    MTOTO wa Mbunge wa Ubungo, Bi Eliaisa Keenja, aliyefutiwa dhamana juzi saa sita mchana na Mahakama ya Hakimu Mkazi Kisutu, amepata dhamana katika kipindi cha saa mbili, baada ya Mahakama Kuu ya Tanzania kutoa amri ya kufanya hivyo.

    Tukio hilo lilitokea juzi mbele ya Hakimu Mkazi, Bibi Bernadetha Beda baada ya mshitakiwa huyo kukiuka masharti ya dhamana na kumfutia dhamana aliyokuwa nayo.

    Hakimu Beda alitoa uamuzi wa kumfutia dhamana mshitakiwa huyo kutokana na kosa alilofanya la kutoonekana mahakamani wakati kesi hiyo ikitajwa.

    Baada ya kufutwa kwa dhamana na mshitakiwa kuwekwa mahabusu, baba yake, Bw. Charles Keenja, alikwenda kwa Hakimu Mfawidhi wa Mahakama hiyo, Bw. Sivangilwa Mwangesi na kumwomba kupitia upya uamuzi uliotolewa kwa madai kuwa mwanawe alikuwa amefiwa na mumewe.

    Kwa mujibu wa Bw. Mwangesi, baada ya kuombwa kufanya hivyo, alikataa na kumtaka kwenda Mahakama Kuu kuwasilisha ombi hilo ili Mahakama hiyo iweze kutoa maelekezo zaidi.

    Bw. Mwangesi alisema Bw. Keenja na wakili wa mshitakiwa, walikwenda Mahakama Kuu na kumwona Jaji Mfawidhi Semistokos Simon ambaye alitoa maelekezo kwa Mahakama ya Kisutu kupitia upya uamuzi wake na kumpa dhamana mshitakiwa.

    "Kitu walichokuwa wanaeleza ni kuwa mshitakiwa amefiwa na mumewe na kutofika mahakamani alikuwa ameomba ingawa hakukuwa na taratibu nzuri za kuijulisha Mahakama, hivyo ndiyo sababu kubwa walizokuwa nazo," alisema Bw. Mwangesi.

    Kutokana na amri hiyo, Hakimu Beda alilazimika kupitia tena uamuzi wake na kumtaka mshitakiwa kuwa na wadhamini wawili ambao watasaini dhamana ya sh. milioni 20 na kuwasilisha hati zake za kusafiria mahakamani hapo, ambapo alikamilisha masharti hayo na kuwa nje kwa dhamana.

    Baada ya kumaliza hilo, Hakimu huyo alijitoa katika kesi hiyo na kuirudisha kwa Bw. Mwangesi kwa ajili ya kumpangia hakimu mwingine, ili aendelee kuisikiliza.


    Mshitakiwa huyo awali aliandika barua akiiomba Mahakama kumruhusu kwenda nje ya nchi kwa ajili ya matibabu Septemba mwaka jana kwa muda wa miezi mitatu, lakini aliondoka kabla ya mahakama kutoa kibali hicho.

    Kesi hiyo ina washitakiwa watatu ambao kwa pamoja wanadaiwa katika muda ambao haukujulikana wakiwa Dar es Salaam, kula njama ya kutenda makosa ya wizi wa vitu mbalimbali mali ya Raia wa China, Bibi Li Jinglan vyenye thamani ya sh. 333,300,000.

    Walidaiwa kuwa Mei 9 mwaka jana Kinondoni, waliingia kwenye nyumba ya Shirika la Nyumba la Taifa (NHC) ambayo mpangaji wake ni Bibi Jinglan wakiwa na nia ya kuiba.

    Washitakiwa hao walidaiwa kuwa baada ya kuingia, waliiba mabandari 74 ya nguo, kompyuta, dola za Marekani, hereni za dhahabu, kamera na vitu mbalimbali ambavyo ni mali ya mpangaji huyo. Kesi itatajwa Aprili 8 mwaka huu.

    Mwanamtama umenichanganya hapo kidogo. Majira wanasema aliwekwa mahabusu na baadae aliwasilisha hati zake za kusafiria....Je, inawezekanaje huyu akawa nje ya nchi kama unavyodai wakati aliwekwa mahabusu Bongo na hati ya kusafiria inashikiliwa kwa sasa?

    Mnyonywaji, kifupi huyo dada yupo Holland anakula maisha, tokea mwaka jana mwezi wa tisa na baba yake Mzee Keenja ndiye aliyefanikisha hilo zoezi. Kusema amefiwa na mumewe ni kamba tu.

    Mbarikiwa huyu dada kwa taarifa yako hasomi wala nini anakula raha na kuwasiliana na wakili wake kesi inaenda vipi

    We mwana, usidanganye watu huelewi unachoandika. Huyo binti alikuwa masomoni Netherlands tangu mwaka jana mwezi wa tisa(that is true). Alirejea nchini mwezi huu baada ya kufiwa na mume wake just last week. Kwa hiyo suala la kufiwa na mume wake ni la kweli. Suala kwamba hasomi ni uongo pia. Labda kwa vile passport yake sasa imeshikiriwa na mahakama, hatoweza tena kurudi Netherlands kuendelea na masomo. Cha muhimu ambacho ungehoji ni kwamba ni kwanini alienda Kusoma huku akijua anakabiliwa na kesi mahakamani.

    Mwanamtama: Huyo Dada ni kweli yupo Bongo na ni kweli amefiwa na Mume wake (May his Soul rest in Peace), pia ni kweli kwamba alikuwa nje ya nchi na amerudi kwasababu ya msiba wa mume wake.....na hapo ndio walipompiga pini vyombo ya dola vikiongozwa na mahakama.

    In controversial circumstances a magistrate yesterday withdrew from a case facing the daughter of the Ubungo MP, Mr Charles Keenja.

    The magistrate, Ms Bernadetta Beda, confirmed her withdrawal but declined to state reasons for her action when approached by reporters.

    However, the withdrawal comes just a day after she had cancelled a bail for Eliesha and ordered her remanded in prison for failing to attend her case several times.

    On Tuesday the magistrate ordered the MP?s daughter sent to remand prison for violating bail conditions.
    But Eliesha, an estate officer with the National Housing Corporation (NHC), was not sent to remand prison and was later the same day released just a few hours after cancellation of her bail.

    An impeccable source at the Kisutu resident magistrate?s court in Dar es Salaam said magistrate Beda was asked by a senior judicial official at the high court to review her decision to cancel the bail.

    ?She obliged and lifted the ban on the bail but immediately withdrew from presiding over the case for the interest of justice,? said the source that requested for anonymity.

    Asked about the truth of the reports yesterday, Ms Beda could only confirm her withdrawal, but referred all other queries to the magistrate-in-charge, Mr Sivangilwa Mwangesi.

    ?You throw me questions which I am not in a position to answer. The magistrate in charge is the proper person to comment on the matter at this time,? she said.

    A public prosecutor at the Kisutu court who opted for anonymity told The Citizen that it was uncommon for a magistrate to issue such an order and nullify it within a few hours.

    Procedurally, he explained, when a magistrate issues an order it automatically becomes an order of the court, adding that no one could nullify it unless the accused files an application for review of the order at the high court.

    The Kisutu Resident Magistrate-in-charge, Mr Sivangilwa Mwangesi, confirmed that the advocate for Eliesha and her father, Mr Keenja, had been to his office yesterday asking for a review of the order.

    ?I told them I had no authority over the order already on record and directed them to go to the high court for further pursuance of the matter,? said Mr Mwangesi.

    Reports say that Mr Keenja and the advocate for the accused, Mr Edward Chuwa, immediately rushed to the judge-in-charge at the high court, Mr Semistokres Kaijage, pleading for a review of the order. Mr Keenja claimed that her daughter had lost her husband just a week ago.

    It is said that the high court agreed with Mr Keenja, leaving two alternatives: the high court to recall the case file for review of the order or the review be made by the magistrate who issued the order.

    Magistrate Beda on the same day nullified her earlier order and ordered the accused to surrender her travelling documents, including her passport.

    Efforts yesterday to contact the MP for comment and verification of his version of the story were futile as his phone was constantly engaged.

    Eliesha and two others were arraigned in December, 2006 allegedly for breaking into the house of a Chinese national, Li Junglan and stealing property worth Sh333 million.

    Upon their first court appearance, Eliesha and her co-accused were released on bail on condition that they appear in court whenever the case proceeds.

    In September last year Eliesha had asked the court to allow her travel outside Tanzania for treatment but it rejected the request.

    Eliesha failed to appear in court since last December. This made the prosecution raise concern.
    Advocate Chuwa promised to submit before the court exhibits to show that his client was sick, but failed to do so. Yesterday when the case came up for mention the advocate told the court that his client was abroad for studies.

    The confusing statements from the advocate made the court believe that she had refused to attend court sessions and thus withdrew her bail.

    Charged along with Mr Keenja?s daughter are businessman Josephat Lema and the manager of National Housing Corporation-Tabora, Damas Ngoiya.

    The case will come up for another mention on April 8.

    Nakuhakishia kwa 100% kwamba alikuwa masomoni kwenye MSc. program, yawezekana alidanganya hilo la kwenda kutibiwa ili apate nafasi ya kusafiri nje ya nchi. Lakini, kwamba alikuwa masomoni, hilo halina ubishi. Kama bado huamini, endelea na kutokuamini, sina jinsi ya kukusaidia hapo.

    Bw. Mwangesi alisema Bw. Keenja na wakili wa mshitakiwa, walikwenda Mahakama Kuu na kumwona Jaji Mfawidhi Semistokos Simon ambaye alitoa maelekezo kwa Mahakama ya Kisutu kupitia upya uamuzi wake na kumpa dhamana mshitakiwa.

    "Kitu walichokuwa wanaeleza ni kuwa mshitakiwa amefiwa na mumewe na kutofika mahakamani alikuwa ameomba ingawa hakukuwa na taratibu nzuri za kuijulisha Mahakama, hivyo ndiyo sababu kubwa walizokuwa nazo," alisema Bw. Mwangesi.

    Kutokana na amri hiyo, Hakimu Beda alilazimika kupitia tena uamuzi wake na kumtaka mshitakiwa kuwa na wadhamini wawili ambao watasaini dhamana ya sh. milioni 20 na kuwasilisha hati zake za kusafiria mahakamani hapo, ambapo alikamilisha masharti hayo na kuwa nje kwa dhamana.

    Baada ya kumaliza hilo, Hakimu huyo alijitoa katika kesi hiyo na kuirudisha kwa Bw. Mwangesi kwa ajili ya kumpangia hakimu mwingine, ili aendelee kuisikiliza.

    Kwanini watu mnapoona mtu yupo kwenye matatizo ni kama mnafurahia. Hata ningekuwa mimi ni Keenja ningefanya hilo. Hapa bongo kesi nyingi pia ni fweki.

    Jamani kuna yule mkurugenzi wa Tanesco aliomba kujiuzulu kwa kutotendewa haki na Karamagi issue iliyoanzia kule kiwanda cha Cement TA,na baadae kuombwa na JK aendelee na kazi,Hakimu mwenzangu kwa nini usiige mfano huo.Hivi kweli kazi itafanyika tena kama zamani labda kama hauna nyongo lakini ingekua mimi moto ungewaka.

    Huyu jaji hajui maadili ya kisheria,ndio hawa majaji wanaookotwa njiani.

    Nionavyo mimi, ni vyema kuwa na taarifa zilizo sahihi na kuziwakilisha badala ya kila kitu kufikiria mchezo mchafu. Sioni kama mpaka sasa kuna harufu mbaya. Kama tumesoma vyema wapasha habari wetu, huyu binti alitolewa baada ya hukumu ya kumfutia dhamana kurudiwa kwa maagizo ya mahakama kuu. Na hii ilifanyika kutokana na ombi la wakili wa huyu binti. Naona hapa mahakama ili fanya kazi kwa ari mpya, kasi mpya, na nguvu mpya. Tunastahili kuipa mahakama BIG UP kwa kuhakikisha wamempatia haki ya dhamana huyu binti ambayo ni haki yake ya msingi. Ingekeuwa mahakama kuu ili futa kesi, basi tuna haki ya kusema tunayosema. Hivyo tuachie mahakama iendelee na kesi na ukweli utaonekana.
