High Court directs CCM, govt to argue on petition

The High Court yesterday directed the government and the ruling Chama Cha Mapinduzi (CCM) to argue by way of written submission the reasons why they want the court to dismiss a petition seeking to bar President Jakaya Kikwete from contesting October General Election.
The order was given by Justice Augustine Shangwa after a dramatic exchange between the petitioner and the judge who spent most of time to inquiry the exact motive behind the petition.
Mr Mhozy, 59, a former tutor at the Dar es Salaam Teacher's College filed a petition last month, asking the High Court to order the National Electoral Commission (NEC) to remove President Kikwete's name from the list of contesters for Presidency for, among other reasons, violating constitutional rights of Tanzanians and abuse of office.
Mr Mhozya is accusing President Kikwete, who is widely tipped to win the October General Election, of being "intolerably extravagant with Treasury coffers during his tenure of office".
"He use them (Treasury coffers) for show of power, flamboyance, unlimited personal voyaging and personal enjoyment," he alleged.
But the Attorney General and Trustees of the ruling Chama Cha Mapinduzi (CCM) who are respondents in the petition have asked the court to dismiss the petition for not worth serious consideration and for provoking unnecessary anxiety.
"The president of the united Republic of Tanzania, Honorable Jakaya Mrisho Kikwete has prudently and properly been executing duties conferred on him by the constitution of the United Republic of Tanzania," argues the AG in a reply to the petition.
The AG has also asked the court to throw out the petition for not being justiciable but only seeking to want to disrupt the election process.
Yesterday Justice Shangwa ordered the respondents to file their written submissions by September 6 and a reply by Mr Mhozya on 13th September before the case come for mention on 21 September.
