THE Prevention and Combating of Corruption Bureau (PCCB) will have to disclose the name of the person who complained to them against former ambassador to Italy Costa Mahalu and Counselor Grace Martin for allegedly having embezzled over 2bn/-, property of the United Republic of Tanzania.
That follows the ruling by Principal Resident Magistrate Sivangilwa Mwangesi of the Kisutu Resident Magistrates Court in Dar es Salaam ordering PCCB to give the complainants statement to the defence counsel.
The magistrate ruled further that PCCB should comply with his order by tomorrow, failure to which legal action would follow as requested by the defence lawyers.
Defence counsel had earlier asked for the court to dismiss the case as there was no constructive complainant. Mwangesi ruled it was mandatory for the prosecution to avail the statement to the defence to enable them know the nature of the case against their clients.
There shall not be a fair trial unless the accused is fully informed by giving him the statement of the complainant, he ruled. He, however, ruled that there was no law that forces the prosecution to state the number of witnesses.
The magistrate further ordered PCCB to stop forthwith from harassing the accused by summoning them to their offices as and when they pleased, as was done recently when the duo was allegedly required to account for their properties.
Intervention of the prosecution in a matter already filed in court is to harass the accused. This should not be seen unless the situation is different where the accused commits another offence while on trial, the magistrate ruled.
On October 5, this year, defence counsel requested the court to prohibit the prosecution from summoning their clients to PCCB's head office for further interrogation without seeking permission of the court.
The prosecution had resisted to disclose any of the intended witnesses for safety reasons. It also resisted supplying the statement of the complainant, saying there was no one who complained to them about alleged commission of the crime.
Preliminary hearing of the case will proceed next Monday when the prosecution is expected to disclose the nature and particulars of the offence allegedly committed by Prof Mahalu and Martin.
In the case, Prof. Mahalu and Martin are charged with conspiring with other people in Italy, Tanzania and other places in the world to stealing from the Tanzanian government 2,065, 827/60 Euros.

MAHAKAMA ya Hakimu Mkazi Kisutu imetupilia mbali maombi ya upande wa utetezi ya kutaka kuifuta kesi inayomkabili aliyekuwa Balozi wa Tanzania nchini Italia, Profesa Costa Mahalu na Mtawala Grace Martin. Pia imeionya Taasisi ya Kuzuia na Kupambana na Rushwa (Takukuru) kutowabughudhi watuhumiwa.
Hakimu Mwandamizi Mfawidhi, Sivangilwa Mwangesi alitoa onyo hilo jana baada ya upande wa mashitaka kuilalamikia Takukuru kwa kuwahoji watuhumiwa kuhusu mali wanazomiliki, kitendo ambacho ni kinyume cha sheria.
Upande huo pia ulilalamikia hati ya maelezo ya awali, kwamba haikuwa imeandikwa mlalamikaji ni nani katika kesi hiyo, pia hakukuwa na orodha ya mashahidi wa upande wa mashitaka katika kesi hiyo. Hata hivyo, Hakimu Mwangesi alisema hakuna sheria inayoulazimisha upande wa mashitaka kutaja idadi ya mashahidi au idadi ya vielelezo kama ilivyolalamikiwa na upande huo, ingawa unaweza kufanya hivyo.
Hakimu aliutaka upande wa mashitaka kutoa maelezo ya awali ya mlalamikaji kwa washitakiwa kesho, kuwezesha mshitakiwa kujua vizuri kesi inayowakabili. Alisema kesi itakuwa haikuendeshwa kwa haki ikiwa mshitakiwa hatakuwa na maelezo ya kutosha kuhusu kesi yake.
Upande wa mashitaka kutoka Takukuru ukiongozwa na mawakili Joseph Holle, Tabu Mzee na Benny Lincoln, awali ulidai haujatoa maelezo hayo ya awali kwa kuwa hata wao hawana. Katika shitaka la kwanza, Balozi Mahalu na mwenzake, wanatuhumiwa kula njama za kutenda wizi katika tarehe na maeneo tofauti huko Italia, wakiwa watumishi wa serikali.
Shitaka la pili ni kuwa watuhumiwa, Septemba 23, 2002, kwa nia ya kudanganya mwajiri wao ambaye ni serikali, walitengeneza hati ya matumizi ya malipo ya Euro 3,098,741 kwa ajili ya ununuzi wa jengo la Ubalozi wa Tanzania huko Rome, Italia. Katika shitaka jingine ilidaiwa Oktoba mosi, 2002, watuhumiwa walitumia mkataba wa uongo uliokuwa na maelezo ya bei ya mauzo ya jengo hilo la Ubalozi yaliyoonyesha matumizi ya kiasi hicho cha fedha.
Vile vile, ilidaiwa Oktoba mosi mwaka huo huo, watuhumiwa walituma stakabadhi za uongo kwa muuzaji wa jengo la ubalozi huo kuonyesha malipo ya ununuzi. Katika shitaka jingine, watuhumiwa walidaiwa kutenda wizi wakiwa watumishi wa serikali kwa kuiba fedha hizo. Shitaka la sita, Balozi Mahalu na mwenzake wanatuhumiwa katika kipindi hicho hicho, waliiba fedha za umma na kuisababishia serikali hasara ya Euro 2,065,827.
