ECK staff on hunger strike

Around 600 Election Commission of Kenya- ECK- employees have gone on hunger strike protesting plans to sack them amid government move to disband the body , a spokeswoman said Wednesday.

The ECK is to be disbanded as part of political reforms in the wake of its disastrous handling of the 2007 presidential election, when its tallying of the vote sparked widespread violence.

Speaking at a press conference, [ECK] spokesperson Joan Mutindi said, according to the Kriegler report which was recently adopted by parliament, there were no recomendations for sacking of ECK staff".

She said her staffs were not constitutional office holders but public servants like other government employees.

Mutindi added that the government had spent so much time and resources in building their capacities as election professionals so they should not be dismissed.

She added that Kriegler report clearly stated they will continue to be nothing more than Senior Assistants to the commissioners.

The Electoral commmision supports reforms in the electoral systems, are willing and able to implement them but holding of office will not interfere with the reforms Kenyans are asking for" Mutindi emphasized.

"We will continue with our services in our offices... we are still working although we are on hunger strike," she said.

"We want to be heard. We don't want blanket condemnation. If there are people to go home it is the decision-makers. We are not answerable to any decision," Mundidi told AFP.

The staff want the Constitution of Kenya Amendment Bill No. 2 of 2008 withdrawn.

The Bill, which seeks to establish an Interim Independent Electoral Commission to replace the ECK was published last week and is due to be presented to Parliament anytime.

The new panel is expected to oversee a "reform process, register voters afresh, supervise (a) referendum and promote free and fair elections," according to the bill.

The ECK staff are also protesting that should the Bill be passed, it would set a dangerous precedent that would see employees of other constitutional bodies sacked over mistakes made by their superiors.

Elsewhere, the government has received one million shillings from the US government to facilitate the implementation of the Electoral reforms agenda and provide experts to oversee the special tribunal and ensure greater accountability in Government activities.

The reform, if fully implemented will put in place constitutional provisions, laws and mechanisms to deal with the culture of impunity, ethnic tensions and accountability in the country.

US Ambassador Michael Ranneberger speaking on tuesday during a press briefing, said he was confident that the agenda for fundamental reform will be embraced by all adding that this will ensure greater accountability in government and among politicians.

The Ambassador noted that the only way to ensure the reform agenda was transparent and effective was to take into account the opinions of Kenyans through the civil societies in the country.

"Involving the public for their opinion will ensure that there are no loopholes or hidden agendas in the relevant legislation, with respect to the special tribunal and establishment of an independent electoral body "he said.

He said that the move by the cabinet to abolish the current Electoral Commission and form a new independent electoral body was a clear indication that the government was committed to ensuring that reforms were fully and effectively implemented.

" The president and Prime Minister are managing a very complex political situation, and reform agenda raises a host of sensitive issues that must be carefully navigated" he said

The reform agenda is a test for MP's to show whether they represent constructive change in terms of passing relevant legislation for interests of Kenyans and paying a fair amount of tax.

He however noted that though the process of implementing the reform agenda had been slow as most bills are waiting to be signed into law, the judicial and prosecutorial reforms remained immense hurdles that need to be addressed.

He urged parliamentarians, leaders of the coalition government, civil society, the private sector and the media to work together and move beyond strictly ethnic politics to achieve a national approach.

Yes huu utakuwa mwanzo mzuri na tume nyingine zitajifunza kutekeleza wajibu wao badala ya kuvuruga uchaguzi kwa kushirikiana na viongozi fisadi kujihakikishia ka kujipangia ushindi!

Kuwajibisha vipi wakati vyama tawala vinafinyangafinyanga katiba ili ziwalinde.

Hebu fikiria katika Bongo katiba yao inaweka wazi kuwa Tume ya uchaguzi ndiyo inamamlaka ya kumtangaza mshindi wa kiti cha Urais na hakuna mahakama yoyote itakayohoji utangazaji huo. Hii ina maana hata kama atakaye tangazwa na tume si mshindi wa kura ninyi wengine hamuwezi kuwahoji na hata mahakama haiwezi kuwagusa na kama wakipelekwa watashinda kwani wamepewa mamlaka hayo na sheria mama (Katiba)

Issue ya kenya ni unique sana kwanza tujue kuwa kuna serikali ya maridhiano na makubaliano hivyo hii ni issue ya kipekee kwa Africa.

Parliament on Tuesday disbanded the Electoral Commission of Kenya, sending home its chairman, Mr Samuel Kivuitu, and his team of 21 commissioners.

169 MPs passed the Constitutional Amendment Bill (2008) which also replaced the ECK with an Interim Independent Electoral Commission (IIEC).

Parliament only needed 145 MPs to pass the law. No MPs voted against the amendment and none abstained. Fifty-three MPs were absent.


Later, 174 MPs voted to push the Bill through the third and final stage. It now awaits the President’s signature to become law.

Referendum

The Bill, which amends Section 47 of the Constitution also provides for a referendum law and establishes an interim Constitutional Court to preside over disputes that are likely to arise from the review process.

The interim commission has the mandate to carry out wide ranging electoral reforms, register voters afresh and install new systems of tallying votes to ensure that elections are free, fair and credible.

The House has already passed the Constitution of Kenya Review Bill, which outlines the road to a new Constitution. President Kibaki has already signed it into law.

Moving the motion to disband ECK on Tuesday, Justice and Constitutional Affairs minister Martha Karua said the Government was putting in place the interim commission to restore the confidence of Kenyans in the electoral system as recommended by the Kriegler report on last year’s disputed presidential elections.

The passing of the Bill was the result of consultations and intense lobbying by the President and the Prime Minister who were seeking the support of MPs to obtain the 145-member threshold required to change the Constitution. Deputy Speaker Farah Maalim presided over the vote.

Ms Millie Odhiambo (nominated, ODM) said Kenya would be a better place if Parliament stayed focused on the reform agenda.
She called for a balanced Parliamentary Select Committee which will ensure equitable gender and regional representation. The committee will nominate the nine new members who will become the IIECK commissioners.

Prof Margaret Kamar (Eldoret East, ODM) said the committee should come up with modalities to ensure that both the process and the content of the Bill remained beyond reproach.

Mr Eugene Wamalwa (Saboti) called for a review of constituency boundaries, saying some constituencies were being shortchanged.

It is after Mr Wamalwa spoke that Agriculture minister William Ruto stood and asked that the debate be cut short for the voting to start. He was supported by Local Government assistant minister Robinson Githae.

The results were 169 in favour and none opposed. The vote effectively set in motion the stalled constitutional review process. Both President Kibaki and PM Odinga had promised to ensure that a new Constitution is enacted by April next year.

With Tuesday’s vote, MPs also entrenched the review process in the Constitution and cleared the way for a new supreme law that the country has been trying to write for the last two decades.

While they were unanimous that ECK chairman Samuel Kivuitu and his team must pack their bags and leave their office at Anniversary Towers, the MPs criticised themselves, security forces and the media for the violence that rocked the country early this year.

However, Cabinet minister Mutula Kilonzo and Kipipiri MP Amos Kimunya demanded a process of identifying the villains in the commission so that those who were innocent could be set free and be well compensated.
