Former Detroit Mayor, Kwame Kilpatrick illegally used the nonprofit Kilpatrick Civic Fund like a piggy bank to pay for crisis consultants, a Cadillac, trips -- even summer camp for his kids -- a federal grand jury said Wednesday, charging the former mayor with 19 counts of fraud and tax evasion.

The indictment comes comes seven years after Internal Revenue Service and FBI agents began looking into the fund in the wake of a Free Press report that a homeless shelter operator gave the fund $50,000 during Kilpatrick's first run for mayor in 2001. The newspaper reported that Kilpatrick then wrote a letter recommending the shelter receive a multimillion-dollar public contract.

Despite Kilpatrick's repeated claims to the contrary, the indictment says he used fund money for campaign and personal expenses, ranging from polling to yoga and golf lessons to college tuition for relatives.

Prosecutors contend he failed to report more than $640,000 in taxable income while mayor that he received in the form of cash, flights on private jets and perks paid for out of the civic fund.

"This indictment sends a clear message that those who make up their own rules based on fraud and deceit will be prosecuted," said Maurice Aouate, head of the IRS Criminal Investigation Division in Detroit.

The indictment did not include public corruption charges, a point Kilpatrick spokesman Mike Paul seized upon.

He called speculation that the former mayor was involved in bribery schemes "lies from the pit of hell!"

"The FBI found nothing remotely close to that in their investigation because it never happened! This investigation puts an end to the ridiculous rumors that the mayor was personally involved with corruption, payoffs and bribes."

DETROIT -- Ex-Detroit Mayor Kwame Kilpatrick has been indicted on federal fraud and tax charges.
Federal prosecutors said the alleged scheme is related to the Kilpatrick Civic Fund, a tax-exempt fund that was supposed to pay for voter education and other purposes.​

Instead, the 40-year-old is accused of using it as a slush fund to take cash payments for himself, friends and relatives.​

He is faced with 10 counts of mail fraud, three counts of wire fraud, five counts of filing a false tax return, and one count of tax evasion.​

Each fraud count carries a maximum sentence of 20 years imprisonment and a fine of $250,000, and each tax count carries a maximum sentence of three or five years and a fine of $250,000.​


Kilpatrick's indictment alleges that beginning in 1999, Kilpatrick devised a scheme to use the Kilpatrick Civic Fund to pay for personal expenses and to fund his mayoral campaigns in 2001 and 2005.​

The government said he used the money to pay for yoga and golf lessons, golf clubs, summer camp for his kids, personal travel, a lease on a Cadillac DeVille, moving expenses, as well as "counter-surveillance and anti-bugging equipment."​

The indictment also lists Kilpatrick using fund money for a crisis manager to oversee his public image and for polling and focus groups.​

He is also accused of failing to report at least $640,000 in taxable income between 2003 and 2008, which includes money, private jet flights and personal expenses paid by the civic fund.​

In reference to a 2004 tax return, the indictment states: "It stated on line 22 that his total income was $188,227, whereas, as he well knew at that time, his total income was in excess of that amount."​

In 2008, Local 4Defenders broke the story that as many as 25 people were being federally investigated for city corruption involving missing money, kickbacks and bribes.​

Local 4 has learned that Detroit businessman and former Cobo Center contractor Karl Kado said in sworn statements that he not only paid Bernard Kilpatrick nearly $300,000 but also paid Kwame Kilpatrick more than $100,000 in illegal cash payments and his aide, Derrick Miller was paid $20,000.​

The allegations were made in sworn statements that are part of a wide-ranging corruption probe.​

Kado pleaded guilty to making false statements on his tax returns. He was sentenced to three years probation for his cooperation in the city hall corruption probe.​

The dumbest thing of all is that this guy was so in denial that even after his original problems became public, he could not curb his addiction to risky behavior, knowing well that he was under extraordinary scrutiny.

To add insult to injury, he was talking to judges in a very arrogant manner BEFORE sitting for his trial, I mean how dumb/ in denial can one person be? Even the legendary cocksure swindler Governor Blago, with his Comical Ali like denial, wasn't that much of a dummy.

Karma is a bad bytch, and Kwame now has to pay for all those wild parties, the philandering, the high life at the expense of the hardworking taxpayers.

I have no sympathy for him and his likes.

Indictment's timing may hurt Kilpatrick in primary

One Michigan politician doesn't have the luxury of distancing herself from the latest blow to former Detroit Mayor Kwame Kilpatrick: his mom.

U.S. Rep. Carolyn Cheeks Kilpatrick said in a statement Wednesday that the news of her son's federal indictment was "devastating."

"As a mother, I hope for the best for my son and will always be there for him," she said. "Beyond that, I have no further comment."

Kilpatrick testified twice before the federal grand jury investigating her son.

The timing of the indictment couldn't be worse for the congresswoman's political future. After barely surviving the 2008 primary election in the heat of her son's text message scandal, Kilpatrick faces another challenge to her job in the Aug. 3 primary.

"Certainly, this could be a death blow to his mother's political career," Lansing political consultant Robert Kolt said. "But her advantage is that there are so many other people in the race" who will split the vote.

There are five other Democrats -- John Broad of Grosse Pointe Farms, Vincent Brown of Garden City and state Sen. Hansen Clarke, Stephen Hume and Glenn Plummer, all of Detroit -- and one Republican, John Hauler of Grosse Pointe Woods.

Clarke, by far, is the most well-known challenger in the overwhelmingly Democratic congressional district. He said he wouldn't make an issue of the indictment in the remaining weeks of campaigning.
"But the perception is growing that Detroit politicians are crooked," he said. "So I have to work harder to prove to people that they can have a congressman who works for them and not in their own self-interest."

Detroit voters comprise a majority in the 13th District, which also includes the Grosse Pointes and the Downriver suburbs of Ecorse, Lincoln Park, Wyandotte and River Rouge.

Damn..this dude just can't catch a break! But all of what's happening to him now he brought it all on to himself. I expected him to know better since he is a lawyer by training but he probably thought he was untouchable, that mommy is a congresswoman and daddy is a prominent businessman and he is the mayor...he probably thought he had the whole world wrapped around his pinky finger that he could do whatever the hell he wanted to do and get away with it and perhaps he ruffled a few feathers along the way. Oh well..if he did the crimes then he must do the time.

He entered the courtroom in orange scrubs, white socks and flip-flops, steel cuffs on his ankles. He confirmed for the judge that he could not afford an attorney...In many ways, a typical defendant.

But Kwame Kilpatrick stood out Tuesday in U.S. District Court.

As family members watched, a somber Kilpatrick was arraigned on 19 counts, from fraud to tax evasion. A grand jury issued the charges last month, alleging that the ex-Detroit mayor looted the nonprofit Kilpatrick Civic Fund to underwrite his lavish lifestyle.

Kilpatrick said little in five minutes in court. A not-guilty plea was entered on his behalf.

As Kilpatrick was escorted out of the hearing by a U.S. marshal, he looked over his shoulder at supporters, patted his chest twice, and left.
Friend and former assistant DeDan Milton -- facing a 3 1/2 -year sentence in federal prison for taking bribes while working for Kilpatrick -- was there.

Outside, Kilpatrick's sister, Ayanna, told reporters: "Stay up, Detroit family, friends, 'cause we are. It's all in God's hands. He has complete control over the situation."

James Thomas, Kilpatrick's lawyer from the text message scandal, was appointed Tuesday to defend him -- at taxpayer expense.

"Obviously, he's not comfortable; how could anybody be, if you come in in shackles?" Thomas said. "Mentally, I think he's strong."

Kilpatrick is expected to stay in the St. Clair County Jail while Thomas works to get him transferred to the federal prison in Milan.

From the whole process and situation it is evident that Kilpatrick as well as the family know
that there is NO turning back and more so.. No mercy to look forward to.. The Plea for
not guilty is just a ruse (and may be a hope that the sentence be reduced...) As much
as he did what he did i feel for the man... for maybe he was so confident of himself and
position that was to unlucky nor intelligent enough of Knowing where and when to cross the line...
It is common knowledge leaders from such positions do a lot of compromising the laws and using
them to their benifit - Whether be it for persona benefits or money laundry.... The only defference
between those not yet caught and him is that Kilpatrick compromised it once, Succeeded and kept
on compromising until the compromising seemed to be proper than most; thus the probable fatal end...

Too bad he is kind of rude and too much kujiamini - thou sasa imepungua if you compare
him to the early stages of the indictment....
