Employee's disciplinary codes and permissible penalties

    Kwanza niseme mimi ni mwajiri anaechipukia na ninatengeneza sera yangu ya usimamizi wa rasilimali watu.

    Ninaomba nisaidiwe kufahamu, je baada ya kutungwa kwa sheria mpya ya Kazi ya mwaka 2004 (The Employment and Labour Relations Act, 2004) je inamaanisha (kama nitakuwa nimeielewa second schedule ya sheria hii kwa lile neno "whole repealed") kuwa ile sheria ya Kazi ya mwaka 1964 (Security of Employment Act CAP 574 of 1964) haitumiki tena?

    If so, swali langu la msingi ni kuwa, sheria ile ilitoa muongozo wa hatua za kinidhamu (code of disciplinary) kwenye second schedule yake pamoja na permissible penalties ambazo zilikuwa zikisaidia sana kwenye maamuzi ya adhabu za mfanyakazi. Kwa hii sheria ya sasa ya mwaka 2004 hizi code of discipline hazipo sasa sijajua je kuna kifungu chochote kinachotoa muongozo kama ule wa second schedule ya 1964 au ndio kila mwajiri atakavyojiamulia kivyake?

    Au ndio sawa na ile iliyoonyeshwa kwenye section 99 ya sheria ya 2004 kuwa Waziri atatoa CODE OF GOOD PRACTICE na kuzibandika kwenye gazeti la serikali, je ndiyo mbadala wa zile code of discipline au ni vitu viwili tofauti? Kama ni kile kile kitu kimoja, je zimeshachapishwa kwenye gazeti la serikali? and if so, je naweza kupata msaada wa kuzipata?

    hii ya sasa ina mabadiliko makubwa sana. Lakini makubwa zaidi ni waliondoa ule mtindo wa kujaza fomu za onyo etc. Sasa hivi utaratibu ni kama imethibitika yale yaliyoonyeshwa katika sheria hiyo kama yametokea na kufuatwa muajiri anafukuza bila hata fomu. Na katika hayo yaliyotajwa ni pamoja na kama anakuona humfai tena kwa labda elimu yako haiendani na mabadiliko yaliyofanywa katika sector hiyo mf. kuna machines za teknologia mpya ambayo wewe elimu yako hairuhusu. Na mambo mengi yameainishwa humu. Na kuna taratibu zake za kufuatwa. Kwa kifupi hii Act mpya imesaidia kiasi fulani kuondoa migogoro ambayo ilikua inalea uvivu kazini na muajiri akapewa nguvu zaidi ya kumfukuza mtu. Pia imeanzisha reconcilliation and arbitration boards ambazo zimewekea muda maalumu kushughulikia migogoro ya kazi ikishindikana ipelekwe labour court. Na pia imeruhusu migomo kazini ambayo zamani ilikatazwa.
    Hivyo basi kuna labour rules ambazo ndio hizo zinatoa maelekezo ya kila kitu katika mambo ya kuachisha mtu kazi ambayo ukiisoma au ukipata mtu anaejua sheria atakuelezea zaidi. Jaribu kwenda Open University wana kitengo cha legal aid watakufahamisha zaidi.

    Ruge unajaribu kusema nini hapa? unadhani hawa wanapatikana kila mahali kwenye nchi hii au ofisi zote zipo walippo? Nimeuliza hapa kwa kuwa nafahamu kuna watu wenye uwezo mkubwa wa kisheria na ambao wanaweza kusaidia eneo hili.
