    Wapendwa naomba ufafanuzi juu ya kigungu cha 61 na 71 vya Employment and labour relations. Naona kama vinagongana. Kimoja kinaruhusu mtu kuzuia kukatwa mshahara wake na kingine kinalazimisha hata kama wewe sio mwanachama. Agency shop agreement section 71 subsection3(c), section 4, 5 and 6 inapingana na deductions on trade unions subsection 4,and 5 naomba ufafanuzi kwa wenye mwanga wandugu.

    As far as I know about agency shop fee, nipale mtu anapokuwa si mwanachama wachama cha wafanyakazi kilichosainiwa kuwa ni bargaining power ya wafanyakazi wa sehemu aliyopo.

    Yeye badala ya kulipa ile monthly fee anatakiwa wakati kunapotokea kila makubaliano yanapoendelea hasa wakati wakutengeneza voluntary agreement alipie kwanai nayeye atafaidika na makubaliano hayo

    Makubaliano yakisha isha halipii tena uwakala huo.

    Mkuu soma vizuri s.61(1), employer anaruhusiwa kukata mshahara, kama ameruhusiwa na employee
    Na s.71 hamna sehemu yoyote inayozungumzia kuhusu deduction, ila s.72(3)(c) ndo kinazungumzia. Ila kumbuka kuna tofauti kati ya Trade union na Agency shop..s.67 ndo hakiruhusu Trade union ku Deduct na s.72 kinaruhusu Agency shop kudeduct maana ni vitu viwili tofauti ila vinafanya kazi sawa ingawa moja ni tempo unit.
    Soma kwanza maana ya Agency shop ( nipo tayari kukosolewa)

    Asante mpendwa, nadhani tatizo ni definition ya agency shop agreement. Angalia tafadhali section 72 subsection 4. Hicho kina maana gani in relation to sec 61 subsection 4 and 5. Naomba def ya agency shop agreement and how it works. Asante sana

    S.61(1) hakimruhusu employer ku deduct mshahara wake kama fee kwenda "TRADE UNION" bila ridhaa ya employee mwenyewe
    S.72(4) Ina mruhusu employer ku deduct mshahara wa employee as "AGENCY FEE" bila ridhaa ya employee (Maana hy agency inaundwa kwa muda kwa ajili ya kufanya agreements flani na employer, wakishakubaliana na yenyewe inakufa)
    Ila kumbuka Agency S inawakilisha majority of employees, so wanaweza kuwa wanachama wa Trade union au sio, kwa hy inabidi iighalamie maana hata wasio wanachama wa "TU" watafaidika na hz agreements.
    Dfn ya Agency shop angalia s.72(9), ingawa hawajaielezea vizuri.
    Ila def ya kawaida ni " is A type of collective agreement, an
    agency shop agreement requires
    employers to deduct a fee from the
    wages of non-union workers to
    ensure that non-union workers,
    who benefit from the union’s bargaining efforts, make a
    contribution towards those
    efforts."

    Thanks a great deal. From your explanation, one can translate that you can withdraw your membership from any trade union!! and cease deductions!! I was worried of this agency shop business

    You are right. Ignorance of law. Sheria iko wazi, ni kuwapeleka mahakamani utashinda tu. Ni watu kutojua haki zetu. Tunaojua sheria ni wachache sana. Vyama vya wafanyakazi viongozi wake hawawezi kuwapa wafanyakazi elimu hii maana wengi watajitoa nao watakosa hela ya bure ya kutumbua. jamaa yangu ambaye sio member anakatwa almost 70,000 Tsh per month. terrible!!! Ndio maana akataka kujua sheria inasemaje.
