    PAMOJA na kukamilika kwa uchunguzi na kuwapo kwa ushahidi wa kutosha, Serikali ya Rais Jakaya Kikwete imepata kigugumizi katika kuwafikisha mahakamani watuhumiwa wakubwa wa ufisadi, baadhi yao wakiwa bado ndani ya nafasi za juu za uongozi serikalini, RAIA MWEMA limefahamishwa.

    Vyanzo mbalimbali vya habari vya kuaminika ndani ya serikali vimeeleza kwamba vyombo vya dola, ikiwamo Taasisi ya Kuzuia na Kupambana na Rushwa (TAKUKURU) na Jeshi la Polisi, vimekuwa katika shinikizo kubwa la kutowafikisha mahakamani watuhumiwa hao; huku kukiwa na mvutano wa wazi ndani ya vyombo hivyo.

    Kwa mujibu wa habari hizo, kwa zaidi ya miezi mitatu sasa, Mkurugenzi wa Mashitaka nchini (DPP), Eliezer Feleshi, alikwishatoa kibali cha kushitaki angalau watuhumiwa watano wakubwa wakati watuhumiwa wengine kesi zao zikiwa katika hatua za mwisho, lakini TAKUKURU na Polisi wamepata kigugumizi cha kuziwasilisha kesi hizo mahakamani.

    Ofisa Mwandamizi wa serikali amelithibitishia Raia Mwema ya kuwa tayari angalao watuhumiwa watano walikuwa wafikishwe mahakamani mwezi huu lakini kukatokea "shinikizo" la kutaka kesi hizo zicheleweshwe angalao hadi mwezi ujao.

    "Tayari jamaa walikuwa wamejiandaa kuwakamata watu watano muhimu, kati yao wanasiasa wawili maarufu na mtendaji mmoja wa juu serikalini, lakini wakaambiwa wasubiri hadi Oktoba kutokana na sababu maalumu za kiutendaji," alisema ofisa mmoja mwandamizi wa serikali ambaye habari hizo zilimfikia hivi karibuni.

    Hata hivyo, ofisa huyo ametetea uamuzi huo kwa kusema kwamba kila serikali ina utaratibu wake wa kufanya kazi na kwamba suala linalohusu haki ya mtu linapaswa kuangaliwa kwa umakini mkubwa, kauli ambayo ilitolewa pia na Rais Jakaya Kikwete alipokuwa akihutubia Bunge hivi karibuni.

    Hivi karibuni Waziri wa Nchi Ofisi ya Rais, anayeshughulikia Utawala Bora, Sophia Simba, alinukuliwa na vyombo vya habari akisema hakuna mtuhumiwa wa ufisadi ambaye anaweza kukwepa mkono wa sheria, na kwamba hatima yao inashughulikiwa.

    Waziri Simba hakuweza kuzungumzia kigugumizi hicho jana baada ya kueleza kwamba alikuwa katika kikao ambacho hawezi kuzungumza na Raia Mwema, lakini habari zinasema kwamba serikali inaangalia mazingira na athari ya kuwashitaki watuhumiwa hao ambao baadhi wana mahusiano na wanasiasa wenye nguvu nchini.

    Pamoja na kuwa kesi zinazosubiriwa na wengi ni zile zinazowahusu watuhumiwa walioiba fedha kutoka katika Akaunti ya Madeni ya Nje (EPA), iliyokuwa ikiratibiwa na Benki Kuu ya Tanzania (BoT), kuna kesi nyingine ambazo uchunguzi wake umekamilika na hata Serikali kupitia vyombo vyake imejigamba kuwa uchunguzi wake umekamilika.

    Rais Kikwete amenukuliwa mara kadhaa akisema kwamba Serikali imo katika hatua za mwisho za kuzifikisha mahakamani kesi kubwa zinazohusiana na tuhuma za ufisadi, lakini hadi sasa hakuna kesi yoyote kubwa iliyofunguliwa.

    Mbali ya Rais, Mkurugenzi Mkuu wa TAKUKURU, Dk. Edward Hosea, amenukuliwa mara kadhaa akisema kwamba mwaka huu pekee wamejiwekea malengo ya kufikisha mahakamani kesi kumi kubwa za rushwa, na kwamba kati ya hizo kesi sita zilikuwa zimekamilika kufanyiwa kazi.

    DPP Feleshi, amewahi kunukuliwa akithibitisha kutoa kibali cha mashitaka kwa kesi mbili kubwa, kabla ya kukataa kuzungumzia tena suala la kesi alizozitolea kibali ikiwa ni miezi kadhaa kupita tokea atoe kauli ya kutoa kibali cha mashitaka.

    Pamoja na Serikali, TAKUKURU na DPP kutotaja kesi hizo hadharani, imethibitishwa kwamba kesi zilizokuwa katika hatua za mwisho kufunguliwa ni pamoja na uchunguzi kuhusiana na tuhuma za rushwa katika kampuni ya uhakiki wa dhahabu ya Alex Stewarts ya Marekani, ambayo iliingizwa na Serikali kuhakiki thamani halisi ya dhahabu inayozalishwa nchini na kuuzwa nje.

    Kesi nyingine ni ile inayohusu miradi ya dhahabu iliyohusisha makampuni ya Meremeta Limited, Tangold Limited, Deep Green na Mwananchi Gold. Kesi nyingine ni kuhusiana na mgodi wa dhahabu wa Buzwagi uliopo Kahama, uchunguzi kuhusu maghorofa pacha ya BoT, mradi wa makaa ya mawe wa Kiwira na ununuzi wa rada ya kijeshi kutoka kampuni ya BAe Systems ya Uingereza.

    Hata hivyo, kuna taarifa za ongezeko la kesi ya mradi tata wa umeme wa dharura uliokabidhiwa kampuni ya Richmond Development LLC ambayo sasa imetangazwa kufutiwa usajili na Wakala wa Usajili wa Makampuni na Leseni (BRELA), na sasa uchunguzi dhidi ya watuhumiwa wa wizi wa fedha za EPA.

    "Kaka, hakuna wa kubaki katika hizo kesi. Atakayepona ni yule msafi tu, na ndio maana unaona watu wanafanya kazi kwa uangalifu mkubwa ili kesi zikifikishwa mahakamani hakuna wa kulalamika kwamba anaonewa. Rais ameagiza kusiwe na mwanya wa mtu kuilalamikia serikali wala mtu kujigamba kwamba amependelewa," alisema ofisa mwingine wa serikali.

    Baada ya Serikali kuonyesha nia ya kukusanya kwanza fedha badala ya kuwafikisha mahakamani watuhumiwa wa fedha za EPA, wananchi mbalimbali walianza kulalamika wakielezea kuwapo kwa ubaguzi katika kushughulikia uhalifu; kauli ambayo iliigusa serikali na kutolewa ufafanuzi na Waziri Simba.

    "Timu ndiyo ita-establish kesi. Kama ni kwenda mahakamani watakwenda, sheria itachukua mkondo wake, kusikiliza pande zote ndio utawala bora. Mimi sijajua kama hapo baadaye itakuwaje. Naomba tusivuke daraja kabla hatujafika, tuiachie timu ifanye kazi yake, maana bado inaendelea, si unajua iliomba muda?”, alisema Waziri Simba alipozungumza na gazeti la Nipashe hivi karibuni.

    Wakati hayo yakiendelea, Tanzania kama taifa imekuwa ikihakikiwa na jumuiya za kimataifa, chini ya mwavuli wa wa Umoja wa Mataifa, kuhusiana na jinsi inavyoshughulikia tatizo la rushwa nchini, kazi iliyokuwa ikifanywa na wataalamu kutoka Uingereza na Uholanzi waliotembelea Tanzania hivi karibuni.

    Wataalamu hao walikutana na wadau mbalimbali wa mapambano dhidi ya rushwa, ikiwamo TAKUKURU, waandishi wa habari, asasi zisizo za kiserikali na watendaji wakuu na wa kati wa serikali wanaohusika katika mchakato wa kupambana na rushwa.

    Serikali kwa upande wake imekuwa ikijivunia matukio ya hivi karibuni katika mapambano dhidi ya rushwa ikielezea kwamba hali ilivyo sasa ni matokeo ya uamuzi wa Serikali kutoa uhuru wa kutosha kwa vyombo vya habari na wanasiasa katika kukabiliana na tuhuma za rushwa na ufisadi.

    Miongoni mwa mambo ambayo Serikali imetumia kama mfano ni pamoja na Rais kukubali kujiuzulu kwa mawaziri wake wanne, akiwamo aliyekuwa Waziri Mkuu, Edward Lowassa. Wengine ni waliokuwa mawaziri wa Wizara ya Nishati na Madini, Nazir Karamagi na Dk. Ibrahim Msabaha, pamoja na aliyekuwa Waziri wa Miundombinu, Andrew Chenge. Lowassa na wenzake walihusishwa na mradi tata wa Richmond wakati Chenge anachunguzwa kuhusika na rushwa katika ununuzi wa rada ya kijeshi.

    Mbali ya kujiuzulu kwa mawaziri hao, Serikali imejigamba kwamba hata mabadiliko makubwa ndani ya BoT, yametokana na dhamira ya kisiasa ya serikali ya Kikwete katika kupambana na ufisadi, na kwamba vyombo vya habari na Bunge vimekuwa vikipewa uhuru wa kutosha na Serikali bila kuingiliwa hata pale "vinapoteleza."

    Pamoja na kujigamba huko, Mwenyekiti wa Tume ya Haki za Binadamu na Utawala Bora, Jaji Kiongozi Mstaafu, Amiri Manento, alinukuliwa akishangazwa na hatua ya Serikali kusita kuwafikisha mahakamani watuhumiwa mbalimbali wa ufisadi, wakiwamo wale wa wizi wa fedha za EPA.

    Uamuzi wa kuwafikisha mahakamani watuhumiwa wa wizi wa fedha za EPA kwa sasa bado uko mikononi mwa Timu ya Rais ya Kuchunguza wizi huo, inayoongozwa na Mwanasheria Mkuu wa Serikali, Johnson Mwanyika na wenzake - Mkuu wa Jeshi la Polisi (IGP), Said Mwema na Mkurugenzi Mkuu TAKUKURU, Dk. Edward Hoseah.

    Timu hiyo imeomba na kukubaliwa na Rais kuongezewa muda hadi Oktoba 31, kipindi ambacho wamedai kwamba watakuwa wamekamilisha kukusanya fedha na ushahidi wa ndani na nje ya nchi.

    Govt becomes its own hurdle in prosecuting EPA suspects

    GOVERNMENT remains notoriously evasive on the fate of the so-called 'EPA billionaires' as calls continue to mount for the prosecution of suspects behind the theft of more than 133bn/- from the external payment arrears (EPA) account at the Bank of Tanzania, according to our investigations.

    Several weeks after the probe team headed by Attorney-General Johnson Mwanyika formally presented its report findings to President Jakaya Kikwete, senior government officials continue to skilfully dodge questions on whether or not there will be any prosecutions.

    So far, not a single government official has agreed to state publicly if the EPA suspects would finally be prosecuted for obvious criminal offences or if they will never see the inside of a jail, thanks to a possible presidential pardon.

    Analysts say the question of whether to prosecute or pardon the 'EPA billionaires' had become a ''politically sensitive subject,'' with opposition politicians now bashing the government for failure to prosecute suspected criminals.

    Most government leaders asked to comment on the subject responded with the popular refrain that the ''EPA probe is still ongoing,'' while others opted to remain tight-lipped.

    Likewise, the Minister of State in the President's Office (Good Governance), Sophia Simba, also dodged questions on the prosecution of EPA suspects.

    ''I can't tell you whether the government will take to court the suspects or not. The probe team formed by the president to investigate the matter and make recommendations is still conducting its work and should be the one to comment,'' she told THISDAY in an interview yesterday.

    Mwanyika on his part has become infamous in media circles for his inevitable ''no comment'' response, with few (if any) journalists now venturing to ask him any questions about the EPA investigation.

    Law enforcement experts describe the evidence against the 'EPA billionaires' as an ''open and shut'' case and wonder why the government is reluctant to prosecute the suspects.

    ''The evidence against the EPA suspects is overwhelming... from fraud, economic sabotage, corruption, criminal negligence, conspiracy and so many other offences,'' a former state attorney told THISDAY.

    He added: ''The government's commitment to good governance and rule of law will be seriously put to question if we don't see any prosecutions.''

    The list of would-be accused persons in the various offences emanating from the scandal include the owners of the companies that received fraudulent payments, lawyers who authenticated forged documents, BoT officials who authorised and processed the payments and several other accomplices.

    Already, several people are pointing to double standards in the way in which the 'EPA billionaires' are being given 'preferential treatment' despite committing obvious criminal offences.

    The EPA scandal forced a group of development partners providing general budget support (GBS) to the government to delay disbursement of more than 800bn/- aid for the country's 2008/09 budget until they received a progress report from the government.

    When addressing the National Assembly last month, President Jakaya Kikwete declared that suspects in the EPA scandal who fail to return the looted funds by October 31 this year will face criminal prosecution.

    The president's remarks have since drawn a heated debate, with critics suggesting that the government had given a blanket amnesty to all EPA suspects.

    Despite the ensuing confusion, no government official has publicly sought to put the record straight on the government's actual position on the matter.

    Among other things, President Kikwete also announced that the assets and passports of all suspects behind the scandal had been seized by authorities.

    PCCB boss cornered over graft cases

    Media Owners Association of Tanzania chairman Reginald Mengi yesterday criticised corruption watchdog chief Edward Hoseah over delayed corruption cases at a function in the city.

    But the director general of Prevention and Combating of Corruption Bureau (PCCB) hit back, dismissing Mr Mengi's criticism as baseless. The two engaged in a brief exchange at the 2008 awards ceremony for local journalists who excelled in reporting on corruption.

    Mr Mengi, who had been asked to invite the PCCB chief as guest of honour, grabbed the opportunity to tell him to show seriousness in dealing with corruption culprits in the country or face media criticism.
    "In the past two years, you have been in the negative limelight due to lack of results in your efforts.

    "We still have confidence in you, but Tanzanians are becoming impatient, you must bite otherwise you will be letting us down," said Mr Mengi, who is also executive chairman of IPP Ltd.

    Apparently stung by the remarks, Dr Hoseah retorted: "I deny your charges because they cannot be sustained in a court of law as they lack facts to support them," Dr Hoseah said. After the brief drama, he delivered his keynote speech, challenging the media to support the PCCB's efforts to fight corruption.


    He drew attention to the complexity of the current investigations, and said his office could not effectively perform due to the shortage of experienced staff.

    Meanwhile, three Citizen Journalists have won the Anti-corruption media awards.

    These are Kagera based reporter Joas Kaijage, Rose Athuman and Stella Barozi. This year�s three overall winners are Simon Mkina, Christopher Nyenyembe and Kaijage.

    Pact Tanzania and Misa-Tan funded the awards.

    Siku za karibuni Mengi amekuwa msema wazi zaidi ya miaka ya nyuma ambako alikuwa yupo tayari kuongea kidiplosia zaidi au kukaa kimya.

    Go On Mr Mengi, Taifa ni letu wote...hawa wakuu lazima sasa watuonyeshe RESULTS sio kutumia hela za kodi miaka na miaka kutuandikia ripoti za kujaza mashelvu.

    MKURUGENZI mkuu wa Taasisi ya Kuzuia na Kupambana na Rushwa (Takukuru), Dk Edward Hoseah, amesema jamii haipaswi kumlaumu yeye wala taasisi yake kwa kushindwa kuwafungulia kesi watuhumiwa wa ufisadi, kwa kuwa TAKUKURU haiwezi kufanya hivyo bila idhini ya Mkurugenzi wa Mashtaka ya Umma (DPP).

    Wakati umma ukisubiri kwa hamu kuona watuhumiwa wa makosa mbalimbali ya ufisadi wakifikishwa mbele ya vyombo vya sheria kutokana na kuhusika katika vitendo vinavyoashiria rushwa na wizi, shutuma nyingi zimekuwa zikielekezwa kwa taasisi hiyo kuwa haifanyi lolote kushughulikia vigogo na badala yake inahangaika na kesi za rushwa ndogo.

    Lakini Dk Hoseah, akizungumza jana jijini Dar es Salaam, alipokuwa mgeni rasmi kwenye mjadala uliokuwa na dhima ya "Waandishi wa Habari Katika Kupambana na Rushwa", alitumia muda mwingi kueleza jinsi taasisi yake ilivyofanya jitihada za kushughukilia mafisadi hadi mamlaka yake yanapoishia.

    Mkurugenzi huyo alieleza kuwa hadi sasa tayari kesi kubwa tatu ziko mikononi mwa DPP, huku mbili zikiwa zimerejeshwa ili kufanyiwa kazi zaidi.

    "Takukuru tumejiwekea malengo ya kuchunguza kesi kumi kubwa za rushwa ifikapo Desemba mwaka huu na tayari tumekamilisha kesi tano ambazo majadala yake yako kwa DPP," alisema Dk. Hoseah bila ya kuweka bayana kesi hizo zinahusu masuala gani.

    "Kati ya kesi hizo tano, DPP amerudisha Takukuru kesi mbili ili zifanyiwe marekebisho na kesi tatu bado anazipitia. Ninaamini katika kipindi kifupi kijacho mtaona nini Takukuru imefanya."

    Miongoni mwa masuala ya rushwa ambayo yamekuwa yakitajwa sana na kashfa ya ununuzi wa rada, ambayo hivi sasa inachunguzwa nchini Uingereza na utoaji wa zabuni ya ufuaji umeme wa dharura kwa kampuni ya Richmond.

    Lakini Dk. Hoseah hakugusia aina ya ufisadi huo na badala yake alitaja mazingira ya kesi ambazo ofisi yake inashughulikia, akisema zile ambazo rushwa yake imekuwa ikilalamikiwa kwa muda mrefu na jamii.

    Alisema kesi hizo pia zinahusu tuhuma za rushwa zinazowahusu watu mashuhuri nchini na mali iliyochotwa kwa njia hiyo isiyo halali ni nyingi kupindukia.

    "Rushwa nyingine zinazochunguzwa ni zile ambazo madhara yake ni makubwa kwa uchumi wa taifa na zile ambazo mali au fedha zilizochotwa nchini na kupelekwa nje ya nchi," alisema.

    Kwa mujibu wa Dk Hoseah mbali na kazi za Takukuru kuishia kwa DPP, ucheleweshaji wa kesi za rushwa kubwa pia unachangiwa na mchakato mzima na mlolongo wa kukusanya taarifa za rushwa, kuzichuja, kuzifanyia uchunguzi na kuandaa majalada yenyewe.

    "Pamoja na mlolongo wote huo Takukuru bado inatakiwa kupeleka jalada la kesi kwa DPP tena kwa mujibu wa kifungu cha 15 cha sheria ya Kuzuia na Kupambana na Rushwa. Yeye anaweza kukubali au kukataa lakini ili kesi iende mahakamani, DPP lazima aone jalada na kutoa kibali," alisema.

    Dk. Hoseah alitoa kauli hiyo baada ya mwenyekiti wa Chama cha Wamiliki wa Vyombo vya Habari nchini (MOAT), Reginald Mengi kusema katika hotuba yake ya kumkaribisha (Hoseah) kufungue mjadala huo kuwa, pamoja na imani kubwa kwa Takukuru, jamii inashindwa kuelewa sababu za Dk. Hoseah kukosa kasi katika kuwashughulikia mafisadi na wahujumu uchumi.

    Akizungumzia jinsi taasisi yake inavyofanya kazi, Dk. Hoseah alisema kazi ya Takukuru katika kushughulikia rushwa kubwa, inaishia katika kutayarisha majalada na kuyapeleka kwa DPP.

    Dk. Hoseah alisema baada ya Takukuru kukamilisha uchunguzi na kutayarisha majalada, inatakiwa kuyawasilisha majadala hayo katika ofisi ya DPP ili yachambuliwe na kuridhiwa kabla ya kufikishwa mahakamani, lakini DPP ana mamlaka ya kukubali au kukataa kufungua kesi.

    "Kuna mambo mengi kuhusu kuchelewa kufungua kesi; kwanza uchunguzi ni mchakato wa muda mrefu, lakini pia ili kesi iende mahakamani lazima DPP alione jalada la Takukuru, alipitie na aridhike. Anaweza pia hata kukataa kulipeleka mahakamani kama anaona halikidhi vigezo," alisema.

    Dk. Hoseah alisema Takukuru inapaswa kupongezwa katika kipindi chote cha uongozi wake badala ya kulaumiwa kwa kuwa tangu Januari hadi sasa imekamilisha uchunguzi wa kesi tano kubwa na kuzipeleka kwa DPP kusubiri ridhaa yake ya kufikishwa mahakamani.

    Kuhusu madai kwamba taasisi hiyo inashughulikia zaidi rushwa ndogo kuliko rushwa kubwa, Dk. Hoseah alisema ni kweli lakini alibainisha kuwa hili linatokana na ushahidi wa haraka unaoweza kupatikana katika rushwa ndogo kuliko ilivyo kwa rushwa kubwa.

    "Nilisema sifa nyingine ya rushwa kubwa ni zile ambazo fedha zinavuka mipaka. Sasa ili ukachunguze huko, DPP anatakiwa kuwasiliana na DPP wa nchi husika halafu akubali na atoe kibali cha uchunguzi, utaona hapa kuna mlolongo mrefu kidogo," alieleza.

    Alisema uchunguzi wa tuhuma za rushwa hautaki haraka badala yake unatakiwa kufanywa taratibu na kwa umakini mkubwa ili kulinda haki ya mtuhumiwa na serikali.

    "Hatutakiwi kufanya kazi kwa haraka tu, tunatakiwa kufanya taratibu, na kwa umakini ili kulinda haki za watuhumiwa na serikali kwa kuwa ni aibu kwa Takukuru kupeleka kesi mahakamani halafu ikaonekana hakuna kesi," alibainisha.

    Katika hotuba ya kumkaribisha mkurugenzi huyo wa Takukuru, Mengi alisema ama kwa sababu watu hawajui taratibu za Takukuru katika kushughulikia rushwa, au kukosa maarifa ya kiutendaji katika suala hilo, jamii hasa waandishi wa habari wanaona TAKUKURU haina kasi katika kushughulikia ufisadi ukiwamo ule wa EPA.

    "Hoseah umekuwa mkurugenzi waTakukuru kwa muda wa miaka miwili sasa, lakini naamini jamii haijaona matunda ya kazi yako kwa sasa. Watu, hasa waandishi wa habari, wanataka kuona nini umefanya katika kuwashughulikia wahujumu uchumi," alisema Mengi na kuongeza:

    "Na hii inaweza kuwa ni kwa sababu watu hawajui muda unaotakiwa kitaalam kutunza jambo kabla ya kulichukulia hatua au hawana utalaam wa kujua na kulinda haki za binadamu katika kuchunguza rushwa."

    Alisema jamii bado ina imani na Takukuru lakini mkurugenzi wake, yaani Dk. Hoseah anatakiwa kulinda imani hiyo kwa kuhakikisha watuhumiwa wote wa ufisadi wanafikishwa mahakamani.

    Mjadala huo uliandaliwa na Taasisi ya Vyombo vya Habari Kusini mwa Afrika-Tawi la Tanzania (MISA TAN) kwa kushirikiana na shirika lisilokuwa na kiserikali la Pact Tanzania na kufanyika kwenye ukumbi wa hoteli ya Blue Pearls, Dar es Salaam.

    Mjadala huo pia uliandaliwa kutoa tuzo kwa waandishi wa habari za uchunguzi kuhusu rushwa na utawala bora. Katika suala hilo, waandishi wa kampuni ya Mwananchi Communications Limited, Rose Athuman, Joas Kaijage na Stella Barozi walikuwa miongoni mwa washindi.

    Wakati Rose akiwa ameibuka mshindi wa tatu wa jumla na kupata zawadi ya Sh1 milioni, Joas amekuwa mshindi wa nne na kuzawadiwa Sh600,000 huku Stella akiibuka na zawadi ya Sh150,000 kwa kuwa mshindi wa tatu kati ya washindi wengine kumi ambao habari zao zilichaguliwa baada ya washidi watano wa mwanzo.

    Mshindi wa kwanza wa jumla katika tuzo hiyo ni Simon Mkina wa gazeti la This Day, wakati Christopher Nyenyembe wa Tanzania Daima alikuwa wa pili na mshindi wa tano alikuwa Rashid Mkwinda kutoka Kampuni ya Business Times Ltd.

    Washindi kumi ambao habari zao zilichaguliwa pamoja Stella na vyombo vyao vya habari kwenye mabano ni Lyamuya Stanley (The African), Finnigan Simbeye na Pendo Ndovie, Daniel Mbega na Lucas Liganga (This Day), Adeladius Makwega na Editha Majura (Kulikoni) Iddy Mkwama na Kenneth Mazembe (Mwanahalisi).
