    Ndugu zangu mimi ni mtazania wa kawaida na najaribu kupambana na ugumu wa maisha ya hapa bongo ambapo pengo kati ya maskini na tajiri linazidi kuongezeka siku hadi siku. Nilisikia habari ya kusajili ardhi na manufaa yake kwamba naweza kuitumia hati miliki kama dhamana ya kupata mkopo hivyo kujiimarisha kiuchumi na nilifanikiwa kusajili ardhi yangu na kupata Hati Miliki ya Kijiji. SWALI: Hati miliki za vijiji ni kweli zinapokelewa na mabenki kama dhamana ya mikopo? Na kama hazipokelewi ni kwa nini? Nitashukuru kwa msaada wenu.

    Watu wa benki wanasita kupokea hizo hati kwa kuwa sheria yenyewe inatoa upendeleo wa kuipa nguvu ile hati kubwa (granted right of occupancy) endapo utata utazuka kati ya sheria inayohusu hati ya kijiji na ile inayotelewa na kamishna wa ardhi. Hapa bado kuna mengi ya kufanya kuhusu suala la ardhi na sheria zake

    Asante mkuu,
    Kwani wabunge hawajui kuwa sisi wanyonge tunahitaji sheria inayolinda ardhi yetu? Mbona sera ya ardhi inataka customary right itambulike na iwe na nguvu sawa na hiyo inayoitwa granted right?

    Mkuu kwa Tanzania mambo mengi yanakwamishwa na viongozi wetu. Angalia mfano wa Mabwepande ambako serikali imewagawia waathirika wa mafuriko. Kule kulikuwa na watu walioendeleza ardhi ile kwa muda mrefu na nyumba zao zimebomolewa bila kuwapa fidia. Sasa ndio maana hata mabenki yanaogopa sana hizi customary right of occupancy kwani haijapewa nguvu ya kutosha. Nadhani kuna haja ya kukipinga kifungu hichi ambacho ni discriminatory na kinazuia maendelea ya mjasiriamali.

    in short ni kwamba hati za kimila bado hazijapewa nguvu ya uhakika,infact te law is not certain.hata wewe ungekuwa ni mtu wa bank usingeweza kuadvance loan kwa security isiyokuwa na uhakika.in order for any person to be given a loan he/she must have a good security without any uncertainities.the law of mortgage itakusaidia sana lakini pia soma baking law yangwilimi+binamungu itakusaidia.hiyo kitu haihitaji research bali ni kurekebisha tu sheria ili itoe vikwazo kama hivyo.
