President Kibaki said the prime minister could not suspend ministers

Kenyan President Mwai Kibaki has revoked the prime minister's suspension of two government ministers linked to corruption allegations. The ministers of agriculture and education were suspended by Prime Minister Raila Odinga during fraud investigations into missing funds.

But hours later the suspensions were lifted as Mr Kibaki said Mr Odinga did not have the authority to suspend.

The two suspended ministers have denied any personal wrongdoing.

There had been growing calls for ministers to resign after millions of dollars of public money were siphoned off in an education and a maize scandal.

Corruption probes

Kenya's fractious coalition government has had its fair share of problems, but as it struggles to deal with corruption it seems to have hit an all-time low, and there is now confusion as to who is in charge.

First of all, Mr Odinga broke the mould by announcing the suspension of two ministers - a very rare move in Kenya.

He said two recent investigations into corruption laid credible foundations for the ministers to be investigated.

A recent audit into a maize scandal revealed that $26m (£16.5m) had been diverted whilst over $1m were stolen in an education scam.
But just hours after the suspensions were announced, President Kibaki annulled them.

He said he had not been consulted. President Kibaki also said the prime minister did not have the authority to take such action against a minister.

The prime minister's position was created as part of a peace deal to end post election violence, and whilst the accord says he should co-ordinate and supervise ministries it does not spell out whether he can suspend or sack the ministers.

It is - for now - not clear if the prime minister's effort to flex his muscles will succeed.

2012 elections
For now there is confusion and the future of the coalition government is being tested.

One of the ministers he is trying to suspend, William Ruto, is a former ally and now staunch foe of the prime minister.

The issue is also controversial because it comes at a time when Kenyan politicians are busy positioning themselves ahead of elections in 2012.

Most Kenyans will view this whole issue as another round of bickering between politicians getting in the way of the fight against corruption.
 
Pres. Kibaki's statement on PM suspension order

The basis of appointment, suspension and removal of a Minister under the Coalition Government as per the Constitution of the Republic of Kenya , the National Accord and Reconciliation Act and the Agreement on the Principles of Partnership of the Coalition government is full consultation and concurrence between the President and the Prime Minister.

There has been no consultation between H.E. the President and the Rt. Hon. Prime Minister on the suspension of Hon. William Ruto, Minister for Agriculture and Hon. Prof. Sam Ongeri, Minister for Education, as announced by the Rt. Hon. Prime Minister today at a Press Conference.

Furthermore, the legal provisions on which the Prime Minister acted, do NOT confer him the authority to cause a minister to vacate his or her office.

According to Section 16 (3)a of the Constitution, the Office of a Minister can only become vacant if the President so directs.

In addition,
Section 4 (5) of the National Accord and Reconciliation Act clearly states: "The removal of any minister nominated by a political party of the coalition shall be made only after prior consultation and concurrence in writing with the leader of the party."

Therefore constitutionally, the two ministers remain in office.

This position should not be interpreted in any way as undermining the ongoing war against corruption.

The war against corruption will be successfully fought when we do so in accordance with the constitution and the due process of law.

Is this East African Intergration feasible when Museveni is the life President in Uganda; Kenya does not want a prime Minister when we in Tanzania have a slot for a PM in our constitution? How are we going to harmonize all these differences and achieve a credible regional grouping?

wala hujakosea na mtazamo wako. Nd'o maana napinga sana hii kitu ya EAC based on these kinds of facts. Kibaki aliiba kura na sasa anadekeza wizi wa mali ya uma by proxy. Uingereza walisitisha kutoa hela kusaidia hii kampeni ya watoto kusoma bure only because hela iliiibiwa. Sasa Waziri mkuu kawaambia hawa mawziri wa-step aside mpaka uchunguzi ufanyike kisha Kibaki anakuja nyuma yake na kusema eti Raila hawezi kufanya hivyo na he was not consulted.That is a bunch of BS!

It is very obvious kwamba Rais Kibaki ndiye fisadi namba one Kenya na skendo zipo kibao zinazoashiria in that direction. Je Tanzania ipo tayari kwa huu muungano ikiwa hii ndio hali halisi?... I dont think so.

Kenya needs to clean up house big time before we move in any direction. Its a sad situation but thats what it is.

Rais kibaki kuwakumbatia kina Ruto kunaashiria mikakati ya uchaguzi mkuu unaokuja hasa tukitilia maanani siasa za Kenya zimejaa ukabila.
 
Mimi ni mpinzani namba 1 wa shirikisho la EAC. Hata hivyo, hakuna tofauti ya ufisadi wa Kenya na Tanzania, na inawezekana TZ inaipita Kenya kwa wizi na unyang'anyi. Hapa naweza kuwasifu kwamba ingawa wako kwenye dilemma, lakini wanajaribu kufanya kitu kuondoa tatizo. Siyo hapa mijadala yote inawekwa kapuni kama ilivyofanyika ya Richmond juzi, na mengine yanafichwa tena grand graft transactions za multimillion USDs kama helicopter za jeshi, radar, ndege ya rais, meremeta , TRL, TICTS, EPA, the list goes on. Mambo ya kuungana (God forbid) ni kuwapa advantage mafisadi wote wa Afrika Mashariki, kwa hiyo kila nchi itatue matatizo ya kifisadi yake separately, and we may borrow form each other's experience. Kuwa na mgawanyiko wa vyama Kenya inawasaidia, tofauti na hapa TZ ambapo CCM ndiyo the "invicible", that's weak. Their only problem ni kwamba vyama vyao vina basis ya ukabila, otherwise they r on the right track!
 
Succession politics, Kibaki is trying to win the support of the Kalenjin community by defending William Ruto, there will probably be a coalition between kibakis cronies and Ruto before the 2012 election. It should also be noted that william Ruto represents the Kalenjin communities, and he has the backing of the largest voting block in Kenya. On the other hand Raila plays populist politics, he tends to side with the common mwananchi, which is working well for him so far because alot of people support his views.

Kibaki is also trying to break O.D.M, the party that raila vied for the presidency with (supported by Ruto), considering that he didn't support Raila's suspension of Ruto. ODM has the largest number in parliament, so he will gain by causing division within the party considering that majority of the rift valley mps support William Ruto.

My take on this is that Kibaki is committing political suicide, the people who advice him are seriously tarnishing his name while making Raila popular. Kenyans will not vote for the person who will be endorsed by Kibaki.. Its so sad that the ruliing elite are not in touch with the reality on the ground, Kenyans want a leader who will fight graft, not someone who keeps protecting the looters of our coffers.

Ilipofikia hizi kura za juzi huyu bwana aliungana na Raila akijua kua Raila atashinda
urais na by extension atamtetea kuhifadhi mali ya wizi alokua amejilimbikiza
wakati wa Moi. Hata hivyo kama tujuavyo Kibaki aliiba kura na ndoto ya bwana
Ruto haikukamilika. Kwa hivyo katika mahesabu yake ameona kwamba ni bora
arudi kambi ya Kibaki ambaye yuko mamlkani na kwa kiwango f'lani atamtetea
katika kuhifadhi mali aliojilimbikizia.

Jambo lengine ambalo limemfanya kumpiga Raila vita ni kwamba katika viongozi
wote waliopo Kenya kwa sasa ni Raila pekee ambaye yuko 'safi' na anajua
hatomuunga mkono katika maswala kadhaa ambayo anataka kufanya. Cha mno
pia kujua ni kwamba baada ya zile kura za '07, kulikua na fujo katika maeneo ya
bonde la ufa na inasemekana wakikuyu wengi waliouliwa na kupoteza mashamba
walisadiki kua mkono wa Ruto ulikuwemo. Kwa sasa kuna kesi ambayo ipo kule
Hague (ICC) na proskyuta mkuu Bw Ocampo atakapo tia timu Kenya mwakani,
Bw. Ruto na Bw. Uhuru Kenyatta watakumbwa na mashtaka. Kwa hivyo anaamini kua
Kibaki will not hand them over for prosecution but Raila will do it without fear or
favor.Kwa hivyo kutetea maisha yake ameamini it is safe to join Kibaki's Camp.

Kuhusu uchaguzi wa Kenya wa 2012, Mheshimwa Raila yuko mbele ya hawa
wagombeaji wote lakini ukweli ni kwamba wataziiba tena ilimradi kutetea mali
ya wizi walionayo hawa watu. Siasa za Kenya baada ya kura za '07 naweza
kusema wazi zimepita ukabila bali kwa sasa watu wanapigana dhidi ya familia
tatu: Ya Kenyatta, ya Moi na ya Kibaki. Wakikuyu washachoka kutumiwa na hii
familia ya Kenyatta na wameamua they are going in a different direction from now
henceforth. Porojo za magazeti ndizo zinazotudanganya kua wakikuyu watampigia
mkikuyu mwenzao. Kem fikiria Kibaki alikua Rais na bado waliuliwa watu kibao na
kunyanganywa mashamba. Bado mpaka hii leo wamo katika kambi za wakimbizi
kila sehemu na hakuna mtetezi japo Rais ni mtu wao. Kimeeleweka kua familia ya
Kenyatta ina mashamba kibao kama mkoa mzima and it is very easy to settle hawa
marefujii wa kabila lao...swali linakuja mbona hawapati msaada??? Jibu: Ubinafsi
wa hizi familia umekua ukiwaziba macho siku nyingi na kwa sasa wameamua
tofauti.

Yaani jana wakati naangalia Citizen Tv ya Kenya... niliona huu mchezo kama movie fulani.

Swala la kujiuliza ni kuwa, President amesema katiba haikufuatwa kwa kuwa hakuwa Consulted. Lakini je, what about the act? Yaani anafurahishwa na ufisadi huu, au hawa jamaa ni mtaji wake wa kisiasa kwenye uchaguzi ujao? Pamoja na kwamba Kibaki amewasimamisha kazi maafisa wengine wanane, lakini hapa kuna walakini.

Kenya President Mwai Kibaki 'overstepped powers'

Kenyan Prime Minister Raila Odinga has accused the president of overstepping his powers, in an increasingly bitter row over corruption allegations.

Over the weekend, Mr Odinga suspended two ministers accused of embezzlement only for President Mwai Kibaki to reverse his decision.

Mr Odinga told the BBC that Mr Kibaki did not have the power to overrule him.
The BBC's Will Ross in Nairobi says many Kenyans have been left wondering who is in charge of the country.

He says people fear that the wrangling will end any hope of winning the fight against corruption, and many Kenyans have lost faith in all politicians.

Mr Kibaki and Mr Odinga - bitter political rivals - joined together in a unity government to end violence that swept the nation after the 2007 election.

But now, both men have accused each other of overstepping their constitutional remit.

"The legal provisions on which the prime minister acted, do not confer him the authority to cause a minister to vacate his or her office," the president's office said in a statement.

But Mr Odinga told the BBC's Network Africa programme he had not sacked the ministers, he had merely suspended them - which he was entitled to do.

"I think that what I've done actually has been within my constitutional powers, and that the president does not have the powers to countermand what I have done," he said.

The two ministers at the centre of the spat - Agriculture Minister William Ruto and Education Minister Samuel Ongeri - both turned up for work on Monday and say only the president has the power to discipline them.

A recent audit into a maize scandal revealed that $26m (£16.5m) had gone missing.

And more than $1m was stolen in an education scam.

Mr Odinga said there was enough evidence implicating the two ministers for an investigation, so they should be suspended.

Serikali ya kenya ni kama ngoma iliyo tengenezewa kwa ngozi ya kenge au mamba. Ikipigwa utasikia mlio hata ukiwa mbali. Nenda ukaone kinachoendelea, inakuwa ngoma ya watoto, hata haikeshi!. They are very and more than being disorganised!
