    KAMPUNI ya African Barrick Gold Mine, ina mpango wa kuanzisha mgodi mwingine wa dhahabu katika Kata ya Mwakitolyo, mkoani Shinyanga mapema mwakani.


    Mgodi huo utakajulikana kwa jina la Golden Ridge Project.Akizungumza na madiwani wa Halmashauri ya Wilaya ya Shinyanga juzi, Meneja wa Uhusiano wa kampuni hiyo, Philbert Rweyemamu, alisema utafiti uliofanyika katika eneo hilo, umethibitisha kuwapo kwa dhahabu ya kutosha kuanzishwa kwa mgodi.

    Alisema kwa sasa, kampuni inafanya tathmini kuhusu athari kimazingira na jamii na kwamba hatua hiyo inawashirikisha wananchi watakaohamishwa ili kupisha mradi huo.Alisema ushirikishwaji wa wananchi hao, unafanyika kupitia katika kamati mbadala inayongozwa na Mkurugenzi mtendaji wa halmashauri ya wilaya hiyo.

    Kwa mujibu wa Rweyemamu, kamati hiyo pia inajumuisha wawakilishi wa wananchi wa eneo hilo, wawakilishi wa kampuni na wakuu wa idara mbalimbali za serikali.
    "Kama utaratibu huu utasimamiwa na kutekelezwa vizuri, nina imani kikubwa kuwa utaondoa malalamiko ya wananchi kuhusu fidia, kwa sababu wananchi watashirikishwa ipaswavyo katika kila hatua,"alisema Rweyemamu
    Akizungumza kwa niaba ya madiwani, Mwenyekiti wa Halmashauri ya Wilaya ya Shinyanga, Amos Mshandete, alisema ziara hiyo itawasaidia kujifunza mambo mazuri yaliyofanywa katika uanzishaji wa mgodi wa Buzwagi.

    Alisema kitendo hicho kitawasaidia madiwani kupata uelewa wa shughuli za mgodi na hatimaye kushiriki kikamilifu katika kusimamia uanzishwaji wa mgodi huo mpya, jambo ambalo litapunguza kero za wananchi.

    "Kwa kweli tumepata picha nzuri itakayotusaidia katika kuanzishwa kwa mgodi wa Mwakitolyo utakaoanza kazi hivi karibuni," alisema Mshandete.Mgodi wa Mwakitolyo, upo umbali wa kilometa 100 Kusini mwa Jiji la Mwanza na kilometa 30 kusini Mashariki mwa mgodi wa Bulyanhulu.

    nachojiuliza ni9 kua je kuna mabadiliko angalau katika mkataba utakao tumika hapa au ni ile ile ya 3%??
    Hivi sisi wananch kama wamiliki halali kabisa wa hizi rasilimali tunaweza kuchukua hatua gani kupinga na kuhakikisha hikli halitokei kama hakuna benefiti za uhakika kwetu??

    Kila mara mgodi unapoanza una-sign dev agreement yake hivyo huu utakuwa na mkataba tofauti. Sasa ni jukumu la serikali yetu kuwa makini kubana kampuni. Tatizo kubwa la mikataba ya TZ ya madini ni kuwa Dev Agmt ina-overide Mining Code. Its a worst case scenario nadhani duniani na ukihudhuria mikutano ya madini nje ya TZ kati ya mifano mibaya kabisa kutolewa huwa ni pamoja na huu. Kama nina identification ya TZ huwa natamani kuivua maana watu wanakuzunguka kutaka kujua how can this happen and still work.
    Lakini private lawyers wa Africa wana umoja wao ambao wamejitolea kuandaa draft ya mikataba na kuipost kwenye website yao kwa nchi zingine kuweza kupata base ya kuanzia na kurekebisha watakavyo kwa ajili ya manufaa yao.
    Kama kawaida serikali ya TZ iliwakilishwa na WZ wao sijui hata kama ali-note hiyo link au kama hata aliisikia badala ya kuwakilishwa na watendaji.

    Tatizo kubwa hapa lipo kwenye utaratibu wa kupata hayo makampuni ya uchimbaji, kwanini serikali isiweke utaratibu wa ushindani inatangazwa na makampuni yanaomba na kila mmoja anatoa offer yake anayetoa offer kubwa yenye manufaa kwa nchi ndio anashinda na kuingia mkataba kama kiwango cha offer ndio hizi 3% ni bora waache ili wananchi waendelee kuchimba na kufaidi matunda ya nchi yao. TUMECHOKA KUIBIWA na kulaghaiwa na wanamagamba kwamba madini yanakuza uchumi wakati serikali mpaka inakwenda kukopa benki binafsi

    Then serikali ikope, iwakodi ma exparts wachahche (wengi wapo locally) na tufanye hii biznez on our own.

    kwa mantiki ya kkua sisi ndo wamiliki na wenye haki kuu kuliko mtu mwingine yeyote katika haya.

    Kihistoria tulisoma kua kulikua na passive na active resistance kwa wakoloni kipindi kile.
    Passive kwa sas ni kama watu wa nyamongo walivyo vamia mgodi wa north mara hivi majuzi (nawakubali sana wale jamaa).
    kama wanasiasa na viongozi wetu wameshindwa kututetea/wametusaliti kwa nini tusia chukue hatua wenyewe??

    Du hili ni janga...... Kwa hiyo hakuna hata provision kwenye sheria au hata kwenye mkataba ambayo inahitaji huyu mchimbaji ku-reclaim the land after the project.....maana kama ni hivyo basi tutegemee kuwa na mashimo na mahandaki yasiyo na idadi.........

    Nadhani mradi unaozungumwa hapa ni wa Golden Ridge, maelezo yaliopo kwenye tovuti ya www.africanbarrickgold.com ni kama ifuatvyo;

    The Golden Ridge exploration prospect is located in northwest Tanzania, in the district of Kahama, in the Shinyanga region. The prospect covers approximately 1,600 hectares and is located approximately 50 kilometres north of the Buzwagi gold mine and 34 kilometres southeast of the Bulyanhulu gold mine.

    Drilling and metallurgical test work will continue at Golden Ridge, and exploration work will likely target a new discovery or satellite deposits in the Golden Ridge area. The ABG Group believes that value can be best optimised by processing Golden Ridge's ore at other ABG Group mines.

    Usidanganyike...Sheria yetu mpya ya Mining ya 2010 meets many of the international standards including a clause and a set regulations specifically on mine closure. However implementation of these regulations kama unavyojua ni issue tofauti kabisa. Pili mining siyo lazma iache mashimo kama hayo, it depends on the type of mine (open cast au underground) and that is determined by the ore body.

    ALL new mining development agreements(MDA's) will be issued under the new mining act of 2010.

    The new Act is more restrictive than its predecessor and is consistent with other recent legislation which seeks to concentrate a greater interest in the hands of Tanzanian nationals with increased regulation in key sectors whilst continuing to encourage inward investment.

    Some of the publicly expressed concerns were due to the restrictions contained in the Initial Reading (such as reservation of mineral rights and licenses for dealing in minerals being reserved to Tanzanian citizens and corporate bodies under the exclusive control of Tanzanian citizens) which were subsequently relaxed by the provisions of the Amendments. However, the Act materially increase the levels of royalty payable to the GOT and places restrictions on non-Tanzanian participation in small scale mining, dealing in minerals and gemstone operations.

    There are concerns within the industry that the restrictions will have a negative impact on the Tanzanian mining industry both in terms of its competitiveness and as a magnet for foreign investment. However with a rising gold price I think these fears have been allayed.


    Key provisions of the 2010 Mining Act that are worth noting;

    The Act will introduce significant changes to mining policy, in particular the following.
    (a)

    Mineral rights and licenses for dealing in minerals will be reserved exclusively to Tanzanian citizens and corporate bodies under the exclusive control of Tanzanian citizens. It has been said that agreements/licences currently in force with non Tanzanian controlled mining companies remain unchanged but there is no clear "grandfathering" provision on this. The main point to note, however, is that the Amendments significantly mitigated the Tanzanian control issue in respect of general mining licences, and the restrictions will apply only to "primary mining licences", which are licences with respect to small scale mining operations involving capital expenditure of less than US $100,000. (Section 8 and Section 73)
    (b)

    Licences to mine for gemstones are only to be granted to Tanzanians, regardless of the size of the operation, except where the Minister determines that the development is most likely to require specialised skills, technology or a high level of investment in which case the licence may be granted to an applicant so long as the non- Tanzanian participation element is no more than 50% (Section 8(4)).
    (c)

    The Act gives the Minister power to prescribe a standard model form Mining Development Agreement for all projects exceeding US $100m. So far as we are aware no standard form has yet been prescribed. (Section 8(4))
    (d)

    The Act gives the Minister power to make regulations authorising the GOT to participate in the conduct and financing of mining operations and give the GOT a free carried interest, the level of which is not set by statute but rather by negotiation between the GOT and the relevant mineral rights holder (Section 10).
    (e)

    It amends the method by which GOT royalties are calculated so that they will in future be levied on the gross value of minerals, rather than the present method of calculation which refers to the net value (Section 87).
    (f)

    It increases the rates of royalties levied by the GOT on the gross value of minerals as follows:
    1. uranium – 5%
    2. gemstone and diamond – 5%
    3. metallic minerals (copper, gold, silver, and platinum group) – 4%
    4. gem – 1%
    5. in the case of other minerals, including building materials, salt, all minerals within the industrial minerals group – 3%. (Section 87)
    (g)

    Although some writers have asserted that the Act imposes an obligation for mining companies to list on the Dar es Salaam Stock Exchange, whilst the Act does refer to the Minister having the right to make regulations relating to a public offering, provisions for doing so are not contained within the Act itself. (Section 109)
    (h)

    The Act requires a greater degree of disclosure by the holders of mineral rights in respect of reports, records and general information. (Section 100 and Second Schedule)
    Arguably the changes to be introduced by the Act will consequentially affect Tanzanian's ability to attract foreign direct investment and indeed some of the provisions may reduce its competitiveness. However, if sector participants take a holistic view as to the mining investment parameters (including by reference to not only royalties levied but also income tax rates, withholding tax rates, capital deduction allowances, the right to carry forward losses and import / custom duties) as against Tanzania's regional competitors, Tanzania is relatively comparable in its investment regime.
