Unachosema ni sawa lakini siamini kuwa DPP haelewi haya unayoyasema. Kinachowasumbua wenzetu tuliowapa mamlaka ya kusimamia haki ni kuwa wamelewa mvinyo wa madaraka ambao mning'inio (hangover) wake ni mgumu sana kuuondoa. Hawana tofauti na Ghadafi ambaye mpaka sasa anaamini kuwa atashinda vita pamoja na kuwa dalili zote zinaonyesha kuwa ameshindwa tayari na kinachosubiriwa ni kumkamata tu na kumpeleka mahakamani.

Kuna kipindi cha nyuma, Ijumaa moja, mtoto ambaye ni mwana pekee wa kiume wa kigogo mmoja, ilichukua bastola ya baba yake akamiminia risasi 6 adui yake mmoja na kufa papo hapo. Mtoto huyo alichukuliwa na kulazwa polisi, Jumatatu asubuhi mtoto alifikishwa mahamani kusomewa shitaka la mauaji. Jioni ya siku hiyo DPP alipeleka Nolle Prosequi, Jumanne kesi ikafutwa, mtoto akaachiwa na kupelekwa nje ya nchi, baba kigogo wakayamaliuza na familia ya marehemu, kesi ikaishia hapo.

Powers hizo za DPP kupeleka Nolle, pia hazihojiwa na mamlaka yoyote, wala DPP hapaswi kutoa sababu zozote za nolle kwa yoyote.

Pasco husidhani hayo unayoyasema yanafanyika kwa kimakosa hapa kwetu, huo ndio mpango na ndio nia ya serikali; kwanza nikuweke sawa tu, kwamba DPP ni State organ hivyo ama akikubali au kukataa kuendesha keshi ujue kuwa ndiyo hivyo Serikali ndio imekaa. Watawala wetu hawawezi kuweka maamu ya DPP mezani ili Umma uamue na kushiriki uhalali wa maamuzi yake kwasababu bado Dola na Ikulu inahitaji kuwa Mungu katika ardhi ya Tanzania kwa Watanzania, sasa ukiwapunguzia nguvu za Umungu mtu unadhalilisha na kunyima uwezo wa kutufanya yoyote wanalotaka muda wowote.

Ukweli ni kuwa hizo nguvu unazosema DPP anazo kwa lugha rahisi ambayo siyo ya kisheria ni mamlaka aliyo nayo Rais kuzuia na kuingilia mienendo ya kesi yoyote mahakamani ili kuipa ushawishi ambao Ikulu inataka kuipa kesi husika, Wameweka hizo nguvu kwa DPP kama kiini macho lakini hazipo ni nguvu za Rais siyo DPP kama mamlaka, kwasababu DPP wetu ni sehemu ya serikali kuu. Mfano mwingine ni Kesi ya Marehemu Ditto nguvu iliyotumika kubadili kuwa mauwaji bila kukusudia ilikuwa ni kubwa sana na dhahiri ilionyesha ambavyo mamlaka ya DPP yapo kwa ajili ya watawala wetu na familia zao.

The government has strongly defended the portfolio of the Directorate of Public Prosecutions (DPP)'s office, saying it has performed its duties diligently. Attorney General (AG) Judge Frederick Werema defended the portfolio of the DPP's office yesterday against allegations by Shadow Minister for Justice and Constitutional Affairs Tundu Lissu (Chadema) when he was presenting views of the opposition camp in Dodoma Wednesday.
According to Lissu, the DPP's failure to take legal actions against some individuals, including government officials, involved in the misappropriation of public funds proved there was no need to retain the office.

In his argument Lissu gave an example of a case of individuals involved in stealing money from the Bank of Tanzania ( BoT)'s External Payment Arrears (EPA) account, saying despite the outweighing evidence, some suspects had escaped the arm of the law. "The government has until today failed to take legal action against Kagoda Agricultural Limited, a company accused of pocketing over 40bn/- from the account on grounds of lack of evidence," he explained.

Without mentioning the names of the culprits, Lissu also said the Prevention and Combating of Corruption Bureau (PCCB)'s and DPP's failure to institute legal actions against individuals involved in the controversial purchase of the military radar from BAE Systems, Dowans, Meremeta, TanGold and the privatisation of Kiwira Coal Mine raised doubts on constitutional powers bestowed upon the two organs. Lissu, in his speech, proposed for the establishment of a special court to look into the best way of removing the DPP from his office because of his unsatisfactory performance. He said such a court should be established by the president after being advised by the AG since the DDP had immunities and privileges bestowed upon him by the country's Constitution.

Defending the DPP's office yesterday morning, Judge Werema said before filing any case in the court, the DPP had to gather satisfactory evidence so ensure the suspects' rights were not violated. According to Werema, out of the 30 files sent to the DPP of the cases involving high profile individuals, the DPP had given the green light to 13 cases after he went through the evidence and found it substantial and relevant. However, the AG could neither mention the cases nor the individuals involved.

Ndiyo maana kwenye baadhi ya nchi nafasi kama hizi huwa ni kugombea na kuchaguliwa moja kwa moja na wananchi. Hii inamfanya mhusika awe accountable moja kwa moja kwa wananchi na wakimchoka wanapata fursa ya kutokumchagua tena.

NN, unadhani hata ni tatizo kwenye kuchagua tatizo liko katika sheria inayotumika kuwafanya wafanye kazi. Wenzetu sheria zao zina trigger clauses ambazo kama x inatokea basi AG anatakifanye a, b c. Sisi sheria zetu (kama hii ya DPP) zimeweka vitu juu juu sana. Kinachoniudhi mimi ni kuwa wabunge ndio watunga sheria lakini wanakuwa wa kwanza kulalamika. Wabunge wakitaka wanaweza kubadilisha sheria na DPP hana cha kufanya kuzuia hilo.

Tatizo ni kuwa wabunge wenyewe badala ya kuleta miswada ya mabadiliko ya sheria ili kuziaupdate sheria hizo ndio wanakuwa wa kwanza kusimama Bungeni kulalamikia "ubaya wa sheria" na "kutaka serikali ilete mswada" wa mabadiliko wakati wao wenyewe wanaruhusiwa na kanuni za Bunge kuleta mswada wa mabadiliko ya sheria.

Hivi umewahi kusikia sheria yoyote au mswada wowote wa sheria Tanzania ambao umewahi kuletwa na mtu binafsi ukapitishwa kuwa sheria?

A copy of the Bank Statement of the showing that the money was being transferred in lots of US$1,000,000 or lesser sums such that by the 31st March 2006 there was still a balance of US$ 9,084,762.64
 
(C) In addition to the questions Hoseah raised about the amount of political will that exists to vigorously combat corruption, we are also concerned about the potential lack of capacity on the part of the PCCB and/or the DPP to successfully prosecute such cases through to conviction. Such concerns also are shared by DFID and some other donors.

BOT "Twin Towers" Buildings:


A suspect major price escalation of this Bank of Tanzania project indicated losses estimated at USD 265 million.

Mwananchi Gold:


The 2005/2006 report by Tanzania's Controller and Auditor General cites dubious payments by the Bank of Tanzania to this company including loans made to the company amounting to USD 5.5 million.

Kiwira Coal Mine:


The controlling interest in the Kiwira mine was held by Tanpower Resources, a company formed by Benjamin Mkapa and Daniel Yona (Minister for Energy and Minerals in Mkapa,s government). Tanpower Resources acquired the mine on extremely favorable terms and has entered into agreements with TANESCO. The mine was constructed with public funds.

Buzwagi Gold Mine:


Barrick Gold received a GOT contract to develop this mine but the contract was signed in London under suspicious circumstances by former Energy and Minerals Minister Nazir Karamagi (who resigned in February due to his possible implications in the "Richmond deal" scandal).

BAE "radar deal":

The British defense firm, BAE Systems, allegedly paid a middleman a commission of USD 12 million to win a contract to install an air traffic control system in Tanzania. The deal was brokered by Sailesh Pragii Vithlani, who was born in Mwanza, Tanzania, but is now a British citizen; he is currently being tried in absentia in a Dar es Salaam court for making false statements to a PCCB officer.
