Kupita bila kupingwa - this too is democracy?

    WALIOPITISHWA BILA KUPINGWA HAWASTAHILI KUWA WABUNGE BILA YA KUCHAGULIWA


    Kuna kundi la wagombea ambao hadi hivi wanaamini kuwa wao ni wabunge halali wa Jamhuri ya Muungano na hivyo wanasubiri siku ya kuapishwa ili wachukue nafasi zao Bungeni. Wagombea hawa hadi hivi wanajiona ni wabunge wateule kwa sababu katika majimbo yao hakukuwa na upinzani na hivyo wao "wamepita bila kupinga". Jambo hili limerudiwa na vyombo vingi vya habari na hadi hivi sasa karibu majimbo 20 yanao watu wanaojulikana kuwa "wamepita bila kupingwa".

    Jambo hili ni kinyume na Katiba, linatishia demokrasia, linanyang'anya wananchi haki ya kujichagulia viongozi wao na ni msingi wa kuendeleza utaratibu wa watu kutumia ujanja, ulaghai na hata vitisho na unyanyasaji ili wapite "bila kupingwa". Mheshimiwa Mwenyekiti ninaandika barua hii kuelezea kuwa watu hawa wote bila kujali majina yao, sifa zao, au vyama vyao hawana haki yoyote ya kuingia katiba Bunge la muungano kama "wawakilishi".

    Kwanza, Katiba yetu haitambue Ubunge wa "kupita bila kupingwa". Ibara ya 66 ya Katiba yetu iko wazi juu ya aina ya wabunge ambao wanapaswa kuwepo Bungeni. Naomba niinukuu jinsi ilivyo (msisitizo mweusi sehemu zote ni wangu):

    66.-(1) Bila ya kuathiri masharti mengine ya ibara hii, kutakuwa na aina zifuatazo za Wabunge, yaani-
    (a) Wabunge waliochaguliwa kuwakilisha majimbo ya uchaguzi;
    (b) Wabunge wanawake wa idadi inayoongezeka, kuanzia asilimia ishirini ya Wabunge waliotajwa katika aya ya (a), (c ) na (d), itakayotajwa mara kwa mara na Tume ya Uchaguzi kwa taarifa iliyochapishwa katika Gazeti la Serikali baada ya kupata kibali cha Rais, watakaochaguliwa na vyama vya siasa vinavyowakilishwa Bungeni, kwa mujibu wa ibara ya78, na kwa kuzingatia masharti ya uwiano wa uwakilishi baina ya vyama hivyo;
    (c) Wabunge watano waliochaguliwa na Baraza la Wawakilishi kutoka miongoni mwa wajumbe wake;
    (d) Mwanasheria Mkuu;
    (e) Wabunge wasiozidi kumi walioteuliwa na Rais kutoka miongoni mwa watu wenye sifa kwa mujibu wa ibara ya 67, isipokuwa sifa iliyotajwa katika ibara ya 67(1)(b).

    Mheshimiwa Mwenyekiti, Katiba yetu inatambua Ubunge wa aina tatu tu: Ubunge wa kuchaguliwa, Ubunge wa kuteuliwa na Ubunge wa Mwanasheria Mkuu. Wale wa kuchaguliwa wanaangukia katika makundi makubwa matatu: Waliochaguliwa majimboni, waliochaguliwa kwa uwiano wa uwakilishi wa vyama (katika viti maalum) na wanaochaguliwa na baraza la wawakilishi. Wabunge wa kuteuliwa ni wale kumi tu ambao Rais anaweza kuwateua. Na yupo Mbunge mmoja (Mwanasheria Mkuu) ambaye anaingia kutokana na wadhifa wake huo.

    Hivyo, hakuna mtu anayeweza kuingia Bungeni bila ya kuchaguliwa au kuteuliwa kwa namna fulani.

    Mheshimiwa Mwenyekiti, kutokana na ukweli huo kuwa Katiba ambayo ni sheria mama ya nchi yetu kutambua kuwa wabunge ni wa aina hizo tu na kwa vile wengi zaidi kati yao ni wale wa kuchaguliwa katika majimbo basi tuna budi kuhoji wale ambao wamepitishwa kama wagombea pekee ambao wanasubiri "kuapishwa" kuwa wabunge katika majimbo yao wanaweza kudai kweli kuwa "wamechaguliwa" kuwa wawakilishi wa majimbo hayo kama hawajapigiwa kura ya aina yoyote? Je kweli tunaweza kusema kuwa "wamepita bila kupingwa" wakati wananchi wote wa majimbo hayo hawakupewa nafasi ya kupinga au kuwaunga mkono kwa namna yoyote ile? Jibu la maswali yote hayo ni "hapana" yenye kupiga kelele kwa sababu Katiba yetu haitambui ubunge wa "kupita bila kupingwa"

    Naomba kwa heshima na taadhima uniruhusu nielezee kwanini wananchi wenzetu hawa hawaruhusiwi, hawapaswi na hawatakiwi kukubalika kuwa wabunge bila ya kuchaguliwa na wananchi wao kwa namna moja au nyingine.

    Kwanza, walichofanya hadi hivi sasa wagombea hawa ni kupitishwa kuwa wagombea pekee katika majimbo yao na siyo kuchaguliwa. Kupitishwa kuwa mgombea pekee si sawa na kuchaguliwa kwa asilimia 100. Kukosekana kuwepo mpiznani haina maana hata kidogo kuwa huyo mgombea mmoja anakubalika na amechaguliwa na wananchi wote. Hivyo, hadi pale wananchi watakapomchagua kwa asilimia mia moja au zaidi ya asilimia ya wale wanaomkataa mgombea huyo hajachaguliwa na hivyo hatimizi sharti la "kuchaguliwa" katika Ibara ya 66:1(a).

    Pili, kwa mujibu wa Ibara ya 63:2 ya Katiba yetu "Sehemu ya pili ya Bunge itakuwa ndicho chombo kikuu cha Jamhuri ya Muungano ambacho kitakuwa na madaraka, kwa
    niaba ya wananchi, kuisimamia na kuishauri Serikali ya Jamhuri ya Muungano na vyombo vyake vyote katika utekelezaji wa majukumu yake kwa mujibu wa Katiba hii." Kama ni kweli kuwa Bunge ndicho chombo kikuu cha Jamhuri yetu "kwa niaba" ya wananchi itaweza vipi kuwa hivyo endapo baadhi ya wajumbe wake wanaingia Bungeni bila ya kuchaguliwa na "wananchi" hao isipokuwa kutokana na "utaratibu wa kiufundi"? Hivi hawa watakapoenda huko Bungeni wataenda kweli kwa "niaba ya wananchi" bila ya kuchaguliwa kwa namna moja au nyingine?

    Tatu, kwa mujibu wa Ibara ya 21 ya Katiba yetu wananchi wanayo haki ya kushiriki katika utawala wa nchi yao kwa moja kwa moja au "kwa kupitia wawakilishi
    waliochaguliwa na wananchi kwa hiari yao, kwa kuzingatia utaratibu uliowekwa na sheria au kwa mujibu wa sheria." Ni wazi kwamba kwa kukubali watu waliosimama peke yao kuwa ndio wawe "wawakilishi" wa wananchi bila ya "kuchaguliwa" kwa namna yoyote ni uvunjaji mkubwa wa haki hiyo na ni kufungulia mtindo wa watu kujiingiza katika madaraka makubwa bila ya kuchaguliwa. Katiba hairuhusu wawakilishi wa wananachi wawe wale wa "kupitiba bila kuchaguliwa". Ni lazima kwa namna moja au nyingine wachaguliwe.

    Nne, kwa kuruhusu baadhi ya watu wapate ubunge kwa njia ya mkato (yaani bila ya kuchaguliwa) ati kwa sababu hakuna mgombea mwingine wa chama "kingine" tunaingiza na kuendeleza utaratibu mbovu kabisa katika demokrasia ambapo watu wenye uwezo au wajanja wanaweza kusababisha wagombea wengine wasijitokeze ili wabakie "peke yao" wakiamini kuwa kwa kufanya hivyo wataweza kuupata Ubunge bila kupigiwa kura na wananchi wao. Hii ni hatari kwa demokrasia.

    Tano, kwa kuingia Bungeni bila kuchaguliwa kwa namna yoyote watu hao watakuwa wamekosa uhalali wa kuitwa "wawakilishi" na hivyo yote watakayoyafanya hata kama yana uzuri wa aina zote yanakosa msingi wa uhalali kwa sababu hakuna mwananchi hata mmoja wa majimbo hayo aliyewachagua. Kwa kuwaruhusu kuingia Bungeni tunaruhusu utawala wa kujipachika na siyo wa kuchagulika. Kama hawakuchaguliwa na wananchi wa majimbo yao, watu hao wanamuwakilisha nani zaidi ya maslahi yao na ya vyama vyao tu? Ni lazima wachaguliwe.

    Sita, uchaguzi wa namna yoyote ile unawapa watu nafasi ya kukataa. Demokrasia hujengwa pale ambapo nafasi ya kukataa inakuwepo na inaweza kutumika. Kwa kuruhusu baadhi ya watu "wapite bila kupingwa" tunaondoa haki ya kidemokrasia ya wananchi wa majimbo ya watu hawa kuweza kukataa. Si lazima wawakatae kabisa lakini ni lazima nafasi ya kukataa (dissent) itolewe. Kwa kuwapitisha ndugu zetu hawa kuwa ni wabunge wanaosubiri kuapishwa tu, tunaondoa utaratibu wa demokrasia wa wananchi kutoa sauti yao. Hili ni jambo kubwa zaidi kwangu kwani nchi kama ya kwetu inayojaribu kujenga demokrasia ikikubali kuwa sauti ya mamilioni ya wananchi isisikike iwe kwa kukubali au kwa kukataa tunakaribisha ubabe wa watu wachache.

    Saba, toka zamani hata katika mfumo wa chama kimoja tuliwapa nafasi wananchi kuchagua wabunge wake aidha kwa kuwashindanisha na mgombea mwingine ndani ya chama hicho au kwa kuruhusu ipigwe kura ya ndio au hapana. Iweje leo tukubali tu kuwa katika demokrasia tunaruhusu watu wapite tu "bila kupingwa". Hata Baba wa Taifa Mwalimu Nyerere angeweza kabisa kuwa rais bila kuchaguliwa wakati alisimamishwa kuwa mgombea pekee, lakini katika udhaifu wetu wa demokrasia wananchi bado walipewa nafasi ya kumkataa. Hakuna wakati wowote ambapo Nyerere aliweza kushinda urais kwa kupata kura za asilimia 100. Kama katika mfumo wa chama kimoja tuliruhusu watu hata wapigie kura jogoo na jembe, iweje letu hata uchaguzi huu muhimu tuwanyime wananchi wetu?

    Nane, hawa wanaotajwa kuwa wamepita bila kupingwa ni kwamba hawakuwa na mpinzani wa kushindana naye kwenye kugombea nafasi hiyo na siyo kwamba wamepita kuwa wabunge. Mchakato ambao umewaacha wao kuwa peke yao haukuwa na lengo la kutoa wabunge bali 'wagombea ubunge'. Hivyo, kwa usahihi hawa wanatakiwa kuwa ni "wagombea pekee" na siyo "waliopita bila kupingwa". Kwa vile ni wagombea pekee basi wananchi lazima wapate haki ya kuwakubali au kuwakataa kwa kuwapigia kura.

    Tisa, kinachotokea sasa hivi ni kutafsiri kura za maoni za CCM kuwa ni kura za uchaguzi. Kwamba, kwa vile mtu kashinda kura za maoni na sasa hana mpinzani wa kugombea naye kwenye kura za wananchi wote (uchaguzi mkuu) basi mtu huyo amechaguliwa kuwa mbunge. Hii si kweli. Kura za maoni za watu wa chama kimoja hata kidogo hazipaswi na hazitakiwa kuchukuliwa kama ni kura za wananchi wote. Wana CCM walipopiga kura walikuwa hawachagui Mbunge na si haki kuwapa watu wa chama kimoja tu uamuzi wa mwisho wa nani anakuwa mbunge wa jimbo fulani. Hivyo, ni lazima hao wagombea waletwe kwa wananchi wote ili wao wananchi - wale wasio wana CCM na wale wana CCM waliomkataa kwenye kura za maoni- wapate nafasi ya kusikika uamuzi wao.

    Kumi, kwa makusudi sijagusia suala la sheria ya uchaguzi au hata taratibu ambazo zimeruhusu hali hii kuendelea. Sababu kubwa ni kwamba Ibara hiyo ya 66 ya Katiba haitoi mwanya au nafasi hata chembe ya kupitisha sheria itakayosababisha watu waingie Bungeni bila kuchaguliwa kwani maneno yake yako wazi kabisa kuwa ni lazima wabunge wanaotoka majimboni wawe ni "wa kuchaguliwa" tena kama inavyosema katika sehemu nyingine kuwa "kwa hiari". Waliopita bila kupingwa wakiwa wabunge watakuwa hawajachaguliwa na wananchi hawakupewa hiari yao kutumia kuwachagua. Hivyo, utaratibu au sheria yoyote yenye kuruhusu hilo haina msingi katika Katiba, Mantiki na haki za wananchi.

    Mheshimiwa Mwenyekiti, ni wazi kuwa bila ya kuchaguliwa au kuteuliwa mtu hawezi kuwa Mbunge. Kwa vile kuna kundi la watu ambao wamepitia na kuwa wagombea pekee katika majimbo yao baada ya vyama vingine kwa sababu mbalimbali kushindwa kusimamisha wapinzani basi ni lazima Tume yako iweke utaratibu ili watu hawa wapigiwe kura na kuchaguliwa ili wapate uhalali wa kuingia Bungeni. Ni lazima wananchi hawa wanaotaka kuwawakilisha wananchi walazimishwe kurudi kwenye majibo yao wauze sera zao wa kwa wananchi na kutoa nafasi kwa wananchi kuwahoji na kuwapinga. Lakini zaidi vile vile ni muhimu sauti tofauti nayo ipewe nafasi ya kusikilizwa kwani kama kuna watu ambao wangependa kuelezea kwanini watu hao wasichaguliwe au chama hicho kisichaguliwe basi ni lazima sauti hizo zipewe nafasi hiyo kwa njia ya kawaida ya kampeni.

    Hivyo basi, naomba kutoa pendekezo jepesi kabisa kuwa wagombea wote waliopitishwa kuwa wagombea pekee katika majimbo yanayokaribia ishirini wapigiwe kura ya "ndio" au "hapana" katika majimbo hayo. Kwa kufanya hivyo wananchi wa majimbo hayo watatumia nafasi yao ya kuwachagua wawakilishi wao na siyo wagombea hao wajipeleke vifua mbele huko Dodoma ili waapishwe kuwa wabunge wakati hakuna kura hata moja iliyopigwa kuwachagua. Endapo watapata kura zaidi za "ndiyo" basi watu hao watakuwa wamepata uhalali wa kuwa Bungeni na watatimiza masharti ya Ibara ya 66 yaani "wamechaguliwa" na endapo watapata kura nyingi za hapana basi watashindwa kuwa wabunge na viti hivyo vitakuwa wazi na hatimaye uchaguzi mdogo mwingine utatakiwa kufanyika kwa mujibu wa sheria.

    Na kwa vile baadhi yao (kama siyo wote) wanaamini kuwa wanakubalika na kupendwa katika majimbo yao kiasi cha kukosa wapinzani ni matumaini yangu watakuwa tayari na watakumbatia kwa furaha wazo hili la kupigiwa kura ya "ndio" au "hapana" ili waweze kusema kuwa na wao wamechaguliwa. Na endapo Ofisi yake itashindwa kuweka utaratibu wa ndugu zetu hawa kupigiwa kura na baadaye kuwatambua kuwa ni "wabunge halali" hata kama hawana uhalali basi wasipewe nafasi nyingine yoyote ya juu katika serikali (kama Uwaziri au Unaibu) kwa sababu ya kukosa sifa muhimu ya kuwawakilisha wananchi kwani ni ukweli wa wazi kuwa hawakuchaguliwa na mtu yeyote kwenye uchaguzi huru na wa haki kuwa wawakilishi wake.

    Na endapo Tume yako itawatambua watu hawa ambao hawajachaguliwa kuwa ni "wabunge" kinyume na matakwa ya Katiba yetu ya Muungano ambayo uliapa kuilinda, mimi kama Mtanzania nikitumia haki yangu ya Kikatiba ya kudumisha hifadhi ya Katiba yetu natangaza katika dhamira safi na mapema kabisa kutowatambua watu hao ambao wataingizwa bungeni bila ya kuchaguliwa na mwananchi mmoja au kuteuliwa Rais; kwamba ninawakataa kuwatambua kama Wabunge halali wa Jamhuri ya Muungano wa Tanzania hadi pale watakapopigiwa kura na kuchaguliwa kwa namna moja au nyingine ili wapate uhalali kwa mujibu wa Katiba.

    Ni matumaini msimamo wangu huo utalazimisha Watanzania, taasisi, na vyama mbalimbali kuchukua msimamo kama huo wa kutowatambua kuwa ni wabunge halali wale wote watakaoingia Bungeni aidha bila ya kuchaguliwa na wananchi au kuteuliwa kama ilivyo katika Ibara ya 66.

    Hii ndio faida ya kuwa na wasomi, watu wenye uwezo wa kupembua mambo na kugundua udhaifu ulipo na pia kutoa mwongozo wa jinsi ya kuepuka tatizo.

    Ni kweli kabisa mtu kupita bila kupingwa zama hizi za ushindani wa kila kitu kuna ashiria ulaghai fulani mahali fulani. Hata zamani za chama kimoja mgombea pekee alikuwa akipigiwa kura sembuse zamani hizi za utandawazi na uwazi?

    Mimi nakumbuka kisa cha Sadamu husein kuchaguliwa kwa asilimia mia kumbe hadaa na ulaghai uliokithiri. Sasa wagombea wote wanaodai kupita bila kupingwa wajichunguze kwani kutakua na jambo nyuma ya pazia.

    Kuna hili la mgombea kupita bila kupingwa kwernye chama chake, well that mayh sound right though not! Lakini inakuwaje kwenye eneo say la watu laki 5 hupati mpinzani kutoka chama kingine?

    Hii ni demokrasia kweli? This could probably be just another proof kwamba kuna uwezekano taifa linapoteza fedha bure na hizi chaguzi ilhali suala zima la demokrasia halieleweki.

    Wanapita bila kupimngwa na chama chochote kile, kwa yapi ya kuigwa waliyoyafanya au watakayoyafanya majimboni kwao?

    Isije ikawa kuna biashara huko majimboni where by instead of spending 50million Tshs kwa kampeni nawapa milioni kumi kumi wapinzania wangu wajitoe then kupita bila kupingwa.

    All in all this is a joke of democracy especially in these times when most of us believe watanzania wameamka.

    Kupita bila kupingwa ni kawaida sana. Hata kwenye nchi zilizo na demokrasia iliyokomaa kupo. Kwa hiyo hakuna cha ajabu kinachoshangaza hapo....

    Well nakubaliana na wewe mkuu, kuna tofauti kidogo kwenye hii ya kwetu....... Wapinzani walichukua fomu and some did it just last week halafu hawarudishi, can't you see that there is something fishy?

    And after all can't we set the standards of our own?

    Na kwenye demokrasia zilizokomaa mara nyingi kupita bila kupingwa ni kwenye local elections.

    Uuum kwa Marekani kwa mfano, raisi Bush mwaka 2004 hakupingwa na mtu kwenye re-election campaign yake. Je, hiyo ilikuwa ni local election? Senator Chuck Grassley, R-Iowa mara nyingi huwa anapita bila kupingwa...na kuna ma senator na ma congressmen and women ambao hupita bila kupingwa.

    Sasa unaweza ukaja na nadharia zako kwa nini kwenye baadhi ya sehemu wagombea hupita bila kupingwa lakini ukweli wa mambo ni kwamba kwenye demokrasia tegemea yote na lolote ikiwemo kupita bila kupingwa.

    Kama hao wapinzani walichukua fomu na hawakuzirudisha basi hilo ni juu yao. Zaidi ya hapo ni speculations tu maana usikute hata chance zao za kushinda were slim to none....

    OLYMPIA — For 39 people running for the state Legislature — nearly a third of all races — the November election is essentially over.
    They have no opponent.
    It's the largest number of unopposed candidates in at least 36 years. And it's no one-time blip, but rather a decades-old trend that's increasing over time.
    Democratic Party Chairman Dwight Pelz says it's nothing to fret over. "I wouldn't say people should worry," he said. "I think in Washington state, Democrats and Republicans are competing on the issues and are posing viable alternatives to the people."
    But he speaks from a position of comfort. Most of the unopposed candidates are Democrats, and the party already controls the state House, Senate and governor's office.
    Others express concern. "I think there is something wrong with our system and this is another indicator of it," said Bryan Jones, a political-science professor at the University of Washington. "It just gives me real heartburn."

    Those facing no challenger in the November election include: • House Majority Leader Lynn Kessler, D-Hoquiam
    • House Appropriations Chairwoman Helen Sommers, D-Seattle
    • House Finance Chairman Jim McIntire, D-Seattle
    • House Deputy Republican Leader Mike Armstrong, R-Wenatchee
    • Rep. Gary Alexander, R-Olympia, ranking Republican on the House Appropriations Committee

    Secretary of State Sam Reed, a Republican, also said he finds the number of uncontested races troubling.
    Competition "is a very important part of the process. It makes us better public servants to be questioned and challenged," he said. "And I have seen a number of times when somebody is not expected to have a chance and they end up winning. That's not happening much anymore because they [the parties] don't field candidates."

    Critics contend the lack of competition can lead to a less-responsive Legislature because politicians who don't have to worry about getting kicked out of office are less likely to listen to their voters.

    Unopposed candidates in safe seats also can have disproportionate influence in Olympia. They tend to stick around in office longer, and gain power through longevity. Plus they can raise buckets of cash they don't need and give it back to their party — another measure of political clout.
    So far this year, incumbents with no opponents have raised about $1.5 million, and the election is still nearly three months away.

    Apparent factors behind the lack of competition include the increasing cost of campaigning, the preponderance of so-called safe districts where one party dominates, and the fact that the deck is stacked in favor of incumbents.

    The amount of money spent by winning candidates increased more than 200 percent between 1984 and 2004, to more than $98,000 each on average. In hotly contested races, costs can soar to several hundred thousand dollars.

    "Running for the Legislature is a major sacrifice," said Paul Berendt, former chairman of the state Democratic Party. "There was a time when there wasn't that much money involved and you didn't have to sacrifice your career in order to run for the Legislature, and that is becoming less the case now."
    Matt Rice, of Gig Harbor, ran as a Republican against Democratic Rep. Pat Lantz in 2004 and lost. He considered running again this year but decided not to. Another person is running for his party.

    Rice said he decided he shouldn't take time away from his job as the chief medical officer for Northwest Emergency Physicians. And his family wasn't eager for him to run either, he said.

    "Families pay a lot bigger price in this than people ever look at. It's less time at home. You get calls from people who are really kooks and are mean," he said. "It takes a toll on them."

    In addition to the financial and personal costs challengers have to deal with, some say redistricting — the redrawing of election district boundaries every 10 years — has created more safe districts where a particular party is virtually assured of winning.

    There's also a certain amount of "self-selection geography" going on, said Todd Donovan, who teaches political science at Western Washington University. "If all the people who keep [moving] to the west side are more disposed to be liberal and the people on the east side are more conservative, it gets really hard to create competitive seats."

    Then there's the power of incumbency. Politicians are hard to defeat once they get into office. They have name recognition, a track record in office and, more importantly, the ability to raise lots of money. Contributors are inclined to donate to sitting legislators who are more likely to win another term.
    State records show the money gap between incumbents and challengers has steadily increased. In 1978, challengers spent about 13 percent less than incumbents. By 2004 they spent 38 percent less on average.

    Mkuu, hili suala linasikitisha sana. Ila kwa Tz lolote linawezekana. Mchezo mchafu nadhani ndiyo sababu kubwa ya baadhi ya watu kupita bila kupingwa. Kwa CCM kitu cha msingi ni ushindi bila kujali gharama ya huo ushindi. Very very sand and this a terrible mistake.
