza. Alisema, "Jana (juzi) nilipata simu zaidi ya 15 za wanachama kutoka mikoani akiwemo aliyekuwa mbunge wa Chadema Jimbo la Tarime, Charles Mwera wakiniunga mkono."

    "Wana CUF mikoani wametangaza kutuunga mkono. Mwanza wameandaa maandamano, Tanga wamesema hadi leo jioni watakusanya kadi 2,000 kwa Dar es Salaam Temeke wameshakusanya kadi 600 na mikoa mingine mingi". Alisema hukumu dhidi yao ilikuwa imeshaandaliwa hata kabla ya kusikilizwa na kwamba hata Kamati ya Nidhamu iliyowahoji haikuwa halali kikatiba.

    "Tumefanya mabadiliko ya Katiba ya chama mara mbili. Kifungu cha 81 cha Katiba ya chama kinaitaka Kamati ya Katiba iidhinishwe na Baraza Kuu, lakini wajumbe wote wa kamati ile wanakaimu nafasi zao. Makamu mwenyekiti wa chama huyo huyo ndiyo aliyeongoza kikao cha Kamati ya Nidhamu na huyo huyo ndiye aliyeongoza Baraza Kuu kutuhukumu," alisema.

    Alisema Baraza Kuu halikutenda haki ya kusikiliza kila upande na kuongeza: "Kwa kuzingatia ‘natural justice', Baraza Kuu limepoteza uwezo wa kusikiliza na halina sifa ya kutenda haki. Baraza hilo lenye wanasheria wengi, lakini halikutupa nafasi ya kutusikiliza."

    Tuhuma dhidi yake
    Kuhusu tuhuma alizopewa kabla ya kufukuzwa, alisema Kitabu chake cha ‘Yaliyojiri' alichokitunga mwishoni mwa mwaka jana ndicho kimesababisha yote.Katika kitabu hicho, Hamad ameweka barua aliyowaandikia viongozi wa chama hicho akiwaeleza mwenendo mbaya wa chama hicho.

    Hata hivyo, Hamad Rashid alisema uongozi wa chama hicho akiwemo mwenyekiti Profesa Ibrahim Lipumba, walimwonya asiendelee kukisambaza kitabu hicho naye akaacha.

    "Hivyo nimehukumiwa kwa kutoa kitabu hicho wakati tayari nilishaacha kukisambaza. Fedha iliyotumika kutufukuza ingetosha kabisa kugharimia matawi mikoani. Waulizeni nguvu waliyotumia kwenda Mwanza, kuzunguka Zanzibar, Lindi na Mtwara yote kuwaambia kuwa eti Hamad ni msaliti" alisema na kuongeza:,

    "Mimi kama nimetumia fedha basi ni Sh 500,000 tu, 250,000 kuimarisha tawi la Kosovo na nyingine tawi la Chechnya. Fedha za walipa kodi na michango ya wabunge yote imetumika kunishitaki mimi niliyejitolea kusema ukweli."

    Kauli ya Tendwa
    Kwa upande wake Tendwa, alisema uamuzi huo wa kumfukuza Hamad Rashid ambaye ni mbunge wala kujali maslahi ya wapiga kura wa Wawi bali maslahi ya chama.

    Tendwa alisema hayo jana Ikulu jijini Dar es Salaam alipokuwa akijibu maswali ya waandishi wa habari baada ya kuhudhuria hafla ya kuwaapisha viongozi wapya wa Tume ya Taifa ya Uchaguzi (NEC).

    Alisema ni muhimu vyama vikaweka maslahi ya wapiga kura mbele kwa kuwa, ndiyo wanaomchagua mwakilishi wao na si chama kinachowachagulia.

    "Tunaweza tukabadilisha mifumo ya uchaguzi, chama kinapomfukuza mbunge ni lazima kimfikirie mpigakura atakuwa katika hali gani na pia suala la gharama lazima lifikiriwe,"alisema Tendwa.

    Msajili huyo mwenye dhamana na ustawi wa vyama vya siasa nchini, alisema ni muhimu mpigakura akapewa nafasi ya kufanya uamuzi huo kama anavyofanya wakati anapomchagua mbunge wake.

    "Busara inahitajika katika kufanya uamuzi huu ili isiwe ni tabia na desturi ambayo tunajiwekea,"alisema Tendwa.

    Mwenyekiti wa UDP na mbunge wa Bariadi Mashariki, John Cheyo alisema walichofanya CUF ni kukiuka sheria mama ya nchi ambayo ni Katiba.

    Alisema kwa mujibu wa Katiba, mbunge atakaa katika kiti chake kwa miaka mitano na utaratibu wa kumwondoa ni katika Uchaguzi Mkuu.

    "Katika nchi tuna sheria mama ambayo inatamka rais atatawala miaka mitano ukimwondoa hapo katikati unatafuta matatizo hivyo kwa mbunge,"alisema Cheyo.

    Alisema kitendo kilichofanya na CUF na NCCR ni kutafuta matatizo nchini na vurugu badala ya kujenga demokrasia.

    CUF: Hatuendeshwi na Mahakama

    Kwa upande wa uongozi wa CUF umetetea uamuzi wake wa kuwafukuza wanachama wake wanne na kuwaonya wengine 10, huku kikisema kimezingatia katiba yake.

    Chama hicho pia kimekanusha madai ya kupokea amri ya mahakama ya kuzuia mkutano huo, uliomalizika juzi kwa kuwafukuza wanachama wanne na kuwavua nyadhifa za uenyekiti na wanachama wanne.

    Akizungumza na waandishi wa habari jijini Dar es Salaam jana, Naibu Katibu Mkuu wa chama hicho Bara, Julius Mtatiro alisema: "CUF hatujapokea pingamizi la Mahakama kuzuia mkutano wa Baraza Kuu na kama amri hiyo ingekuwa sahihi kama tungeletewa juzi, (Jumatatu) na si siku ya mkutano."

    Mtatiro alisema kimsingi, mahakama haina uwezo wa kuzuia mkutano wa chama cha siasa kama ulikwishaanza kwa kuwa chama hakiongozwi na mahakama.

    "Mahakama yoyote haina uwezo wa kuzuia mkutano wa chama cha siasa uliokwishaanza, chama hakiongozwi na mahakama bali kila chama kinaongozwa na katiba za vyama vyao ambazo zinatambuliwa na Katiba ya Jamhuri ya Muungano wa Tanzania," alisema Mtatiro.

    Katika mkutano huo, CUF kilitangaza kuwavua uenyekiti wanachama wake wanne katika Wilaya za Ilala, Temeke jijini Dar es Salaam na Nachingwea Mkoa wa Lindi. Waliovuliwa nyadhifa zao za uongozi ni waliokuwa wenyeviti katika Wilaya za Ilala, Don Waziri, na katibu wake Masaga Masaga, Temeke, Mohamed Albadawi na mwenyekiti wa Nachingwea, Haji Nanjase.

    Mtatiro alisema baraza lilipokea majina ya watuhumiwa 14 akiwamo Hamad Rashid na baada ya kuwahoji lilijiridhisha kwamba 12 kati yao walivunja katiba ya chama.

    Alifafanua kwamba, wajumbe wanne akiwamo Hamad Rashid wamefukuzwa uanachama na kuanzia sasa si mbunge kupitia chama hicho.

    "Kuanzia sasa Hamad Rashid si mwakilishi wa wananchi wa Wawi kupitia CUF, akitaka kuendelea kuwa Mbunge anapaswa kuwa mwakilishi kupitia mahakamani,"alisema Mtatiro.

    Mwanasheria

    Kwa upande wake ofisa mwandamizi wa Kituo cha Sheria na Haki za Binadamu (LHRC), Harod Sungusia alisema tabia ya vyama vya siasa kuwafukuza uanachama wanachama wake, inatokana na matokeo ya mmomonyoko wa utawala wa sheria.Sungusia alisema hayo jana jijini Dar es Salaam alipokuwa akitoa maoni kuhusu chama cha CUF kumfukuza uanachama mbunge huyo wa Wawi.

    Alisema vyama vya siasa vimekuwa vikifanya uamuzi kwa kujali maslai yao binafsi, ndio maana vimekuwa vikileta msuguano ndani vya vyama na kusababisha wengine kufukuzwa.

    "Kama wabunge wanatumia vizuri chombo chao cha kutunga sheria, wanaweza kuondoa matatizo haya kwa kutunga sheria ambazo zitawasaidia wananchi pamoja na kuwapa miongozo mizuri katika kazi zao ndani ya Bunge na nje ya Bunge," alisema Sungusia.

    Wawi Legislator Hamad Rashid Mohamed, who was expelled by his CUF party on Wednesday, addressed a press conference in Dar es Salaam yesterday.



    Embattled Wawi (Zanzibar) legislator Hamad Rashid Mohamed and his three colleagues, who have been expelled from the Civic United Front, have dismissed the disciplinary measure by the party's governing council as illegal.


    They claim that the council erred by disobeying a January 4, 2012 High Court order refraining the opposition party from any engaging in any such activity while there was a pending case relating to the same issue.


    So far hundreds of CUF followers from different regions have surrendered their membership cards to support suspended leaders.


    "It is sad for (Zanzibar First Vice President) Maalim Seif Shariff Hamad, who is also a government leader, to disobey the Judiciary. Basing on the court order, I am still a Member of Parliament and will continue to fight for my rights," said Mohamed, once a deputy minister in the Union Government.


    He said the decision to expel them was made in a rush and immediately after the issuance of a court injunction, adding that Shariff Hamad dictated the proceedings of the council meeting and ordered their suspension while other members were yet to be interrogated.


    The embattled MP expressed dissatisfaction with the way the meeting was conducted, saying the principle of natural justice was blatantly side-stepped. He said all accused persons including himself ought to have been given time to prepare themselves before responding to the charges.


    "I requested members of the governing council to give me extra time so that I could prepare myself to answer charges, but they refused. There was no natural justice. Even worse, some members of the council are top Zanzibar government officials," he noted.


    He said meanwhile said 600 CUF members in Temeke District, Dar es Salaam, have returned their membership cards in protest, "while over 100 members in Tanga Region have acted similarly in a show of solidarity with us".


    He expressed hope that yet more members of the party would soon follow suit, particularly in Tanga, Morogoro, Dodoma and Mwanza regions.


    Mohamed said that he has no immediate plans of joining any political party, only vowing "to continue serving my people through different means". He hinted that CUF party leaders and members expelled alongside him have been pressuring him to set up a party of their own, "but I am not yet decided and am still making consultations with political scientists to ensure it will be a strong and stable political party".


    "I am making consultations with political scientists…I don't want to start a political party that will last for only a few months and then collapse," he noted.


    He said it was a "big mistake" for CUF to suspend party leaders as that could seriously destabilise the party.


    CUF Deputy Secretary General (Mainland) Julius Mtatiro meanwhile said the party has not received any order from High Court of Tanzania, adding that the governing council meeting had legal powers "since it operates as provided for under our party's constitution".


    "We haven't seen or received any such letter (injunction) from the court. Who are we to disobey an order by the Judiciary? These are legitimate party decisions and we will stand by and for them", he noted.


    Political Parties Registrar John Tendwa yesterday expressed dismay over recent decisions by political parties to expel some of their members, including MPs, "without considering the rights of the electorate, the cost of conducting by-elections and fundamental principles of democratic practice".


    He said that the trend could create fear among party members, making them refrain from airing even constructive view that would have consolidated the very parties.


    The registrar made the remarks in Dar es Salaam yesterday in talks with journalists, saying: "Expelling party members is not something new. It has been occurring several times. But as we mark 20 years of the reintroduction of multiparty democracy in our country, it is sad that the rights of the electorate are not being observed as expected."


    He explained that political parties have the right to make any decisions they wand, "but they must seriously consider the costs of conducting by-election if need be because it is lots of money".


    "It is high time appropriate measures were taken to address this problem, including exploring the possibility of putting in place an arbitration mechanism rather than resorting to expulsions, as this seriously undermines democratic practice," noted Tendwa.


    On Wednesday CUF governing council stripped Mohamed and three other people of their party membership and positions on allegations of fomenting conflicts and divisions in the party.


    The party's governing council said it also found them guilty of instigating misunderstandings and spreading corruption allegations against the party's top leaders.


    Those expelled alongside Mohamed are Doyo Hassan Doyo (Tanga), Shoka Khamis Shoka (Pemba) and Juma Said Sanani. Yasin Mrotwa meanwhile escaped with a severe warning "for going against the party's code of ethics".

    CCM alifukuzwa na pia CUF kafukuzwa?. Jamani anayekumbuka sababu za Hamad Rashid kufukuzwa CCM naomba atukumbushe tafadhali. Inawezekana huyu jamaa kweli ni mkorofi.

    There is something rather fishy going in the wake of the sudden expulsions of Members from NCCR and now CUF??
