    BAGHDAD (AFP) – Saddam Hussein's notorious enforcer "Chemical Ali" was sentenced to death on Sunday for ordering the gassing of Kurds in the Iraqi town of Halabja, a brutal attack that killed an estimated 5,000 people.

    Ali Hassan al-Majid will die by hanging, the state-run Al-Iraqiya television channel said, having been found guilty of the attack in the northeast of the country as the Iran-Iraq war drew to a close in 1988.

    The ruling is the fourth time that Majid, better known by his macabre nickname, has received a death sentence.
    Three-quarters of the victims at Halabja were women and children, in what is now thought to have been the deadliest gas attack ever carried out against civilians.

    "This judgment is a victory for all Iraqis, humanity and the Kurds because Halabja is the biggest crime of modern times," said Majid Hamad Amin, minister of the martyrs and displaced in the Kurdish regional government.

    "Halabja is not only a Kurdish case but it is an issue for all Iraqis and the rest of the world," he added.

    A close cousin of Saddam, Majid earned his ghastly moniker for ordering poisonous gas attacks in a brutal scorched-earth campaign of bombings and mass deportations that left an estimated 182,000 Kurds dead in the 1980s.

    He had already been sentenced to hang for genocide over the Kurdish offensives when in December 2008 he received a second death sentence for war crimes committed during the ill-fated 1991 Shiite uprising in southern Iraq.

    And in March last year, the Iraqi High Tribunal handed down a third death sentence over the the 1999 murders of dozens of Shiites in the Sadr City district of Baghdad and in the central shrine city of Najaf.

    However, he is probably best known for the Halabja attack when in March 1988, Iraqi jets swooped over the small town and for five hours sprayed it with a deadly cocktail of mustard gas and the nerve agents Tabun, Sarin and VX.

    Majid was the King of Spades in the pack of cards of most wanted Iraqis issued by the US military in 2003 and was arrested in August of that year.

    Like Saddam, Majid hails from the northern town of Tikrit, where he was born in 1941, according to court documents, although he told a tribunal last year that he was born in 1944.

    Considered Saddam's right-hand man and bearing a strong resemblance to the former dictator, he was a member of the decision-making Revolutionary Command Council and regularly called upon to wipe out rebellion.

    He was most infamous for his role in northern Iraq. In March 1987, the ruling Baath party put him in charge of state agencies in the Kurdish area, including the police, army and militias.

    As Iraq's eight-year war with Iran drew to a close, fighters from the rebel Patriotic Union of Kurdistan, with backing from Tehran, took over the farming community of Halabja, near the border.
    As Saddam's henchman, Majid then ordered the gas attack to crush the uprising.

    New York-based Human Rights Watch has said Majid was responsible for the deaths or disappearances of around 100,000 non-combatant Kurds when he put down the revolt across the Kurdish region.

    But Majid said he ordered the attacks against the Kurds, who had sided with Iran in the war, for the sake of Iraqi security. He has refused to express remorse for the killings.

    Nafikiri hukumu hizi zipo kwenye kulipa kisasi zaidi kuliko kujenga umoja wa kitaifa, maana kama hata Mandela angekuwa na phobia kama hii kwa makaburu basi leo SA kungekuwa hakukaliki.

    Hilo swali umeuliza is very justified nami pia niliuliza na nikapewa jibu.
    Most of the time hawa jamaa wa ICC mpaka waalikwe ndani ya nchi
    husika kabla hawajaanza kesi zao.In this case of Iraq, Marekani ndio
    wamekua waki-run the show so to speak na they are not signatories
    wa ICC.

    Kwa hivyo they decided to orchestra the whole thing inside Iraq with
    the local judiciary system having the final say.

    Problem wameiona from the beginning kuwa, kama kesi hizo zikitoka nje ya Iraq, itabidi ziende all the way back kuangalia source ya conflict yenyewe, na ndicho jamaa walichoogopa.

    They committed crimes against Iraqis in Iraq so they were tried in Iraq by Iraqi courts.

    Kazi ya ICC hutawaliwa na kanuni zake kifungu 17 kinasema:
    a case is inadmissible if: "(a) The case is being investigated or prosecuted by a State which has jurisdiction over it, unless the State is unwilling or unable genuinely to carry out the investigation or prosecution; (b) The case has been investigated by a State which has jurisdiction over it and the State has decided not to prosecute the person concerned, unless the decision resulted from the unwillingness or inability of the State genuinely to prosecute;"


    Halafu kuna sharti ya kwamba ICC haiwezi kuangalia kesi zilizotokea kabla ya kuundwa kwake mwaka 2002. Jinai za Bwana Ali zilitendeka kabla.
    Amehukumiwa mara 3:
    1. kwa jinai wakati wa kempeni ya al-Anfal dhidi ya Wakurdi mwaka 1980 (matumizi ya gesi ya sumu dhidi ya watu raia)

    2. kwa mauaji dhidi ya Washia mwaka 1991/92 (Waislamu Washia kati ya 20.000 hadi 100.000 waliuawa katika kusini ya Irak)
    3. kwa kumwua Ayatollah Mohammad al-Sadr mwaka 1992

    Yote yalitokea KABLA ya kuundwa kwa ICC.

    Asante kwa kunikumbusha juu ya chanzo cha swali. Samahani kwa kukukosea katika hii.

    a)Hapana Marekani imekimbia utaratibu wa ICC. Bado wanajisikia ni wakuu hawataki kukubali wengine kuwahukumu.
    b) si sahihi ya kwamba ICC ilikuwepo kabla ya 1998/ 2002. Labda unaichanganya na Mahakama Kuu ya Kimataifa (International Court of Justice kifupi ICJ)? Chanzo chako si wazi hapa.

    a) Ukiona kanuni za ICC hakuna msingi wa kupeleka kesi hii huko. Marekani ipende isipende!
    Chungulia mwenyewe kanuni uniambie ICC ingeangalia mambo ya Ali kwa msingi gani??
    B) Tena sioni ya kwamba Ali alihukumiwa haraka sana. Inaonekana kuna watu wengi huko Iraq waliotaka kumalizana naye mbele ya mahakama - maana hawakumnyonga baada ya hukumu ya kwanza ilitotolewa mwaka 2007 (leo 2010!).

    c) Wakurdi walitaka ufafanuzi kuhusu matumizi ya gesi ya sumu (wakati ule Marekani hakika ilitafuta tamko hili pia kama uthebitisho wa vita yake)

    d) Lakini Washia walipotafuta ufafanuzi rasmi mbele ya mahakama haikuwa habari rahisi kwa Marekani maana Washia wanashikamana na Iran adui wa Marekani.
    Pia ni wazi hata Marekani iliwajibika kwa namna fulani katika vifo hivi maana wakati ule 1991 Marekani iliwapa moyo Washia kusimama dhidi ya Saddam bila kuwasaidia wakachinwa.

    Mie nakubaliana nawe 100% kua marekani wana double standards when
    it comes to ICC. Maana jeshi lao likiua watu kimakosa they are not
    subjected to prosecution on foreign soil lakini watalazimisha nchi zengine

    Technicalities are based on the names. Zile Nuremberg trials za baada
    ya WW II were a mirror image of the ICC...ICJ/ICC kwangu ni kitu kimoja.

    Nations is just the same thing..difference ni jina na mahala headquarters

    rufaa wala nini. When it comes to International Courts, kesi zinaweza
    ku-drag for an untold time lakini zikiwa humuhumu uswahilini
    mwetu tutazikimbiza na hata tukikiuka sheria, they are not really
