    Je ni haki kwa mfanyakazi yoyote kufanya kazi kama kibarua kwa zaidi ya miezi 12?
    Je ni haki kwa mfanyakazi huyo huyo kufutiwa mkataba bila kupewa sababu?
    Je ni haki kwa mfanyakazi kuendelea kufanya kazi bila mkataba kwa wiki moja nzima baada ya mkataba wake kuisha.

    Naomba msaaba wa majibu haya wana JF wenzangu mliobobea katika tasnia hii ya sheria kampuni ya kigeni inatunyanyasa sana ndani ya nchi yetu.

    Kwanza moja na mbili zinakinzana. Kama una mkataba then wewe si kibarua bali ni mfanyakazi wa mkataba. Hebu tufahamishe zidi swali laki la kwanza na la pili ili tuwe clear.

    Assuming kuwa una mkataba then si haki kufanya kazi kama mkataba umeisha. Now inategemea. kama unataka kuacha kazi hulazimishwi kufanya. Kama unataka kazi basi constructively kama unaendelea na kazi it is assumed umeignia mkataba mpya on the same terms and conditions kama mkataba umeisha.

    Assuming unataka kuboresha maslahi unashauriwa kujadili mkataba mpya.

    otherwise kwa maelezo yako hafifu hapo kampuni ya kigeni haina kosa wala haijakudhalilisha. Without mincing words wewe ndo unajidhalilisha kwa kutosimamia haki zako.

    1. Si haki,kwani sheria inaelekeza kuwa mtumishi akishafanya kazi kwa miezi sita au zaidi kama kibarua basi sheria inamtambua kama mwajiriwa na si kibarua,

    2.sio tu si haki mtumishi kufutiwa mkataba bila kupewa sababu,bali hakuna sababu yoyote ya kumfutia mfanyakazi mkataba isipokuwa mkataba wake umekwisha au amevunja vifungu vya sheria ya ajira na mahusiano kazini au masharti ya mkataba wa ajira husika,hivho no kosa kwa mwajiri kuvunja mkataba na mwajiriwa anaweza kulipwa stahiki na fidia kama atapeleka shauri lake kwenye mabaraza ya usuluhishi na uamuzi.

    3.inategemea,kwani mkataba una masharti halisi yaani express terms na mashariti butu yaani implied terms,hivyo kama mkataba unaeleza wazi kuwa baada ya kufika mwisho,pande zote zitakubaliana kama uendelee au la, kama mtumishi ataendelea bila kusaini mkataba mwingine basi assumption ni kwamba masharti yaleyale ya mkataba wa awali yanazingatiwa.

    Wakati mwingine elezea vizuri tatizo lako ili upate ushauri mzuri..

    Kwa kuongezea tu;
    Kwa sheria ya sasa ya kazi hakuna ajira inayoitwa kibarua; kibarua ilikuwa sheria ya zamani,
    Sheria sasa hivi inatambua ajira za aina tatu nazo no
    1. Permanent contract
    2. Contract for specified period, eg. miezi mitatu, one year etc
    3. Contract for specified task, mfano kujenga darasa na likiisha kazi inakuwa imeisha

    Hivyo kwa sheria mpya za kazi maneno ya kibarua hakuna
