    habari wana JF,tafadhali ningependa kusaidiwa kujua malipo stahiki ya mtu kama muajiri amevunja mkataba,mfano halisi,muajili ame mterminate mwajiriwa kazi ambaye alikuwa akifanya kazi kwa mkataba wa mwaka mwaka bt renewable,je mwajiriwa anapaswa pata stahiki zipi?,,,,nauliza hv mana sample yangu imeambiwa italipwa mshahara wa miezi 3,siku za likizo zilizobaki na nssf alafu basi,,,tafadhali naomba kusaidiwa

    Ili kujibu swali lako inabidi ueleze sababu ya 'termination' maana kama muda wa mkataba ulikuwa bado hiyo ni 'premature termination' na malipo yake ni makubwa sana

    katika rules and regulation za sample hakuwa ana ruhusiwa ku access internet kazini,but it wasnt her fault by default siku hiyo aka open internet ikapatikana,akawa terminated,hapo stahiki zake ni zipi

    Mwajiri akivunja mkataba ambao ni fixed lakini renewable, stahili zako ni
    1. Kama ameuvunja bila kosa lolote, displinable, then, mwajiri atakulipa mshahara wako wa mwenzi mmoja, pamoja na full gratuity ambayo iko kwenye mkataba kama angemaliza mwaka mmoja kazini.
    2. Mkataba ukivunjwa kwa kosa displinary, kosa hilo, limeorodheshwa miongoni mwa makosa ambayo ukukiktwa nayo unafukuzwa. Kama ni kampuni ya foreign, wana kitu wanaita information protection ambayo alipoajiriwa lazima alisainishwa ikieleza ukiiuka hiyo imformation protection, ni kufukuzwa bila mjadala. If that is the case, then, mwajiri anakulipa mshahara wako wa mwezi mmoja na kukulipa gratuity ya ile miezi uliofanya kazi.

    Kama kampuni ni ya wazungu, kila kitu kiko kwenye mkataba, kama ni ya wahindi, kuna mikataba ya kibwege *****, unaweza kukuta mtu anafanya kazi ya fixed contract, halipwi gratuity kwa kisingizio wanamkata NSSF, na ukienda NSSF unakuta hauna sentano, ukiuscutinise vizuri mkataba, unajikuta kumbe ulikuwa ni kibarua unalipwa kwa masaa, hivyo huna gratuity, wala NSSF na siku ukiachishwa/kufukuzwa, unalipwa mshahara za zile siku tuu ulizofanya kazi na biashara inaisha!.

    Watanzania wengi sana wanadhulumiwa haki zao, kwa kutojua haki zao ni nini!.
