Imenikumbusha miaka ya nyuma rais Banda wa Malawi wakati huo alileta choko choko mpakani wakati huo tulikuwa na viongozi full of patriotism. Alipigwa mkwara wa kijeshi ndani ya juma moja akasalimu amri. Ndiyo chanzo cha zile nyimbo tulikuwa tunaimba kwenye mchaka mchaka shuleni:

The Anglo German Treaty reads as follows:
"1. To the north by the line that commences on the northern bank of the mouth of the Umba River, runs directly to Lake Jipe and, after passing along the eastern shore and around the northern shore of that lake, crosses the Lumi River and bisects the territories of Taveta and Chaga. Skirting the northern slope of the Kilimanjaro range, this line continues to the point on the eastern shore of Lake Victoria Nyanza that is intersected by the 1st degree of south latitude. It crosses the lake on this parallel and follows it to the border of the Congo Free State, where it terminates. It is understood, though, that the German sphere of interest on the western side of the aforementioned lake does not include Mount Mfumbiro. Should it turn out that this mountain lies to the south of the aforementioned parallel of latitude, the line of demarcation shall be drawn so as to exclude the mountain from the German sphere of interest; but the line shall nonetheless terminate at the previously described point.
2. To the south by the line that starts on the coast of the northern border of Mozambique Province and follows the course of the Rovuma River to the point where the Messinge flows into the Rovuma. From here the line runs westward on the parallel of latitude to the shore of Lake Nyasa. Turning north, it continues along the eastern, northern, and western shores of the lake until it reaches the northern bank of the mouth of the Songwe River. It then continues up that river to its intersection point with the 33rd degree of east longitude. The line continues along the river until its closest point with the border of the geographical Congo Basin as described in Article I of the Berlin Conference and marked on the map appended to its ninth protocol. From here the line runs directly to the previously described border, follows this to the point of intersection with the 32nd degree of east longitude, turns and continues directly to the meeting point of the northern and southern branches of the Kilambo River. It follows that river until it enters Lake Tanganyika."
Clearly the Tanzanians have no claim on the northern part of the lake as the boundary is the shore of the lake.
I talked about this on this very forum. I pointed out these very issues namely that:
(a) the boundary demarcating the lake we both share with Tanzania has not been settled. The individuals in the relevant Ministries (Justice; Surveys; and OPC) are fully aware of this matter. It is a well settled legal precedent that where a body of water forms a boundary between two land masses, the boundary is mid point along the body mass. Malawi has purposefully sought to ignore this principle. Those interested should look at the map of Malawi and observe how the lake boundary has been delineated. We (Malawians) lay ownership claim of the lake up to the shores of the lake on the Tanzania side. Really staggering. When I heard the Malawi govt has commissioned survey operations in the lake I knew we were headed for trouble.
(b) Tanzania has never referred to the lake as "Lake Malawi". To them it is known as "Lake Nyasa". The boundary dispute between Malawi and Tanzania over the lake goes back to Banda's time. It is not a new thing. Unfortunately successive governments have chosen to put it on the back burner on the basis nothing of strategic interest was there and was not envisaged. The Tanzanians too did not bother because Malawi, despite its territorial claims on paper, did not do or make any physical moves that could be interpreted as seeking exclusive proprietary rights over the entire lake. Unfortunately the move by Malawi to start prospecting for oil can be said to be that very physical act that Tanzania can interpret as expanding territorial ambitions. Trust me, the oil venture will not go anywhere until the vexing issue of border delineation is resolved.
I hope we do not proceed with this folly of going it alone. Folly because we only need to look back at Shire project and the ensuing consequences having ignored inter-country spatial issues.
It is not too late for our government to move to reach an accommodation with our neighbour (Tanzania). If we have to share proceeds so be it! Coming to blows with Tanzania is not even thinking about. We will be blown to pieces.
