    [​IMG] KAMA vile imeshindwa kusoma alama za nyakati, serikali imeamua kuchakachua mchakato wa marekebisho ya katiba mpya kwa kuandaa muswada ambao unapinga yote yanayopendekezwa na wananchi.
    Badala yake, serikali inarejesha yote yanayokataliwa na wadau, hali ambayo inaweza kuhatarisha amani ya nchi na hatimaye kusababisha mchakato mzima kurudiwa huko mbele.
    Mabadiliko ya katiba ni madai ya msingi na matakwa ya lazima kama nchi hii inataka kujenga na kudumisha amani ya kweli na kuleta maendeleo kwa watu wake.
    Katika mazingira ambamo wananchi wamekuwa wanalalamikia mamlaka yaliyopitiliza ya rais, kama kikwazo cha maendeleo na badiliko la msingi katika katiba, muswada wa sasa unaoletwa na serikali, unalenga kuendelea kusimika mamlaka hayo.
    Uchambuzi uliofanywa na Mbunge wa Ubungo, John Mnyika (CHADEMA), ambaye awali ndiye alidhamiria kuwasilisha hoja binafsi bungeni kuhusu mchakato wa katiba mpya, unaonyesha kuwa muswada huo uliochapwa katika gazeti la serikali toleo No. 1 Vol. 92 la tarehe 11, Machi 2011, unataka kumpa rais mamlaka ya kuunda tume ya kuongoza mchakato mzima wa katiba bila kuhusisha Bunge ama wadau wengine wa msingi.
    Wakati wanaharakati na wananchi kwa ujumla wamekuwa wanasisitiza wananchi wawe na mamlaka ya mwisho katika kuamua hatima ya katiba yao, muswada huu wa serikali unarejesha mamlaka hayo kwa rais.
    Muswada wa Sheria ya Mabadiliko ya Katiba wa mwaka 2011 unatarajiwa kuwasilishwa bungeni hivi karibuni, na CCM kwa kutumia wingi wa wabunge wao, wanaoiunga mkono serikali hata kwa masuala wasiyokubaliana nayo, wanatarajiwa kuunga mkono muswada huo, kuhujumu mabadiliko makubwa ambayo taifa lingefanya baada ya miaka 50 ya uhuru.
    Katika taarifa yake kwa vyombo vya habari, ambayo gazeti hili lina nakala yake, mbunge huyo wa Ubungo anasema:
    “Maudhui ya muswada huu yamedhihirisha tahadhari niliyotoa mara kadhaa kwamba serikali haina dhamira ya kweli ya kuhakikisha panakuwepo na mchakato mzuri wa kuwa na katiba mpya.
    “Muswada huo umelenga kuhalalisha yote ambayo yalitangazwa kufanywa na rais kuhusu mchakato wa katiba mpya na kupingwa na wadau mbalimbali; sasa yanataka kupewa uhalali kwa sheria inayotaka kutungwa na Bunge kupitia muswada huo.
    “Muswada huo unataka kumpa mamlaka rais ya kuunda tume ya kuongoza mchakato mzima wa katiba bila kuhusisha Bunge ama wadau wengine wa msingi. Muswada huo pia utaka kumpa rais mamlaka ya kuteua wajumbe wa tume husika bila kushauriana na mtu yeyote isipokuwa Rais wa Zanzibar.
    “Muswada huo unaelekeza kuwa katika kuteua wajumbe, rais atazingatia uwakilishi wa makundi ya kijamii, lakini makundi husika hayatajwi hata kwa ujumla wake, hivyo kuacha mamlaka yote ya kuamua uwakilishi kubaki kwa rais.
    “Muswada huo unataka kumpa rais mamlaka ya kutengeneza hadidu rejea za tume, jambo ambalo lilipaswa kufanywa na Bunge kwa kuwa sehemu ya sheria husika ama kufanywa na mkutano mkuu wa kikatiba. Kwa kutoa mamlaka ya kuunda hadidu rejea kwa rais, mwanya umetolewa kwa mtu mmoja kuweka mipaka ya nini kinastahili kufanywa na tume wakati wa mchakato wa katiba mpya, hivyo kuminya wigo wa mabadiliko.
    “Muswada huo unataka tume iwasilishe ripoti yake kwa rais ambaye atampa nakala Rais wa Zanzibar na baadaye kumwelekeza waziri mwenye dhamana kupeleka yale atakayoamua rais bungeni. Muswada huu kwa kuwa na kifungu hiki utaendeleza yaliyofanywa na marais waliopita kuhusu ripoti na mapendekezo ya tume nyingine, hivyo kukwamisha mabadiliko ya kweli.
    “Muswada huo unataka kutoa mamlaka kwa tume itakayoundwa kuitisha jukwaa (fora) ambalo litaundwa kwa ajili ya kupata maoni pekee (ad hoc) badala ya kuitishwa kwa Mkutano Mkuu wa Katiba (National Conference/congress) kama wadau walivyohitaji.
    “Aidha, uwakilishi katika jukwaa hilo umetajwa tu kuwa ni wa kijiografia na kimakundi bila kuweka bayana mnyumbuliko wa uwakilishi. Muswada huo unataka kutoa mamlaka finyu kwa jukwaa hilo kuwa ni kutoa ushauri kuhusiana na muswada; tofauti na mkutano mkuu wa kikatiba ambao ungekuwa na mamlaka zaidi katika mchakato husika.
    “Muswada huo unataka kutoa mamlaka kwa rais kuitisha Bunge la katiba (constituent assembly) ikiwemo kuteua wajumbe wa Bunge husika. Muswada huo unataka kutoa mamlaka makubwa kwa rais kuteua wawakilishi wa chombo kikuu zaidi katika mchakato wa katiba bila kushauriana na kundi lolote ama wananchi kuhusika katika uteuzi ama kuwa na wawakilishi walioteuliwa na makundi yenyewe, mathalani vyama vya siasa, asasi za kiraia, taasisi za dini, vyama vya wakulima, vyama vya wanafunzi, vyama wa wafanyakazi nk.
    “Muswada huo unataka rais ashauriane na Rais wa Zanzibar na Mwanasheria Mkuu wa Serikali pekee. Muswada huo unatoa mamlaka makubwa zaidi ya rais kuamua hata kufanya Bunge la kawaida kuwa ndilo Bunge la Katiba, jambo ambalo linaweza kurejesha udhaifu uliofanywa katika mchakato wa katiba inayotumika sasa ambapo umma uliporwa wajibu na mamlaka yake ya kushiriki moja kwa moja katika kupitisha katiba.
    “Muswada huo kwa ujumla haujaeleza muda wa mchakato wa katiba na vipindi vitakavyotumiwa na vyombo mbalimbali katika hatua mbalimbali za mchakato wa katiba; ama kutoa mamlaka ya kuwekwa kwa muda huo kwa chombo chenye uwakilishi mpana wa umma kama mkutano wa katiba au Bunge, hivyo kutoa mwanya kwa mchakato mzima kucheleweshwa.
    “Haya ni baadhi ya maudhui ndani ya muswada husika ambayo yamenishtusha na kunifanya nitoe tamko hili la awali wakati nikiendelea kufanya uchambuzi wa kina ambao nitautolea kauli katika hatua za baadaye.”
    Mnyika alitoa wito kwa vyama vya siasa, asasi za kiraia, vyombo vya habari, taasisi za dini na Watanzania kwa ujumla kufuatilia na kupata nakala ya muswada huo ama maudhui yake kwa ajili ya kuujadili kwa dharura na kutoa matamko.
    Sanjari na hilo, alitoa wito kwa serikali itoe taarifa kwa umma namna ambavyo wananchi wanaweza kupata nakala za muswada huo nyeti na sababu za serikali kupuuza maoni mengi ya wadau yaliyotolewa kabla ya kuandaliwa kwa muswada huo kuhusu mchakato unaofaa kuongoza mabadiliko ya katiba katika taifa letu.
    Mara kwa mara mbunge huyo amekuwa akisisitiza kuwa ipo haja kwa mchakato wa katiba mpya kupata uhalali wa umma kwa kurejea ibara 8 ambayo inatamka kwamba, “madaraka na mamlaka ni umma na serikali inafanya kazi kwa niaba na Bunge ndicho chombo kikuu cha kusimamia wajibu huo kwa kutokana na mamlaka ya kikatiba yaliyopo kwenye ibara ya 63(2) na (3) na ibara ya 98 inayohusika na mabadiliko ya katiba.”
    Kumbukumbu zinaonyesha kuwa Waziri Mkuu, Mizengo Pinda, katika hotuba yake bungeni Februari 8 mwaka huu, pamoja na mambo mengine, alieleza kwamba muswada kuhusu mchakato wa katiba utawasilishwa kwenye mkutano wa tatu wa Bunge mwezi Aprili mwaka huu na kwamba utahusu kuundwa kwa tume.
    Makongamano, mikutano na midahalo imekuwa ikifanyika kujadili suala la mabadiliko ya katiba na wanazuoni wamesisitiza mara kadhaa kuwa katiba isiyotokana na matakwa ya wananchi, na isiyopitishwa na wananchi, si ya wananchi.
    Iwapo serikali itapuuza wito huu, itakuwa inalielekeza taifa katika machafuko ya kisiasa, na italazimika kufanya mchakato mpya ili kukidhi matakwa haya ya kisheria katika uundwaji wa katiba mpya.
    Hatua hii ya serikali kuchakachua mchakato wa katiba imedhihirisha pia kwamba Rais Jakaya Kikwete alidandia hoja asiyoijua mapana na marefu yake alipokiri kwamba nchi inahitaji katiba mpya, baada ya wimbo na joto la kisiasa lililoibuliwa na aliyekuwa mgombea urais kupitia CHADEMA, Dk. Willibrord Slaa.
    Dk. Slaa aliahidi kuwa angeanzisha mchakato wa katiba mpya ndani ya siku 100 za utawala wake. Rais Kikwete hakuwahi kuahidi wakati wa kampeni kwamba angerekebisha katiba.
    Hata hivyo, baada ya wananchi kudai katiba, huku Mnyika akiahidi kupeleka hoja binafsi bungeni kwa ajili hiyo, ghafla Rais Kikwete alitekeleza ahadi hiyo ndani ya siku 100 za utawala wake – hatua ambayo wachambuzi walisema ililenga kuwanyamazisha wananchi na kuipokonya CHADEMA ajenda.
    Hata hivyo, wananchi wanaendelea na mijadala kuhusu katiba mpya; na sasa linaandaliwa kongamano la pili lililoandaliwa na Jumuiya ya Wanataaluma Chuo Kikuu cha Dar es Salaam (UDASA), lenye lengo la kuwapa wananchi uelewa wa kutosha ili waweze kushiriki kikamilifu katika mchakato wa katiba mpya.
    Mwenyekiti wa UDASA, Dk. Mushumbusi Kibogoya, akizungumza na waandishi wa habari jijini Dar es Salaam jana, alisema mada kuu katika kongamano hilo ni ‘Maudhui na Misingi ya Katiba Mpya.’
    “Safari hii tunataka watu waweze kujua zaidi kuhusu katiba, wawe tayari kutoa mawazo ili tume au kamati itakapowatembelea wawe na kitu cha kusema, watakapoachwa hivi hivi hawatakuwa na cha kuzungumza,” alisema Dk. Mushumbusi.
    Watoa mada katika kongamano hilo litakalofanyika keshokutwa ni Jaji Mkuu mstaafu Barnabas Samatta na Mkurugenzi wa Kituo cha Sheria na Haki za Binadamu (LHRC), Francis Kiwanga.

    Dear fellow Tanzanians,

    I have gone through the bill and I have strong reservation that the government hasn't taken seriously the issue of ''New constitution''. A quick review of the proposed bill indicates that the ruling party wants to have full control of the process hence resulting into having a new constitution in its favor. The draft of the bill also may have been affected by the prevailing political climate in the country including the overwhelming support of citizens to one of the formidable opposition party.

    I have identified 8 areas of serious concern with the bill:

    1. Appointment of the commission member by the incumbent president
    The current president is the head of the ruling political party, how can he be impartial when it comes to selecting the commission members? How can we ensure that the commission takes in the balance the divergent views of our population both in Tanzania Mainland and Zanzibar? Surely the excessive power of the president is spilling over and will result into a constitution which is not the will of the people.

    2. Equal numbers of representatives from Zanzibar and Tanganyika
    There is no rationale here and this is an absurd and jokes to the people of Tanzania mainland. Zanzibar has about 1million people and mainland are over 40 million! What criteria did the Ministry use to arrive at this ratio of 1:1. Zanzibar is over represented in this commission and the mainland is under represented.

    3. Terms of reference to be issued by the president
    ToR is the backbone of the new constitution formation process, how can such a sensitive issue be vested to the president? I know presidency is an institution but he will still have powers to overrule any proposal which does not serve the interest of his party. How can we ensure that the ToRs given to the said commission is going to consider all the diversity of our society? What if the president will orient himself to only such terms as those acceptable to his party and protecting its future interests?

    4. The commission shall adhere to national values and ethos and shall in that respect observe inviolability and sanctity of the following matters (Including: Union of Tanganyika and Zanzibar, Executive, Legislature and Judicature, the presidency, The existing of the revolutionary Government of Zanzibar etc)

    The things mentioned here are supposed to form the fundamentals of the law of the land. How were they arrived at? Who has the authority to dictate the key principles to hold our nation? Aren't some of the issues mentioned part of the very things citizens are challenging and need to be discussed and agreed upon? Why this kind of imposition? Don't we as people of Tanganyika and Zanzibar have right to determine how we should be governed? Don't we have rights to review the union and how it is constituted and finally determine how it should be? Yes Executive, Legislature and Judicature are key pillars of any democracy but what is the current status of affairs where our president is like a king with supreme powers over the other arms of governance and almost appointing everybody?

    The presidency: Why restricting us to discuss this institution? There are issues on the current excessive powers conferred to the president and we would like to have them reviewed. We might come up with a formula which can potentially affect the roles of top government officials including the president. The president is overprotected and above the law - we have concern on this and we need to discuss and give our opinions.

    The existing of the revolutionary government in Zanzibar: This is complete ridicule to democracy in Zanzibar. Revolutionary government is not elected, Zanzibar government is no longer a revolutionary government, it is the government of the people by the people. It is very illogical to continue calling it that way and even to maintain the revolutionary council in Zanzibar. We want to discuss this; this is not our national ethos at all. Why do you shield this from being discussed?
    Tanzanians have a right to discuss and determine what the national ethoses are. The committee which prepared this bill went beyond to almost drafting the constitution. How did they arrive at the list? Is the list exhaustive? Is it superfluous? Are things therein really national ethoses? Does it lack some more things of key concern to Tanzanians?
    [FONT=&quot]5. The commission report shall be submitted to the president ..... and after considering the report.......[/FONT][FONT=&quot]
    Assuming the commission will do an excellent job of collecting, compiling and coming up with initial proposals (report) reflecting the will of the people but somehow contrary to the will of the president. The bill has given so much power to the president, he has discretion to accept the report, reject some parts of the report or the whole of the report. How can we be ensured that this process is going to have an absolute buy in by the president at the end? The process depends on the president!

    6. Constituent Assembly will be appointed by the president.
    Same issues as in 1 above. The assembly is likely to reflect the will of the president and his party. There is no ensured impartiality in the process all things will be at the mercy of the president, his party and aides!

    7. The referendum shall be organized by NEC (National Electoral Commission)
    NEC in the just ended election did not do a good job. How can we be sure that things will be different in the referendum? What measures are going to be in place to ensure that people's wills are safeguarded in the process? The commissioners of NEC are appointed by the president; the Constitution Commission will be selected by the president, why is the government encroaching the important and historical event which will lay a new foundation of our country? Why this control? What is the fear? After all we are all Tanzanians; there is not any one of us who is more Tanzanian than the rest.

    8. Referendum campaign shall be conducted by the commission and no political party or an affiliate organization to a political party shall participate in the referendum campaign

    The bill further imposes a punishment up to 2 years in jail for any individual violating this. The bill suggests to tighten mouths of people not to say their views or share their stand during the referendum. Who will represent the yes answer and who will represent the no? Who will speak for the yes and who will speak for the no? In any election there must be campaigns. If for example the commission and the president will come with a proposal not popular to people who will speak these realities?

    Conclusion:
    The government has hijacked the constitution process and there are clear indications that it will not offer its citizens a space to debate and come with a new constitution reflecting their will. If the government is not ready to accept the will of the people we would rather halt this process until at times such that we are sure the will of the people will be respected. Otherwise manipulating the constitution process will mark the end of our enviable peace we have enjoyed since independence. Those who are thinking they can still manipulate Tanzanians are on the wrong side of history. I would like therefore urge all Tanzanians to reject this bill with strongest terms possible until our rulers understand to respect peoples' voice.
