    Magazeti yameandika kuwa mikataba ya madini inatamka wazi kuwa kila mwekezani anatakiwa kuchangia dola za kimarekani laki mbili na arobaini elfu ( 240,000$US ) kwa ajili ya maendeleo ya wananchi wanoishi eneo lenye mgodi. Sasa mimi najiuliza kwanini serikali iliyopita haikuliweka wazi hilo?

    Au kuna viongozi wamekuwa wakila na wawekezaji? Tuseme ndiyo maana wananchi wamekuwa wakipigwa risasi kama ndege na Sirikali kukaa kimya?, Kwa mfano migodi ya Nyamongo na Bulyankulu.

    Ni kina nani walitakiwa kutoa hizi taarifa? Au nani alizuia zisitolewe kama siyo BM? Hawa watu pamoja na BM wana kesi ya kujibu. Mauaji ya wananchi na Ufisadi (Uhujumu) wa mali ya wananchi. Hawa watu hawatakiwi kulindwa. Kama JK atawalinda atakuwa anajipaka damu za hao watu na uhujumu..

    Kwanini mikataba iendelee kuwa SIRI? Kwanini isipitiwe na Bunge letu? Kwanini tunaendelea kuchezeana akili hivi? Wanasheria wetu mko wapi?

    Mimi nina swali moja tuu kuhusu hii ishu ya mikataba , Kwa nini inakuwa siri ? Mimi nilitegemea ya kuwa mikataba ingekuwa inawekwa wazi ili wananchi wajue what to expect !

    Mikataba hii inagusa maisha kila either direct or indirect kwa hiyo wazalendo tuna kila sababu ya kujulishwa . Kitu ambacho kinaniuma sana ni baadhi ya viongozi kujiona ya kuwa wao ni smart na sana kuhisi ya kuwa watz wengine ni mambumbu .

    Ningefurahi sana kama tungepata kopi ya hiyo mikataba ili tuwezekuisoma between the lines.

    Kampuni ya Barrick 'yamwaga' milioni 735/-

    *Ni kwa Halmashauri za Wilaya tatu inakochimba madini

    Mwandishi Wetu, Dodoma

    BARRICK Gold Tanzania, Kampuni ya Kanada inayochimba madini katika wilaya za Tarime, Kahama na Biharamulo, imeahidi kutoa michango zaidi kusaidia shughuli za meandeleo katika maeneo kampuni hiyo inakofanyia kazi.

    Hayo yalisemwa juzi na Meneja Mkuu Mtendaji wa kampuni hiyo, Bw. Deo Mwanyika wakati akikabidhi sh. 734,999,999 kwa Serikali zikiwa ni mchango wa kampuni hiyo kwa shughuli za maendeleo kwa wilaya hizo.

    Fedha hizo zilikabidhiwa kwa Waziri wa Nchi Ofisi ya Waziri Mkuu (Tawala za Mikoa), Bw. Mizengo Pinda mjini hapa.

    Naye Waziri Pinda alikabidhi fedha hizo kwa wenyeviti wa halmashauri za wilaya hizo, ambao ni Paulo Magazi (Kahama), Magese Kachwele (Biharamulo) na Charles Ochele (Tarime).

    Bw. Pinda alisema kuwa mchango huo ni matokeo ya majadiliano kati yake na Serikali.

    "Kutokana na migongano ya mikataba kati ya Serikali na kampuni za madini, haikuwezekana halmashauri kupata kodi hizi. Hata hivyo kutokana na majadiliano na nia nzuri ya Barrick Gold kuwa na uhusiano mzuri baina yao na halmashauri wamekubali kutoa dola za Kimrekani 200,000 kwa hizo halmashauri tatu kwa mwaka huu wa fedha", Alisema Waziri huyo.

    Katika hafla hiyo fupi iliyohudhuriwa pia na wabunge kutoka katika maeneo hayo, Bw. Pinda alisema kuwa sheria hizo ndogondogo zilikuwa ni kinyume na mikataba na sheria ya uchimbaji madini ya mwaka 1998.

    Kutokana na tatizo hili, alisema kuwa utekelezaji wake ulikuwa ni mgumu na hivyo kufanya mazungumzo kutozaa matunda yoyote.

    Kampuni ya Barrick Gold ambayo inamiliki migodi ya Bulyahulu-Kahama, Tulawaka-Biharamulo na North Mara-Tarime, imekuwa ni ya kwanza kuitikia mwito huo wa kuchangia maendeleo katika maeneo wanayofanyia kazi.

    Aidha Bw. Pinda aliwataka wenyeviti hao kuzitumia fedha hizo kwenye miradi ya maendeleo na kuongeza kuwa Serikali itaweka utaratibu wa jinsi ya kuzitumia fedha hizo.

    Sheria na kanuni za utumishi, haziruhusu nyaraka za serikali kuwa wazi kwa mtu yeyote. Huwa zina utaratibu wake wa kuzipata kama ukizitaka. Hata leo hii Tausi1 ukiwa ndani ya system, moja ya masharti yako ya kazi ni kuwa huruhusiwi kutoa/kutoka na information ya seriakli nje ya mahala pake panapotakiwa bila ya kibali cha serikali. ikijulikana umevujisha, kibarua kinaota mbawa.

    Inabidi tuwe na "Mafia" kama akina Mzee Es wanotumegea kidogo kidogo, anachoona ni kibovu na kinatupeleka kubaya.

    Kwa kuangalia mfano wa mkataba niliouweka hapo juu, sisi wanabodi tunaweza kufanya uchambuzi/review na ku-suggest tunavyoona mkataba unavyotakiwa uwe ikiwa ni pamoja na kuweka formula zitakazo kuwa na mlengo wa "win win".

    Umafia lazima ufanyike kuipata present mikataba, kwani usipofanyika umafia yatatukuta yaliyomkuta Mhabsibu wa Hazina about 2 or 3 yrs ago.

    Ogah, ni sheria gani hizo zinazokataza watu kupata habari za kile serikali yao inafanya? Kuna habari ambazo ni haki ya wananchi na hatuhitaji kibali toka kwa mtu yeyote kuzipata. Serikali inapoingia katika majadiliano fulani na taifa jingine hatuhitaji kibali kujua wamezungumza nini!! Serikali inapoingia katika mikataba fulani, hatuhitaji kibali kujua mikataba hiyo ni ipi na masharti yake ni nini!! Tanzania ni jamhuri siyo ufalme!! Kama jamhuri, uwezo na mamlaka ya nchi yanatoka kwa watu (sovereignity is from the people)

    Wakati umefika kwa Tanzania kutunga na hatimaye kupitisha Sheria ya Uhuru wa Kupewa Habari (Freedom of Information Act) Najua jambo hilo liliwahi kuzungumzwa huko nyuma. Katiba inatupa uhuru wa kupata habari mahali popote lakini haiupi haki ya kupata habari toka serikalini, vyombo vya serikali au idara za serikali. Baadhi ya vipengele vya Sheria ya Usalama wa Taifa ya 1970 lazima vifutwe!

    Ukiwa umewahi kuajiriwa serikalini, utaelewa nilichokisema. Unajua kuna mambo mengi tu huko maidarani yanapita kiholela holela, yakigundulika inakuwa too late watu wameshasaini mikataba, ndiyo maana hata ndg Rutabanzibwa (na IPTL) aliishia kupigania kupunguza mzigo kwa serikali angali sisi wananchi tungependa KUFUTA KABISA.

    Nafurahi kuwa umeuliza swali, na mwishowe kujijibu swali. Nakubaliana nawe kuwa tupiganie kuwa habari zinazohusu maslahi ya wananchi ni vyema zikawa huru, na zisiwe siri.
    Wakati tunapigania hilo na Umafia tuutumie kupata hizi habari zinazofichwa.....tutazipata tu!

    SERIKALI imekataa kuleta bungeni, mkataba wa ukodishaji Uwanja wa Ndege wa Kimataifa wa Kilimanjao (KIA).

    Msimamo huo wa serikali unatokana na kipengele kwenye mkataba huo, kinachozuia watu wasiohusika, kuusoma.

    Msimamo huo ulitolewa bungeni jana na Naibu Waziri wa Miundombinu, Dk. Maua Daftari, wakati akijibu swali la Mbunge wa Kigoma Kaskazini, Zitto Kabwe.

    Dk. Maua alisema kwamba kipengele cha 30.4 kinaifunga serikali na mbia wake, Kilimanjaro Airports Development Company (KADCO), kutoa habari kwa mtu yeyote ambaye si mhusika wa moja kwa moja kwenye utekelezaji wa mkataba huo.

    Alisema wabunge si wahusika wa moja kwa moja na mkataba huo, badala yake serikali itaendelea kuwawakilisha.

    Uwanja huo ulikodishwa kwa Kampuni ya KADCO kwa muda wa miaka 25.

    Kampuni hiyo inatakiwa kulipa dola 1,000 za Marekani kwa mwaka, kama ada ya ukodishaji.

    Dk. Daftari alisema katika mkataba huo, serikali iliingia ubia na Kampuni ya KADCO ikiwa imesalia na asilimia 24 ya hisa.

    Hata hivyo, Naibu Waziri huyo aliafikiana na muuliza swali juu ya kuupitia upya mkataba huo, na kufafanua kwamba kazi hiyo imekwishaanza.

    "Wizara yangu imeona umuhimu wa kuupitia upya mkataba huo, kipengele kwa kipengele, kazi ambayo ilianza na inaendelea," alisema.

    Shughuli hiyo inafanywa na wataalamu kutoka Wizara za Fedha; Miundombinu; Mipango, Uchumi na Uwezeshaji; na Ofisi za wakuu wa mikoa ya Arusha na Kilimanjaro.

    Baada ya pande mbili kufikia muafaka, marekebisho hayo yatawasilishwa ngazi za juu serikalini kwa maelekezo zaidi.

    KADCO imetumia sh 8,772,896,600 kulipia mkopo uliochukuliwa na serikali ili kufanya matengenezo ya magari ya zimamoto, na ukarabati wa kituo cha zimamoto, paa lililokuwa linavuja,vyumba vya kufikia abiria na chumba cha watu maarufu.

    Vile vile iligharimia upakaji rangi majengo ya abiria, ujenzi wa barabara kutoka BP Fuel Farm hadi DAHACO, ununuzi na kujenga mitambo mbalimbali ya kuongozea ndege.

    Shughuli nyingine ni utoaji wa misaada kwa taasisi za kidini, shule na afya, elimu kwa wafanyakazi na uboreshaji wa shughuli za mazingira.

    Hii ni mara ya pili Kabwe kuzungumzia suala la mkataba huo, ambapo mara ya kwanza aliujadili wakati akichangia hoja ya Waziri wa Mipango, Uchumi na Uwezeshaji, Dk. Juma Ngasongwa.

    Alisema wakati serikali inalipwa dola 1,000 kwa mwaka, Kampuni ya KADCO inakusanya dola 5,000 kwa siku kutoka Shirika la Ndege la Uholanzi (KLM).

    Alisema pia kuwa mkodishaji huyo ameanza kukodisha ardhi kwa wananchi wanaolima katika eneo hilo kwa sh 20,000 kwa ekari.

    Katika swali la nyongeza, Mbunge wa Mtera, John Malecela, alihoji kama katika upitiaji wa mkataba huo serikali itaingiza karakana ya ndege iliyojengwa na serikali miaka ya nyuma.

    Waziri Mkuu, Edward Lowassa, alijibu kwa kusema serikali itazingatia ushauri wa Malecela na kuufanyia kazi.

    MY TAKE:
    WTF!!! Somebody need to shoot me!! Hivi ni kina nani hawa wanaoiingiza serikali kwenye mikataba yenye vipengele vya ajabu namna hii? Ina maana hata mahakama haiwezi kuona mikataba hiyo? Kama wabunge ambao ni wawakilishi halali wa wananchi hawawezi kusoma mikataba hiyo.. ni nani basi anasoma mikataba hiyo!!

    Nimesoma mara mbili mbili huo ujumbe wako Mzee Mwanakijiji, yaani hata kile kibanda changu pale bongo nilichopangisha kwa TX mmoja analipa US$ 1200 kwa mwezi, sasa Uwanja wa Ndege wa kimataifa wa nchi.......US$ 1000 kwa MWAKA!!!!!!! gimme a break guys, wahusika waliosaini huu mkataba ni wahujumu wa uchumi.

    Je ni kweli kuwa serikali inalipwa UDS1000 kwa mwaka huku hiyo Kampuni ikilipwa Dola 5000 kwa kila siku toka KLM tu??

    Kumbe ndiyo maana nchi nyingine watu huamua kuingia msituni kupambana na maadui wa maendelo kama hao waliosaoni huo mkataba!!

    Huu ni mfano tu wa mikataba mingi ya uuaji wa watanzania. Sasa aliesaini huo mkataba ana tofauti na na majambazi kama walioiba hela Ubungo?

    Labda mama ... naye ni mmiliki wa hiyo kampuni labda ana share huo.

    Hizi $240,000.00 ni kwa mwaka au ni kwa muda gani? Kama Barrick wanavuna USD $20m a year with 3% rolyalties to Serikali 9$600,000) then it make sense to claim at least $240000-400000 for local development.
    Serikali inapaswa iongeze mgawo wake wa royalties to at least 15% ambapo 40% ya hiyo 15% itawekwa kwenye maeneo ambapo huu uwekezaji unafanyika kwa shughuli za maendeleo kama Shule, zahanati, vyuo vya ufundi, maji, umeme na barabara na si kutumia pesa hizi kulipana mishahara na kununua magari mapya!

    Serikali inaonesha kuchukua hatua kwenye hili swala. Ila tu kinachoniudhi ni hio statement ya kwamba "tunaeendelea na uchunguzi"!

    Watu tumeshajua tunaibiwa sasa tunasusa susa nini ku cease production immediately kuzuia wizi zaidi mpaka hapo tutakapo sawa zisha mambo.

    Kwasababu hivi sasa tunawatishia na katika huko kutishia tunawapa hawa wezi ample time yako panga mipango itakayo counter strategies zetu na pia huu ndio muda wataiba zaidi kwasababu wanajua arobaini zao ziko karibu!

    Tanzania: Pressure Mounting On Govt to Act On Exploitative Contracts

    The mining sector in Tanzania has once again come under intense scrutiny with signs that government officials are beginning to yield to public pressure for a fresh look at mining contracts.

    Last week, the government publicly acknowledged that major mining companies have been fiddling with figures to avoid paying the requisite duties and royalties. Deputy Minister for Energy and Minerals Lawrence Masha disclosed in parliament that a recent audit report by government appointed assayers Alex Stewart had noted that reports presented by large scale gold mining firms on their operations were not correct. Mr Masha said that the investigations by the assayers were still going on.

    "The preliminary report by the committee is ready. I request the MPs to be patient as such problems and many others will be sorted out after the review process," said Mr Masha.
    Members of Parliament last week pressed the government for more action on mining contracts, with the legislators demanding better profit sharing arrangements and better accountability to the communities where the mines are located.

    Legislator Chacha Wangwe demanded a government explanation for what he described as the mining companies' "insignificant contribution to the communities" compared with the profits they were making.

    Companies are obliged to pay $200,000 annually to respective local authorities "depending on the tax regime of the district and additionally pay a royalty of 3 per cent of the value of exports to the Tanzanian government."

    The government had in June 2003 entered into a contract with Alex Stewart (Assayers) Government Business Corporation of the US to verify the cost of production, transportation of gold, and capital invested by large scale miners.

    The mining sector grew by 15.7 per cent in 2005 compared with 15.4 per cent in 2004, contributing 3.5 per cent and 3.2 per cent to GDP respectively. The Minister for Planning, Economy and Empowerment, Juma Ngasongwa, says the government has formed a special committee to undertake an in-depth evaluation of why the revenue accruing from mining activities is so small.

    Dr Ngasongwa attributes the higher growth of the sector to additional investments in Tulawaka Gold Mine in Biharamulo. Gold is the main mineral export with 48.2 tonnes being exported in 2004, but its impact on economic recovery and job creation has been very minimal.

    Review of the mining contracts was one of the priorities identified by President Jakaya Kikwete when he took office last year. He promised to provide a fair balance between returns to investors and the country's interests.

    Despite being the continent's third largest gold exporter behind South Africa and Ghana, Tanzania was cited by the United Nations Conference on Trade and Development (Unctad) as one country that, despite massive FDI inflows, had yet to attain the desired goals, including job creation.

    The report had advised that countries like Tanzania needed to add value to the raw minerals as is the case in South Africa and Namibia to benefit the local economy. Tanzania has had no mineral processing facility since the closure of the diamond-cutting firm Tancut in the late 1980s.

    The drive to introduce value addition saw former President Benjamin Mkapa inaugurate the Mwananchi Gold Company Ltd, a multibillion-shilling investment aimed at processing gold. Two months ago, officials from the Barrick Gold Corporation visited the country on a similar mission.

    Key public concerns over the mining sector have revolved around the lopsided contracts that the government has entered into with the investors, resulting in meagre returns and royalties, lack of transparency in the mining sector and poor social relations.

    Serikali yafunga mgodi wa dhahabu Musoma

    SERIKALI imesitisha shughuli za uzalishaji wa dhahabu kwenye mgodi wa Buhemba Gold Mine (BGM) katika Kata ya Buhemba, Wilaya ya Musoma Vijijini mkoani Mara, kutokana na madini hayo kupungua katika eneo hilo.

    Mkuu wa Wilaya za Musoma Mjini na Vijijini, Saveli Maketa, aliwaeleza wafanyakazi 350 wa mgodi huo kuwa serikali imefikia uamuzi huo kutokana na sababu hiyo, lakini kuwahakikishia kuwa hakuna atakayefukuzwa kazi na wataendelea kulipwa mishahara yao kama kawaida.

    "Serikali imetenga eneo lingine la kuchimba dhahabu baada ya dhahabu ya hapo kupungua, lakini hakuna mfanyakazi atakayefukuzwa na wote mtalipwa mishahara yenu kwa kipindi chote ambacho mtakuwa hamfanyi kazi," alisema.

    Maketa aliwaeleza wafanyakazi hao kuwa mgodi huo wa Buhemba ni mali ya serikali pamoja na mali nyingine, ikiwamo mitambo yake na kwamba hata mishahara wanayolipwa ni ya serikali kupitia kwa mwekezaji kutoka Afrika Kusini.

    "Mgodi, samani zote za ofisi, mali zote za hapa mgodini na mishahara yenu ni mali ya serikali ya Tanzania, hivyo ni mali zenu. Hao mnaowaita makaburu hawana chochote hapa bali wao ni mawakala tu wa serikali," alisema Maketa.

    Alifafanua kuwa serikali haiwezi kumudu kukaa na wafanyakazi hao wote 350 wakati hakuna uzalishaji, hivyo utaratibu umepangwa wa kuwarejesha baadhi yao kwao ingawa wataendelea kulipwa mishahara yao na wengine watabaki katika eneo hilo kufukia mashimo, kusawazisha eneo hilo na kupanda miti ili kuhifadhi mazingira.

    Alisema, wafanyakazi hao hawatapata malipo ya muda wa ziada kwa kuwa hakuna uzalishaji kwa sasa, ila baada ya uzalishaji mpya kuanza kwenye eneo jipya ambalo tayari limeishapangwa.

    Mkuu huyo wa Wilaya alisema pia kwamba serikali ina akiba maalum benki inayotokana na mapato ya mgodi huo ambayo iko chini ya Bodi ya Wadhamini wakiongozwa na Gavana wa Benki Kuu (BoT) na kwamba akiba hiyo ndiyo itakayotumika kuwalipa mishahara.

    Akijibu maswali ya wafanyakazi hao, Maketa aliwaeleza kuwa serikali itatoa fedha kwa ajili ya eneo lingine jipya la mgodi huo katika eneo hilo la Buhemba, lakini itachukua takriban miezi saba kuanzia sasa.

    Kwa mujibu wa DC, mgodi huo umewekeza kiasi cha Sh18 bilioni, ikiwamo mishahara ya wafanyakazi, mitambo na samani zote za ofisi.

    Katibu wa Chama cha Wafanyakazi wa Migodi, Ujenzi, Nishati na kazi nyinginezo (Tamico) kanda ya ziwa, Stephen Mageta, alisema pamoja na ujumbe mzuri wa DC kwa wafanyakazi hao, lakini wanataka serikali iwahakikishie kwa maandishi kuwa hawatawafukuza kazi na kwamba watalipwa mishahara yao wakati huo wa mpito.

    "Wafanyakazi tulikuwa hatuamini kwamba mgodi huu ni mali yetu, sisi tunajua ni mali makaburu kutokana na unyanyasaji, vipigo tunavyopigwa, mishahara midogo na matusi juu," alisema Mwenyekiti wa Tamico tawi la Buhemba, Edward Ng'wenge.

    Meneja wa mgodi huo, Jian Duvenage alikataa kuzungumza lolote na waandishi wa habari mgodini hapo na badala yake alimuomba DC aongee naye faragha.

    Gazeti hili toleo la Novemba mosi, mwaka huu lilichapisha habari zikimkariri Mbunge wa Musoma Vijijini, Nimrod Mkono, akiutaka mgodi huo, pamoja na mambo mengine waonyeshe ankara zao na takwimu za mrahaba wanaolipa tangu waanze kuchimba dhahabu.

    "Endapo BGM itapuuza, agizo hilo litaliwasilisha bungeni na nikishindwa nitakwenda kuwatetea wananchi mahakamani," alisema Mkono ambaye pia ni wakili.
