Kusimamishwa kazi kupisha uchungu

    Kwa wale wanaojua sheria za kazi. Mimi ni mtumishi katika moja ya kampuni binafsi jijini Dar. Mwezi ulopita nilimjibu vibaya bosi wangu wa kitengo (idara). Siku saba baadaye akaniandikia barua ya kutaka nitoe maelezo kwanini nilimjibu vibaya. Wakati nipokea barua hiyo yaani ndani ya masaa matatu nilipata barua kutoka kwa mkurugenzi kunifahamisha kuwa nimesimamishwa kazi kupisha uchungu. Kinachonisikitisjha ni kuwa hata sijajibu barua ya kutoa maelezo sehemu ya hukumu ishapitishwa.

    Kwa wale manojua sheria za kazi hivi kweli haki imetendeka katika suala langu? Ni taratibu gani nifuate kujupata mustakabali wa suala langu?

    usijali wataalamu wanakuja, ila kwa kuanzia tu, inawezekana sana (kwa maelezo yako) utaratibu haujafuatwa, ila tazama human resource manual yenu, au kanuni za maadili ya kazi na adhabu zake, je ulimtolea mbovu wapi nayo ina nafasi yake, mbele za wafanyakazi wengine au.. ila usiwe na shaka kusimamishwa kazi kupisha uchunguzi haina shida kama una uhakika huna tabia ya kutoa lugha chafu, kama umeshatukana wengine na ukapata onyo, jipange, kama kuna taaasisi ya wafanya kazi pia waweza washirikisha/ kuwapa taarifa. wanakuja

    Kosa lako linaitwa "INSURBODINATION" yaani kumdharau kiongozi wako. Kama umefikia hatua ya kumtukana kiongozi wako, wewe tafuta tuu kazi nyingine maana huwezi kufanya kazi na mtu ambaye humuheshimu.

    Kwa kusimamishwa kazi utaendelea kupata nusu mshahara na pindi ukirudi utapangiwa kazi nyingine kama korokoroni ili uwe na adabu kwa viongozi wako sehemu za kazi

    Unajua tatizo bosi wangu huyo ni ilaza. Mimi nafanya kazi kama punda halafu yeye anataka kila nikifanya na yeye apate posho. Kwa kweli kwa kitendo hiki nikaona nimtolee uvuvi kwa kumwambia anatakiwa ana yeye afanye kazi ili kupata posho. Ndo hapo akasema nimemtusi

    Ndachuwa unajua huyu jamaa amenichosha kwa dharau na kutaka mimi nimfanyie kazi kama punda wake. Yeye kazi yake ni kuvuta posho tu tena zaidi yangu kwa kazi ninayofanya mimi. Ndo maana nikaamua kumtolea mbovu. Aliyenisikitisha ni Mkurugenzi kunipiga benchi hata bila kusubiri maelezo ya barua yangu ambayo yanatakiwa yatolewa ndani ya siku 7.

    Kosa la kujibizana na kiongozi wako vibaya ni Misconduct, hata kukataa alternative work given by your employer is a misconduct, which is a gross insurbodination.
    But the issue is not about the scale of misconduct, bali mtoa mada anataka kujua kama hatua zilifuatwa katika kusimamishwa kwake!

    Kwa kukusaidia kuelewa kama taratibu zilifuatwa ni hivi:
    Once ulipojibizana na bosi wako ama ulimtukana, bosi wako alitakiwa afuate taratibu za kuwajibishwa kwako. Jambo la kwanza ulitakiwa upewe barua ya wito wa mashauri (Disciplinary Hearing). Hapo ndipo utakapohojiwa na kamati kujua sababu za kufanya kosa, na ku determine aina ya adhabu stahiki kama ilithibitika kuwa ni kweli ulifanya kosa.
    Katika hatua hizo, kamati itakupa outcome of the hearing, ikonyesha maamuzi yaliyofikiwa na kamati ya nidhamu.
    Utakuwa na siku tano ya kukata rufaa ambayo itaanza kuhesabika tangu ulipopokea outcome ya DHC.

    Hata hivyo itategemea pia na Mkataba wako wa ajira una conditions za namna gani. Kwani kuna baadhi ya waajiri huingia mkataba na waajiriwa kukiwa na kanuni kandamizi, mfano kuna kuwa na kanuni labda inaelezea kuwa ukimjibu vibaya bosi wako adhabu yake ni kufukuzwa kazi bila kusikilizwa, na wewe unasaini tu haraka haraka kwakuwa unataka kazi.

    Tulia uchunguzi huo ufanyike obviously baada kukamilisha uchunguzi wao watakuita kwenye ''hearing'' ambako utapewa nafasi ya kujieleza na kujitetea then utapewa uhamuzi utakao kuwa umefikiwa kama ni termination au kuendelea na kazi yako, kinyume hapo hutakuwa hujatendewa haki kwa kutokusikilizwa, therefore itabidi ufike ofisi za CMA au Idara ya Kazi kwa ufafanuzi zaidi.

    Hakuna tena kusimamishwa kwa nusu mshahara. Sheria inasema mfanyakazi atasimamishwa on a full pay. Kwa hiyo wakati umesimamishwa unatakiwa ulipwe kama vile uko kazini.

    Kwa private sector sawa, ila kwa serikalini Standing Orders za 2009 zinasisitiza nusu mshahara. Kazi kweli kweli. Yaani labda mwajiri 'akupotezee' tu.

    Pole sana ndugu yangu, unatakiwa kurudi shule au kwa namna yeyote ujifunze jinsi ya kuwasiliana na watu wote bila kuwakwaza, na hasa watu wenye mamlaka juu yako kwa namana moja au nyingine.


    Hoja ya kwamba bosi wako alitaka kitu kidogo kutoka kwako sioni kama ilikuwa na uzito wa kutosha, kwani baada ya wewe kuona hali hiyo ulitakiwa kujipanga kukabiliana naye ikiwa ni pamoja na kutoa taarifa kwa kiongozi wa juu yake, taarifa TAKUKURU au kama uliona haifai basi ulitakiwa kujipanga kutafuta kazi nyingine badala ya kutoa lugha chafu kwa kiongozi wako. Angalia sasa unahaha!


    Umesema umesimamishwa kazi kupisha uchunguzi, hapo nadhani unastahili kuendelea kupata mshahara wako mpaka siku ambayo uchunguzi utaisha na hatua alizozieleza ndugu Mungi kufuatwa.



    Kumbuka Sheria ya Ajira na Mahusiano Kazi ya 2004 inazuia tabia ya zamani ya waajiri ya hire and fire ndio maana imeweka vyombo vya kushughulikia migogoro ya wafanyakazi na waajiri [CMA na High Court Labour Division]. Pia Kanuni za Utendaji Bora za 2007 zimeweka procedure mbalimbali halali katika kufikia kumuadabisha mfanyakazi mwenye makosa kama yako.


    Hata hivyo, usisahau kuwa kwa namna yeyote mwajiri hatakiwi na hana mamlaka ya kumfukuza kazi mfanyakazi bila kumpa nafasi ya kujieleza [akithubutu kufanya hivyo atakuwa amefanya kosa na hiyo ni unfair termination]. Haki ya kusikilizwa ni ya kikatiba.
