The search for a successor to the Prosecutor of the International Criminal Court, Mr. Luis Moreno-Ocampo, whose term will expire in June 2012, is underway. The Search Committee, which operates from New York and is mandated to facilitate the nomination and election, by consensus, of the next Prosecutor, held its first meeting. Over the next few months, the Committee will informally receive expressions of interest from individuals, States, regional and international organizations, civil society, professional associations and other sources. The Search Committee will also actively identify and informally approach individuals who may satisfy the applicable criteria, in particular those contained in article 42 of the Rome Statute. The Search Committee will review the expressions of interest and produce a shortlist of at least three suitable candidates, where possible for consideration by the Bureau of the Assembly of States Parties. The next Prosecutor will be elected by the tenth session of the Assembly of States Parties to the Rome Statute of the International Criminal Court.

The Committee is composed of five members, one from each regional group, namely:

Founder and main shareholder of an international company who use market forces to increase transparency and

Prosecutor experience:
1980-1984: Clerk in the office of the Solicitor General, Argentina.
1984-1985: Assistant prosecutor in the trials against the military junta that ruled the country during the dictatorship; led
the prosecutorial team which analyzed more than 10,000 alleged human rights abuses, selected 700 cases, and presented
2,000 witnesses; managed to establish how the commanders approved and executed a meticulous plan to kidnap, torture
and eventually ʺdisappearʺ those they mistrusted; shared in Witness examination and cross-examination.
1986: Assistant prosecutor in the trials against General Ramon Camps, the chief of the Buenos Aires Police Force and 8
police officers involved in murders, kidnapping and tortures; led the investigations and the evidence gathering and

Most of Tanzanians do not have a culture of appreciating what their fellow countrymen perform. Mr. Chande is an eminent lawyer and has been featured in different positions at an international level yet folks keep on misprizing his reputation. We should change our attitude and start to be proud of our own excellent figures.

Kwa ujumla Marekani inacheza mchezo mchafu sana kuhusu ICC huku dunia inatazama tu bila kufanya lolote. Marekani iko tayari kushabikia kuona watu wa nchi nyingine kukamatwa na kufikishwa mbele ya ICC na siyo Wamarekani.

Tuchukulie theory kwamba hiyo board ya "ma-recruiter" katika kutafuta ma-candidate waliona CV, history etc ya Chande wakavutiwa nayo. I am very sure walimtaarifu kabla ya mchakato kuanza. Kama tukichukulia mtizamo wako John, then tunajua alikuwa na-choice ya kukubali au kukataa kabla hajawa short listed. Ikiwa TZ in watu mahiri kama bwana othman ambaye amebobea ktk sheria, sasa kwanini mikataba ya serikali inakuwa hovyo?? just to mention few of them, Richmond, buzwagi, Dowans and etc !!!!!!!!

Isuto, kwa mtizamo wangu ni kwamba Tanzania tuna wasomi waliobobea lakini "system" yetu haiwatumii inavyotakiwa(inawabana) wasi-perform at their best capacity. Hili ni wazi kwenye mahakama zetu, tunazungumzia uhuru wa mahakama lakini ukweli ni kwamba haupo. Behind the curtain serikali ina influence mahakama kwenye mambo fulani fulani. Mtu anakuteua kwenye nafasi fulani kama "ceremonial leader" behind the curtain he demands favor on some issues. At the end of the day, wewe msomi uliyeteuliwa unaonekana kituko. I suspect the same is happening to Ndulu, he has the post, but his hands are tied up. He can hardly perform at his best of his abilities in a such chaotic politically influenced environment. And guess who is getting the blame....

Joka Kuu, nitakujibu jinsi nionavyo mimi. Kwa experience Judge Ramadhani is waay far above Judge Chande. Chande anauzoefu kwenye kuendesha mashtaka kama ulivyosema tofauti na Judge Ramadhani amebobea kwenye Ujaji. Lakini pia wanatofauti sana kwenye uongozi (leadership style). Wengi ndani ya mahakama wanampenda Judge Chande kwasababu hana/ha-intertain majungu. Leadership style yake ni yakuunganisha na sio ya makundi. Judge Ramadhani ni kiongozi aliyeruhusu makundi/majungu, majigambo, na anaubabe fulani hivi (i guess hii inakuwa influenced na experience yake kama mwanajeshi. Judge Ramadhani was not a good communicator- alipenda alichosema ndio hicho (not very open to discussion). Mfano; kwenye ile ishu yaku-toa/bomoa jengo la mahakama kwaajili ya mwekezaji, majaji walionyesha kutofautiana naye lakini hakuruhusu debate. Alisema raisi amesema na ndivyo itakavyokuwa. Kutokana na style hii ya Judge Ramadhani watu ndani ya mahakama walikuwa na makundi and so never liked the guy that much. Mtu akimueleza kitu kuhusu jaji mwingine, atakuja kukisema mbele ya wote kwa mafumbo badala yakuzungumza faragha etc. Lakini Judge Chande ni msikivu (nionavyo so far), hapendi majungu/makundi lakini this is not enough to make him competent kwenye position aliyopewa. The reality is; he is a good prosecutor not sure if he can transform to become a competent Chief justice. Amepewa majukumu tofauti kabisa na aliyokuwa anafanya mwanzo, si hilo tu na mazingira nayo ni tofauti sana; with all the respect; mimi naona kwasasa anajifunza majukumu yake mapya, then akiyamudu ndio ataweza ku-perform. Tofauti na zamani Chief Justice alikuwa anateuliwaga mtu aliye-wiva tayari.

Ili kuitendea haki post yangu pamoja na wasomaji na wachangiaji ningeomba uipitie vizuri post niliyokuwa naichangia. Hamna sehemu hata moja ninaposema mheshimiwa Jaji Chande anachukiwa au kupendwa wala sehemu yoyote niliyotoa hoja inayofanana fanana na ya kisiasa. Mchangiaji aliyepita alikuwa anajaribu kujenga hoja kwamba mh Chande ni chanzo cha anachokiona kushindwa kwa Mahakama kufanya vizuri na yeye akiwa jaji mkuu. Nilichofanya kwa faida yake na wasomaji ni kumjulisha umri wa Jaji Chande katika nafasi ya ujajai mkuu na ujaji kwa ujumla. Lengo langu ilikuwa ni kuondoa dhana kwamba yeye, kama Jaji Mkuu na chanzo cha mapungufu katika Mahakama. Kwa upande mwingine nilidhihirisha histroria ya Jaji katika fani ya sheria kwa kuainisha kwamba sehemu yake kubwa katika maisha ya sheria ameiitumia katika taasisi za kimataifa. Nikahitimisha katika nukta hiyo kwamba maisha yake hayo ndiyo yalimfanya aonekane mbele ya wenzake walipo katika anga za sheria ya kimataifa kwamba ni mmoja kati ya wenye sifa ya nafasi hiyo. Sioni siasa katika hili labda unisaidie.

Pia hamna sehemu niliyojenga dhana ya kukubali bila kuhoji wala nilipokebehi hoja za wachangiaji wenzangu. Nilichofanya ni kutumia uhuru na haki yangu na mimi kujiingiza katika mjadala huu na kutoa maoni ninayodhani na kuamini kama ni sahihi. Wala sikusema mahali popote kwamba maoni yangu ni bora kuliko ya wasemaji wenzangu hilo nimeliacha kwa kila mtu kuamua kwa kadilili ya ufahamu wake.
 
Samhani nimepitia tena upya post yangu na kuona kwamba iliashiria kama anachukiwa. Kwa hilo nadhani sikuwa sahihi kusema hivyo conclusively. Na regret for that na nakushukuru kwa kuniweka sawa
