THE long-serving Permanent Secretary in the Ministry of Finance and Economic Affairs, Gray Mgonja, is in line to be joined in the ongoing trial against former government ministers Basil Mramba and Daniel Yona over a dubious gold auditing contract with Alex Stewart (Assayers) Government Business Corporation, it has been revealed.

Prosecutors are expected to make amendments to the charge sheet in criminal case number 1200 of 2008 against the two ex-ministers at the Kisutu Resident Magistrate’s Court in Dar es Salaam by adding Mgonja’s name to the list of accused persons, informed sources told THISDAY.

Mgonja, who is currently on leave pending official retirement from government duty, has served as the senior permanent secretary in the finance ministry for the past six years.

Between 1996 and 2002, he served as deputy permanent secretary in the same ministry.

According to officials familiar with the 11.7bn/- abuse of office case against Mramba and Yona, Mgonja has been linked to similar allegations facing the two ex-ministers, but his prosecution was deliberately delayed due to the ’highly sensitive’ nature of his erstwhile position as Treasury PS.

Mgonja has been the main link man between the government and development partners and responsible for signing important financial aid documents with donors.

In a reshuffle of PSs announced over the weekend, President Jakaya Kikwete named Ramadhan Khijjah, the erstwhile deputy PS at the finance ministry, as Mgonja’s successor.

’’The fact that Mgonja is now no longer the PS of the finance ministry has paved the way for prosecutors to file charges against him,’’ said a source close to government law enforcement agencies.

’’Mgonja could well be the next big name to land at the Kisutu court to face criminal charges over alleged improprieties committed while he was a senior government official,’’ the source added.

Mgonja has been in the media limelight in recent years over a number of allegations concerning wrongdoings at the finance ministry.

At the time that Mramba and Yona are alleged to have authorized tax exemptions and a controversial extension to a contract between Alex Stewart Assayers and the government, Mgonja was the permanent secretary in the finance ministry.

According to prosecutors, Mramba and Yona allegedly abused public office and caused a loss of 11,752,350,148/- to the nation in lost income tax as a result of a controversial tax exemption granted to the gold auditing company.

Defence lawyers will today try to secure the release of the two ex-ministers on bail after the High Court on Friday ruled in favour of their application for a relaxation of bail conditions set by the Kisutu Resident Magistrate’s Court.

Officials in close contact with law enforcement agencies say the expected release of Mramba and Yona could coincide with Mgonja being joined in the same criminal case to face similar charges.

Investigations by THISDAY have also linked Mgonja and several other prominent government personalities with a controversial company, TANGOLD Limited, which was initially registered as an offshore firm in Mauritius in April 2005.

In February 2006, the company was registered in Tanzania, with its local shareholders listed as former Bank of Tanzania (BoT) governor Daudi Ballali (now deceased), former infrastructure development minister Andrew Chenge, and Mgonja.

Other TANGOLD shareholders were named as the former PS in the Ministry of Water and Irrigation, Patrick Rutabanzibwa, and the retired permanent secretary in the Prime Minister’s Office, Vincent Mrisho.

The mysterious company, which received millions of US dollars from the BoT, is not listed at the Treasury registry among companies partly or wholly-owned by the government, although the Ministry of Energy and Minerals has claimed that TANGOLD is 100% owned by the government.

The Prevention and Combating of Corruption Bureau (PCCB) is understood to be investigating TANGOLD and the associated Meremeta company (now defunct).

Kweli tunahitaji uhakika wa hizi habari maana nimezungumza na mtu aliyeko Kisutu mahakamani ananiambia Mgonja hajafikishwa, isipokuwa kuna mtu mwingine (ambaye hajapata jina lake) ameletwa kwa ajili ya kuunganishwa kwenye kesi moja ya epa-labda ndiye mgonja mwenyewe na jina lake linafichwa

Sina lengo la kuwarusha roho wakuu. Hii ilinifikia dakika 30 zilizopita toka chanzo credible kabisa, tumemtuma mwandishi wetu na anafuatilia kwa karibu na atatupa updates za kinachoendelea. Kama alivyosema mzee Kichuguu, one client at a time!

I confirm kuwa ni Mgonja kafikishwa hapo Kisutu (hata kama wanaficha). Our detectives are down there and one reporter on his/her way to the court. Ni mashtaka gani? Basi hilo tutafahamishana.
