Kuteremshwa(kushuswa)kwa mishahara, inakubalika kisheria?

    Tafadhali wanasheria tunaomba msaada hapa.
    Kuna jambo limetokea kwa ngazi moja ya ajira serikali kuu. Awali ngazi hii ilikuwa ya kimadaraka zaidi hivyo MISHAHARA ilikuwa mikubwa kulinganisha na kazi zingine. Ilipofika mwaka 2003 ngazi hii ilirudishwa kuwa Kama utumishi wa kawaida ila sijui ni bahati mbaya au njema hawakushusha ngazi ya mshahara. Hivyo mpaka 2008 watu waliajiriwa kwa mshahara mkubwa.
    Sasa imekuja barua ya kuwashusha MISHAHARA wafanyakazi hawa toka ngazi ya TGS F mpaka E, ni tofauti ya shilingi 200,000,hii itaanza kwa mwezi huu wa Saba.

    SWALI LANGU: hii iko sahihi KISHERIA? Au niseme sheria inasemaje?

    Note: wafanyakazi hawa wamekopa kwenye mabenki kwa mshahara ule wa awali, wakikatwa watakuwa na negative kwenye account zao.

    Wako sahihi. Na wale waliolipwa kimakosa walitakiwa warudishe hizo pesa kwa kukatwa kidogokidogo. TGSF inaanzia shillingi ngapi mkuu?

    mi naona serikari haiko sahihi.Kilichotakiwa kufanyika ni kuacha kufanya nyongeza ya mshahara mpaka hapo wenzao walioanza na TGSF watakapowafikia la sivyo wawapeleke kwenye majukumu yanayoendena na mishahara wanayopokea sasa

    Kimsingi MISHAHARA hiyo iligota, haipandi mpaka sasa walipoamua kuwashusha.
    Sasa can they go to court agaist govt?

    Mshahara uliotolewa kutokana na sheria halali ya wakati huo hauwezi kupunguzwa hata kama mhusika ameshushwa cheo!

    Nitaanza kwa kusema kwamba kilichofanyika sio sahihi. Kabla hatujaenda kwenye vifungu vya sheria Civil Service Act, 2003 na pengine Employment and Labour Relations Act, 2004 ili kuona kama Mwajiri anayo mandate ya kushusha mshahara wa mwajiriwa, tujiulize haya:

    Kwamba, ajira ni mkataba/ makubaliano kati ya mwajiri na mwajiriwa. Mwajiri alipotangaza kazi alitoa sifa na pengine masharti ya ajira. Mwajiriwa akaona kuwa anazo sifa, akaomba kazi hiyo. Akasahiliwa na kufaulu. Baada ya hapo, bila shaka alipewa barua ya kufaulu kwake na kuonyesha kuwa amekubaliwa kuajiriwa. Barua hiyo ndio inatoa masharti ya ajira ikiwemo malipo (yaani mshahara). Kwa stage hii, muomba kazi halazimishwi au halazimiki kuajiriwa. Anaangalia masharti ya ajira yenyewe lakini kikubwa anaangalia mshahara (How much do you offer me). Hiki ni kigezo kikubwa sana cha mtu kukubali kuajiriwa. Inawezekana kuwa wakati wa ajira hii, mtu alishwahi kupata offer nyingine mahali pengine. Kwa kulinganisha mishahara ya sehemu mbili tofauti, bilashaka unachagua sehemeu iliyonona kidogo. Mtu huyu (Mwajiri) akikubadilikia kesho na kutoa mshahara tofauti atakuwa amekuumiza na kukupotezea opportunities za mahali pengine.

    Hivyo basi, kwa mantiki hiyo, Mwajiriwa hawezi kukurupuka na akasema leo nashusha msharahara wako bila kukushirikisha na wewe ukatoa idhini au maoni yako. Akifanya hivyo, atakuwa amevunja mkataba wa ajira na atakuwa amekiuka sheria na hata katiba ya nchi. Mwajiriwa hana budi kuchukua hatua.
