Court to decide on Mramba, Yona next month

    The Kisutu Resident Magistrates' Court on Wednesday set June 27 as date for determining over whether former cabinet ministers Basil Mramba and Daniel Yona charged with abuse office will have a case to answer.



    The two, who served during President Benjamin Mkapa's term in office, are accused of occasioning the government a loss amounting to 11.7bn/- through tax exemptions.


    The prosecution alleges that the duo willfully committed the offence between 2003 and 2007, in respect of a firm known as Stewart Assayers.


    The case was instituted following three years of investigations by the Prevention and Combating of Corruption Bureau (PCCB) and the police into the suspicious hiring of Alex Stewart (Assayers) Government Business Corporation (ASA) to audit gold production in
    Tanzania.


    The corporation was in 2003 controversially assigned a contract which saw it receive a whopping 65bn/- (USD 50 million) in gold audit fees. The company completed the assignment and left the country in August, 2007. The ASA was paid an average of 1.3bn/- (USD1 million) every month from June 2003 to August, 2007.

    MAHAKAMA ya Hakimu Mkazi Kisutu imepanga Juni 27, mwaka huu kutoa uamuzi kama washitakiwa wana kesi ya kujibu au la katika kesi inayowakabili mawaziri wa zamani, Basil Mramba na Daniel Yona pamoja na Katibu Mkuu mstaafu wa Hazina, Gray Mgonja.

    Kesi hiyo inayowakabili mahakamani hapo ni ya matumizi mabaya ya ofisi na kuisababishia Serikali hasara ya Sh bilioni 11.7.

    Aidha, Hakimu aliyeiahirisha jana, Sam Lumanyika amepanga kesi hiyo kutajwa tena Mei 22, mwaka huu.

    Kesi hiyo jana ilitajwa na kuangalia kama taratibu za Mahakama zimeenda kama ilivyopangwa baada ya mwenendo wa kesi kukamilika na washitakiwa kupewa kuandaa majumuisho na kuyawasilisha mahakamani.

    Mawaziri hao wa zamani wa Fedha, Nishati na Madini, pamoja na Mgonja, wanadaiwa kutoa msamaha wa kodi kwa Kampuni ya ukaguzi wa dhahabu ya Alex Stewart (Assayers) ambayo haikustahili kupata msamaha huo.

    Kampuni hiyo inadaiwa kuwa kama ingelipa kodi, Serikali ingepata faida kupitia kodi katika kipindi chote kutoka iliposajiliwa na Mamlaka ya Mapato (TRA), Oktoba 3, 2003, hivyo Serikali inadaiwa kupata hasara ya Sh 11,752,350,148.00 kati ya mwaka 2002 na Mei 2005.

    Aidha, kampuni hiyo inadaiwa ilipitishwa kusimamia ukaguzi wa dhahabu nchini kwa kubebwa bila kuzingatia ushauri na kuisababishia Serikali hasara ya mabilioni.

    Duh.. Yaani toka kesi ilivyoanza mwaka 2009.. tarehe 27 june 2012 ndio mahakama itatoa uamuzi kama washtakiwa wana kesi ya kujibu au..! :doh: Halafu bado wanataka kutuaminisha ati mahakama ziko huru..!! Labda kwa wezi wa kuku..

    Kenye katiba mpya wezi wa mali za umma kesi ziwe na ukomo alau miezi sita na hukumu ni kupigwa risasi hadharani kwenye uma na mali zilizoibwa zirudishwe serekalini.

    hata mi nilikua najiuliza kitu hicho hicho..watu wananyea debe miaka yote hii kumbe ndio kwanza mahakama inakaa kuona ka jamaa wana kesi ya kujibu..this happens only in AFRICA
