    Wanajamii kama mlimsikia jana Waziri Mkuu Pinda kwenye taarifa ya habari jana saa mbili usiku kwenye ITV, alieleza kuwa, kuna viongozi wastaafu, ambao wengine walikuwa marais, mawaziri wakuu, n.k. wana uzoefu mzuri na mkubwa tu wa chama na serikali. Sasa hawa watu wakiwa na dukuduku au jambo fulani wanaweza kumuona rais na kumshauri juu ya jambo hilo……. Na baada ya kujadiliana na rais nadhani watafikia muafaka…. Lakini sasa wanavyotumia majukwaa ya vyombo vya habari kueleza mambo yao yanayo wakera haioneshi kuwa wana dhamira njema. Kufanya hivyo ni kana kwamba wamepeleka maoni yao kwa rais na yamekataliwa. Kitu ambacho si kweli, wangeenda kwanza kwa rais, ikitokea wamekataliwa basi wanaweza Kwenda kwenye media.

    My Take:
    Hayo maelekezo ambayo ameyatoa kwa viongozi wastaafu mbona hawakuyatumia wakati wanampinga Dr. Magufuli waziri wa ujenzi kwenye zoezi lake la bomoa bomoa? Je yeye [Dr. Magufuli] walimwita na kushauriana naye juu ya bomoa bomoa na akakaidi na hivyo kuamua kumchonganisha na wananchi majukwaani? Au maelekezo kama hayo [ya kujadiliana kwenye vikao stahili (hapa tunaongea baraza la mawaziri)] hayatumiwi kwa watu walio chini yao? Na kama Dr. Magufuli alikana kuachana na mpango wake huo wa bomoa bomoa kwenye kikao, kwa nini wasinge mshauri ili ajiondoe/kumuondoa, wa sababu hakuafikiana na matakwa ya baraza la mawaziri na aliyemteua, maana hilo ni nafuu kuliko kuchonganishwa na wananchi?
    Hapa inaonesha kwamba mkubwa akiumbuliwa majukwaani/kwenye vyombo vya habari, waliomuumbua [wanaambiwa eti] hawaja fuata utaratibu na ni wabaya. LAKINI wadogo wakiumbuliwa na wakubwa majukwaani/vyombo vya habari, hilo halina neo. TAFAKARI.

    Kuja kwa swala la magufuli Pinda na Rais JK walimkosesha Maghufuli na wananchi kwanini nasema hayo JK na Pinda serikalini wamekaa muda gani wataka kuniambia serikali hakuwa na mipango miji kuendeleza maeneo? je walitakiwa kuwajibika ktika hilo ni akina nani idara ya Aridhi au kwani manispaa nyingi mikoani ndio walio gawa viwanja kwa raia sasa sheria inapita wao JK na pinda wana sema jamani tuwe na huruma ivi sheria na katiba zilitungwa iwe ivyo wengine wavurunde na muwatetee na kumtoa mtu anaye wajibika kwa maendeleo ya nchi na kuwwacha wale walio vuruga nchi mbona wanapishana hawa viongozi kwa kauli zao na Kanuni na sheria za nchi waliapa ilikuja kutufanyia madudu hapo kweli wamekiua chama chao CCM bila kukijua na this time wao ndio wanapindisha kabisa HAKI na wanataka kulilia AMANI sijui hiyo AMANI ni ya aina gani sijui.

    Nakumbuka mwanzoni mwa miaka ya 1970 wakati wa zoezi la uanzishwaji wa vijiji vya ujamaa ulijitokeza mgogoro mkubwa kati ya aliyekuwa jaji mkuu Augustino Saidi na majaji wenzake. Kiini cha mgogoro huo zilikuwa ni kesi za ardhi zilizohusisha vijiji vya ujamaa na watu binafsi; kilichotokea ni kwamba kwakuwa vijiji vya ujamaa kwa wakati huo vilikuwa havijaandikishwa kisheria havikuwa na sifa ya kumiliki ardhi,na hivyo mara zote vilipokuwa vikishitakiwa kwa uporaji wa ardhi vilikuwa vikishindwa. Katika jitihada za kunusuru vijiji hivyo, jaji mkuu aliandika waraka uliotaka kesi zote za vijiji vya ujamaa zipelekwe kwake. Waraka huo ulizua ubishi mkali wakati wa mkutano wa mwaka wa majaji ambapo majaji hao walimpinga wazi wazi jaji mkuu kwa kumueleza kwamba madaraka yao ya kisheria hayawezi kuondolewa na waraka wake. Mambo yalipokuwa moto jaji mkuu akamwita mzee Kawawa ambaye kwa wadhifa wake kama waziri mkuu na makamu wa pili wa rais alikuwa pia waziri wa sheria. Mzee Kawawa baada ya kusikiliza hoja za pande zote, alikata shauri kuwa majaji walikuwa sahihi; alisema kazi ya mahakama ni kusimamia sheria, hivyo serikali ikiona sheria yeyote ina mapungufu ni jukumu lake kuifanyie marekebisho na wala siyo kuipindisha

    Mkuu nakupa big up kwa kuelezea kinaga ubaga juu ya suala hili. Mimi nasikitika kwa sababu mpasuko ndani ya CCM [ambao Kikwete binasfi anabisha kuwepo kwa hali hiyo] unaathiri hadi kwenye utendaji wa serikali. Hapa inadhihirika wazi kabisa kuwa wale wote [ yaani watendaji wa serikali] ambao wako ule upande mwingine wa mpasuko y[aani upande unaopingana na Kikwete na kundi lake ndani ya CCM] unapingwa, wanategwa, wanabezwa, pia wanafanyiwa hila mbali mbali ili kukwamishwa katika utendaji wao katika serikali ili tu ionekane na wananchi kuwa hawafai. Na pengine pia hata kutishiwa maisha kama mlivyoona kwa Dr. Mwakyembe........ Hili ni hatari kwa taifa na nchi inaweza kuangamia, labda tumpate mtu [Rais/Kiongozi] ambaye anakiri udhaifu unaojili na pia anukemea bila kuuma/kumung'unya maneno, na si kiongozi ambaye anakana auhakiri kuwa kuna udhaifu hivyo anashindwa kuukemea kwa sauti kuu au anauma maneno au anapata kigugumizi kukekmea ubaya.

    Hapo penye red mzee, nakumbuka JK wa ukweli mwaka 1992 alivyosoma katiba za vyama vyote vya upinzani vilivyoanzishwa wakati huo, alisema CHADEMA ni chama ambacho kitaisumbua sana CCM. Na hayo sasa yanadhihiri.
    Wakisimamia vizuri katiba yao, basi 2015, CCm bai bai.

    Mkuu aksante kwa kutukumbusha historia......
    kuna kesi maarufu kama Mulbadaw Village vs NAFCO na Ololosokwan Village vs Tanzania Cattle Products.
    Kuhusu sheria, kama Taifa kuna sheria nyingi ambazo ni vigumu kuzisimamia ama kwa sababu kuzichukua kutoka nchi au mazingira tofauti na kuzileta nchini, au kupitwa na wakati.... moja ya sheria ambazo huwa zinasumbua sana ni sheria za ardhi na za barabara. kuna matukio ambayo mtu ana hati ya kumiliki eneo lake, lakini anaambiwa yuko kwenye hifadhi ya barabara.

    Halafu kuhusu suala la Magufuli kuzuiwa na viongozi wake kutsimamia sheria hili ni kawaida katika nchi hii, na ndiyo maana tuko katika hali mbaya namna hii. Ngoja nikupe mfano mmoja miwili..... unakumbuka kampuni ya kukagua madini ya Alex Stewart Assayers, wataalam wa kodi walimshauri waziri [wa wakati huo] Mramba kuwa kampuni hiyo ilipe kodi zote za kisheria, lakini akaktaa. Haya waziri wa Utalii alishauriwa na wataalam kuwa kodi kwa wanaondesha mahoteli ya utalii iwe kiasi hiki [kikubwa] kulingana na sheria pia kulingana na hadhi ya hotel zenyewe, waziri akakaidi. Kwa hiyo magufuli anaposimamia sheria bila kupindisha, wanaona anafanya kitu ambacho sio culture ya CCM na viongozi wengi wa serikali. Na kwa kuwa wao wamezoea usanii wanamzuia kwa sababu wanazozijua wao.....

    Hawajamuonea magufuli bali wamewaonea wananchi wapenda maendeleo, bila kufuata sheria nchi haiwezi kuendelea. Kwa kuzuia sheria kuchukua mkondo wake, barabara hazitapanuliwa tena na wala barabara za juu hazitojengwa, kwa maana hiyo kero ya msongamano wa magari barabarani hasa dar haitakwisha na uchumi wa nchi utazidi kuporomoka. Waswahli husema "sheria ni msumeno, hukata mbele na nyuma" sasa hapa vipi? serikali itapedwa na wananchi kwa kuwaletea wananchi maendeleo, siyo kwa kupindisha sheria.

    mchango wako umenikumbusha mtihani wa form two mwaka 1992 na form four mwaka 1993. mitihani hiyo ilikuwa migumu sana. waziri husika alitaka kuifuta ili irudiwe lakini baraza la mitihani likamkomalia ikabidi azime sigara! sikumbuki alikuwa waziri gani. Lakini toka wakati huo sina kumbukumbu ya mitihani kutungwa migumu kiasi kile [kwa wanafunzi wa wakati huo mnaikumbuka]!!

    Tabia ya serikali za nchi maskini zinaufanano katika matendo ya wanasiasa. Wanasiasa katika nchi hizi wanatabia ya kutokubali kushindwa. ukimshinda leo ki-sheria atakuja na mbinu ya kukusambaratisha kwa kupulizia au kukuchekea kirafiki.
    So .....................
    either way Magufuli was to be brought down because their superiors are not happy with his performance from the very beginning!!!

    Yawezekana kuna siri nzito juu ya ujenzi barabara. Siamini kabisa kama JK na Pinda hawajui kuwa barabara haziwezi kujengwa bila kubomoa nyumba zilizo kwenye road reserve. Naamini kabisa kuwa Magufuli anachojaribu kutenda kiko ndani ya sheria ambazo JK na Pinda wanazijua.
    Ninachoona hapa ni kutaka kukwamisha ujenzi wa barabara. Hii ni kwa maslahi ya nani?

    Kikwete's directive to stop demolition sparks debate
    The recent order by President Jakaya Kikwete to the Works minister regarding the on-going demolition of structures along road reserves has drawn mixed reaction from different sections of the society.
    Early last week, President Kikwete directed Dr John Magufuli to stop applying force in the demolition of houses built on road reserves, saying friendlier demolition would do in the exercise.
    "Demolishing houses before addressing complaints of the owners of the buildings would be injustice. We should not look for approaches, which appear simple to us at the expense of the people," the President said during his official tour of the ministry.
    Mr Kikwete's statement is seen as rubbing salt to the wound, as Dr Magufuli was still pondering the same order by the Prime Minister, Mr Mizengo Pinda.
    The minister appealed to the visiting Head of State to let him carry out the operation, noting that construction of buildings on road reserves was one of the ministry's major challenges, as owners of the buildings were often reluctant to voluntarily pave way for road construction whenever they were asked.
    "I am of the view that we have to implement the law. We want to change the face of our country and our cities by building highways, we have to demolish houses and other structures established on road reserves as the law requires," Dr Magufuli stressed.
    Mr Mizengo Pinda had during his tour of Dr Magufuli's Chato constituency early this month ordered the Works minister to suspend the exercise, pending further consultations and communication from the Cabinet.
    Mr Kikwete insisted that there should be leniency in demolishing buildings illegally built on road reserves, including tracing the history of some of the plots.
    Authorities should make a thorough study on the origin of the respective roads, as some were ‘native roads' before they were upgraded.
    Some interviewees lauded the President's directive, while others condemned it, insisting that the law should always take its course regardless of different circumstance.
    Mr Ramadhani Kisanda, a Mabibo resident whose part of his house was demolished recently, commended President Kikwete's directive.
    "I do not commend the President because part of my house has been pulled down, but rather because he has reminded Dr Magufuli of the poverty inflicting the majority of us Tanzanians.
    "The minister had given us one-week to demolish our houses, how can an ordinary Tanzanian afford to build or find another residence within such a short period?" Mr Kisanda queried.
    A resident of Arusha, Ms Getrude Francis, also supported President Kikwete's directive, contending that fairness and justice ought to be observed in executing such operations.
    Dr Mgaufuli was supposed to consult local authorities' leaders, who, according to her, were to blame for allowing members of the public to construct houses in those prohibited areas.
    "How come the Tanroads (Tanzanian Roads Agency) officials, civic leaders and the district council directors relax when they see people constructing buildings on road reserves and in other prohibited areas?" she wondered.
    But Mr Iddi Bilal whose stall was demolished during the recent incident at the Big Brother Market was skeptical with President Kikwete and Mr Pinda's directives, arguing that they were politically motivated.
    Mr Bilali sees the national leaders' directive as a ‘common phenomenon among African leaders', who often opt for short-term and simple solutions for serious problems facing their countries.
    "I wonder where the money required to compensate houses constructed at road reserves and after upgrading ‘native roads' will come from … the defunct East African Community (EAC) retirees have been fighting for their pensions for over two decades now to no avail," Mr Bilali said.
    A third year Political Science and Public Administration student at the University of Dar es Salaam, Mr Reginald John, takes Mr Kiwete and Mr Pinda's directives as a ‘political gimmick' aimed at restoring the lost public trust in Chama Cha Mapinduzi (CCM).
    "The cost of living for an ordinary Tanzanian has tremendously soared, leading to members of the public to lose trust in CCM and its government leadership under Kikwete.
    "The President's directive has been compounded by CCM's desperation to restore its tainted public image," he said.
    A commentator to the Mwananchi newspaper's website, who identified himself as one Dr More, criticised President Kikwete for politically interfering with the enforcement of the country's laws.
    "There has never been any economic development that has been achieved without causing pain to some people. Every leader is supposed to fulfill his or her duties as per laws and regulations of the country.
    How come the President and his Prime Minister interfere with activities of a minister, who operates within the laws of the country," he wondered.
    A lawyer based in Mwanza, Mr Salvatory Magafu, accused the President of mixing politics with laws, saying the 2007 Road Act number 13 clearly stated that there should not be any building or structure within a road reserve.
    "The Act has not left any room for any other consideration…I wonder where does the President find the mandate to prevent the law from taking its course," he queried.
    Mr Magafu attributed the country's failure to accomplish several projects to inconsiderate interference by politicians.
    He explained that the Road Act gave the Works minister the mandate to oversee all trunk and regional road projects.
    President Kikwete though is the minister's boss, was not supposed to prevent Dr Magufuli from carrying out his responsibilities provided the latter adhered to the laws of the country, he stressed.

    “The minister had given us one-week to demolish our houses, how can an ordinary Tanzanian afford to build or find another residence within such a short period?” Mr Kisanda queried.
    A resident of Arusha, Ms Getrude Francis, also supported President Kikwete’s directive, contending that fairness and justice ought to be observed in executing such operations.
    Dr Mgaufuli was supposed to consult local authorities’ leaders, who, according to her, were to blame for allowing members of the public to construct houses in those prohibited areas.
    “How come the Tanroads (Tanzanian Roads Agency) officials, civic leaders and the district council directors relax when they see people constructing buildings on road reserves and in other prohibited areas?” she wondered.
    But Mr Iddi Bilal whose stall was demolished during the recent incident at the Big Brother Market was skeptical with President Kikwete and Mr Pinda’s directives, arguing that they were politically motivated.
    Mr Bilali sees the national leaders’ directive as a ‘common phenomenon among African leaders’, who often opt for short-term and simple solutions for serious problems facing their countries.
    “I wonder where the money required to compensate houses constructed at road reserves and after upgrading ‘native roads’ will come from … the defunct East African Community (EAC) retirees have been fighting for their pensions for over two decades now to no avail,” Mr Bilali said.
    A third year Political Science and Public Administration student at the University of Dar es Salaam, Mr Reginald John, takes Mr Kiwete and Mr Pinda’s directives as a ‘political gimmick’ aimed at restoring the lost public trust in Chama Cha Mapinduzi (CCM).
    “The cost of living for an ordinary Tanzanian has tremendously soared, leading to members of the public to lose trust in CCM and its government leadership under Kikwete.
    “The President’s directive has been compounded by CCM’s desperation to restore its tainted public image,” he said.
    A commentator to the Mwananchi newspaper’s website, who identified himself as one Dr More, criticised President Kikwete for politically interfering with the enforcement of the country’s laws.
    “There has never been any economic development that has been achieved without causing pain to some people. Every leader is supposed to fulfill his or her duties as per laws and regulations of the country.
    How come the President and his Prime Minister interfere with activities of a minister, who operates within the laws of the country,” he wondered.
    A lawyer based in Mwanza, Mr Salvatory Magafu, accused the President of mixing politics with laws, saying the 2007 Road Act number 13 clearly stated that there should not be any building or structure within a road reserve.
    “The Act has not left any room for any other consideration…I wonder where does the President find the mandate to prevent the law from taking its course,” he queried.
    Mr Magafu attributed the country’s failure to accomplish several projects to inconsiderate interference by politicians.
    He explained that the Road Act gave the Works minister the mandate to oversee all trunk and regional road projects.
    President Kikwete though is the minister’s boss, was not supposed to prevent Dr Magufuli from carrying out his responsibilities provided the latter adhered to the laws of the country, he stressed.

    Unajua tofauti kati ya KIKWETE na PINDA ukiwalinganisha na Magufuli ni hii,
    KIKWETE/PINDA hawa jamaa ni wanasiasa kabisaaa na wanasifa za kisiasa kama Unafiki, Uongo, Uzushi na KUjifanya wana busara kidoogo wakati wameshachemka. Lakini huyu MAGUFULI ni mtendaji wa kazi, Mtu anayefuata sheria na taratibu za kazi, Si muoga kuthubutu kufanya kitu ili mradi tu ni kwa maslahi ya Taifa hebu tazama ujenzi wa barabara ya Morogoro-Chalinze pamoja na Daraja la Mkapa kama si Magufuli hadi leo mambo yangekuwa bado au viwango visingezingatiwa kabisa. Magufuli si mnafiki na ni msema kweli, tazama jinsi alivyomnyang'anya kiwanja LITA MLAKI na kutoa taarifa Bungeni japo alikuwa Naibu wake.

    Mimi binafsi kwa sasa sina imani tena na huyu PINDA kwa kuwa ameyarudia matapishi yake mwenyewe na si mtetezi wa WATANZANIA walio wengi bali ni mtu anayejipendekeza kwa wakubwa zake kama JK wa sasa japo mimi nafahamu kuna JK mmoja tu ambaye nii Hayati kwa sasa kwa kuwa huyu alikuwa ni mtetezi wa WATANZANIA halisi na wala hakuwa mnafiki na muoga kama huyu wa sasa!.
