    Mamlaka ya Mapato Tanzania (TRA) imezuia kwa kuweka makufuli katika lango la kampuni ya kufua umeme ya Aggreko Dar es Salaam jana, baada ya kuwapo taarifa inahamisha kinyemela mitambo yake na kuipeleka nje ya nchi, kwa lengo la kukwepa kulipa deni la Sh bilioni 10 inalodaiwa na mamlaka hiyo.

    Kwa mujibu wa taarifa zilizolifikia gazeti hili kutoka chanzo cha habari ndani ya TRA juzi na jana, zilidai kuwa Aggreko inadaiwa Sh 10,117,558,321 ikiwa ni deni la kodi ya miaka mitatu ya uzalishaji umeme nchini. TRA ilithibitisha Aggreko kudaiwa deni ingawa hawakuwa tayari kusema ni kiasi gani, kwa kuwa ni mkataba wa siri kati yake kampuni hiyo ambayo wanaitambua kama mlipakodi wao.

    “Tangu wameingia hapa nchini hawa wawekezaji ambao waliitwa kutokana na dharura iliyolikumba taifa kipindi cha nyuma, hawajawahi kulipa kodi, na tumefanya nao mikutano bila mafanikio, tumewaletea taarifa za maandishi, hawajaonyesha kujibu,” kilisema chanzo chetu cha habari.

    Katika eneo la tukio jana, tafrani ilizuka wakati maofisa wa TRA pamoja na wa Kampuni ya Majembe Auction Mart, walipofika wakiwa katika magari ya kawaida na kuwaamuru walinzi wafungue mlango mkuu wa kuingia ilipo mitambo hiyo.

    Kutokuelewana kulianza pale walipogundua kuwa ni maofisa wa TRA na wanahitaji Mkuu wa eneo ili waamuru wafanyakazi wake watoke ndani, kwani mtambo huo unafungwa hadi deni hilo litakapolipwa; ndipo walinzi walipotaka kuwatoa kwa nguvu maofisa na wanahabari, jambo lililozua zogo bila mafanikio ya kuwaondoa.

    Mpelelezi Msaidizi wa TRA aliyekuwa eneo la tukio, Kalist Lyimo aliwaambia waandishi wa habari kuwa TRA imekuwa ikiidai Aggreko deni kubwa (bila kutaja kiasi) la miaka mitatu kuanzia mwaka 2006 na hatua ya kufunga ofisi za mtambo huo ni kuzuia mtambo wowote kutoka nje ya hapo mpaka deni lilipwe.

    Alisema hatua hiyo imefanyika baada muda wa kulipa fedha hiyo waliokubaliana katika mkataba kumalizika tangu Novemba 26, mwaka huu na pia baada ya kupata taarifa kwamba baadhi ya mitambo inahamishwa kinyemela usiku kwenda nje ya nchi (hakutaja sehemu).

    Aidha, Msimamizi Mkuu wa Uendeshaji wa kampuni ya Aggreko Kituo cha Ubungo Maziwa, Dar es Salaam, Shaughen Tyreman alipotakiwa kutoa ufafanuzi kuhusu deni hilo, aligoma kusema kwa kisingizio kuwa si msemaji, ila alikiri mitambo inafunguliwa tayari kusafirishwa kwenda Dubai.

    Juhudi za waandishi katika eneo la tukio zilifanikiwa kusoma waraka wa agizo lililoitaka Aggreko ikubali deni na kuondoka katika mtambo huo likionyesha kampuni hiyo inadaiwa Sh bilioni 10.11. “Sina neno la kusema kuhusu suala hilo, ondokeni ondokeni eneo hili ni la hatari kwenu tafadhali, mimi si msemaji, hapa tunafungua mitambo tunaipeleka Dubai, ni hatari kwenu, ondokeni………,” alisikika akimaka msimamizi kuyo.

    Baadhi ya wafanyakazi wa kampuni hiyo walikumbwa na mshangao na kushindwa kuendelea kufungua mitambo hiyo na walipoulizwa, walisema hawakuwa na taarifa zozote za ujio wa TRA na wanachofahamu ni kwamba Aggreko imekuwa ikiwalipa mishahara yao bila matatizo na wanastaajabu kama kweli deni hilo wanadaiwa au wapo wakubwa wanaohusika.

    Akizungumza na wanahabari ofisini kwake, msemaji wa TRA ambaye pia ni Mkurugenzi wa Huduma na Elimu kwa Walipa Kodi, Protas Mmanda alithibitisha mamlaka hiyo kuchukua hatua hiyo baada ya muda wa kulipa deni kupita. “Muda ulishapita wa wao kulipa tangu Novemba mwaka huu na wanataka kuondoka, lakini bado tunamdai kodi, tulishawapa taarifa mara mbili hii ya tatu, lakini hawajachukua hatua yoyote,” alisema Mmanda.

    Hata hivyo, alisema wanaifahamu Aggreko kama mlipa kodi wao na kama alishindwa kulikuwa na hatua ambazo alipaswa kuchukua kama vile kupeleka malalamiko kwa Kamishna endapo aliona deni hawezi kulipa ili utaratibu mwingine ufanyike, lakini siyo kuanza kufungua mitambo na kuondoka. Meneja Mawasiliano wa Tanesco, Badra Masoud aliliambia gazeti hili jana kuhusu tukio hilo kuwa shirika hilo lilikwishamaliza mkataba na kampuni hiyo na kwamba halihusiki kwa namna yoyote na deni hilo.

    Aidha, wakazi wa Ubungo Maziwa, waliokuja eneo la tukio kushuhudia zoezi hilo waliieleza HabariLeo kwa nyakati tofauti kuwa wanashuhudia mitambo ikihamishwa usiku kwa magari makubwa, lakini walikuwa hawajui kinachoendelea. Aggreko ni miongoni mwa kampuni zilizoingia nchini mwaka juzi kutokana na tatizo la umeme lililoikumba taifa na kutakiwa kufua umeme wa dharura wa megawati 40. Hata hivyo, serikali ilishasitisha mkataba wa kuzalisha umeme huo wa dharura kupitia Shirika la Umeme la Tanesco tangu Novemba mwaka huu.

    KAMPUNI ya Aggreko jana ilikuwa kwenye kizaazaa na Mamlaka ya Mapato (TRA), baada ya maofisa wake na wa Kampuni ya Udalali ya Majembe Auction Mart kuvamia ofisi za kampuni hiyo ya kufua umeme wa dharura na kusimamisha zoezi la ufunguaji mitambo, kwa madai kuwa ilitaka kutorosha kisiri wakati ikiwa haijalipa kodi ya zaidi ya Sh10 bilioni.

    Sakata la Aggreko na TRA lilitokea jana kuanzia majira ya saa 3:00 asubuhi katika maeneo ya ofisi za kampuni hiyo zilizoko Ubungo, ambako maofisa wa TRA walienda eneo hilo na kukuta mafundi wa kampuni hiyo wakiipakia mitambo hiyo kwenye kontena tayari kwa safari baada ya kupata taarifa kuwa kulikuwa na mipango ya kuitorosha.

    Kampuni hiyo, ambayo imemaliza mkataba wake na Shirika la Umeme (Tanesco) tangu Novemba 26, ilitakiwa iondoe mitambo yake katika eneo hilo, lakini baada ya kulipa deni hilo.

    Habari zinadai kuwa, maofisa wa TRA walipopata taarifa za kuondolewa kwa mitambo hiyo bila ya kushirikishwa, waliamua kupeleka notisi ya kuzuia isiondolewe mpaka kampuni hiyo ikamilishe deni hilo na kuishirikisha kampuni ya Udalali ya Majembe Auction Mart ambayo hufanya kazi za TRA za kupiga minada nali za wanaoshindwa kulipa kodi.

    Hata hivyo, msimamizi mwendeshaji wa kampuni hiyo, Shaughn Tyreman, alijaribu kukwamisha zoezi hilo alipojaribu kuwafukuza maofisa wa TRA na wa Majembe Auction Mart kwa madai kuwa wameingilia kazi zake.

    "Nimesema ondokeni, sitaki kumuona mtu wala kuongea na ninyi katika eneo hili, waacheni mafundi waendelee na kazi zao mnawapotezea muda, mmewasimamia sana hadi wanashindwa kufanya kazi zao, nasema ondokeni," alisema huku akiita walinzi ili wawaondoe maofisa hao wa TRA na waandishi wa habari.

    "Kama kuna madai yoyote, subirini nje akija mkurugenzi mtazungumza naye na sio humu ndani, hatutaki kuwaona."

    Akizungumza na waandishi wa habari katika eneo hilo, mpelelezi mwandamizi wa TRA, Calist Lyimo alisema, Aggreko walikuwa wanafahamu muda mrefu juu ya deni hilo, lakini hawakutaka kulipa.

    Alisema tangu kampuni hiyo ianze kazi ya kuzalisha umeme nchini mwaka 2006/07 haijawahi kulipa kodi ya Ongezeko la Thamani (VAT), haijalipa kodi ya PAYE (lipa kadri upatavyo) kwa mwaka 2006 hadi 2007 na kodi ya SDL kwa mwaka 2006 hadi 2008, hali ambayo imechangia deni hilo kuwa kubwa.

    Alisema TRA iliwapelekea notisi ya madai ambayo iliwataka walipe deni hilo kwa kuwa wamo kwenye orodha ya makampuni yanayolipa kodi nchini na Aggreko waliipokea notisi hiyo, lakini hawakulipa fedha hizo.

    "Aggreko wanafahamu kuwa, wanadaiwa kwa sababu walikuwa wakipokea notisi zetu za kuwataka walipe deni hilo kwa muda mrefu, lakini wameshindwa kutekeleza. Hii imechangia deni hilo kuwa la muda mrefu na kuongezeka. Kutokana na hali hiyo, hatuwezi kuwaruhusu waondoe mitambo bila ya kutupa malipo yetu," alisema Lyimo.

    Kachero huyo wa TRA alisema kutokana na hali hiyo, TRA iliamua kuiagiza kampuni ya Majembe Auction Mart kuzuia mitambo hiyo. Alisema zoezi la kuhamisha mitambo hiyo lilianza tangu wiki iliyopita na kwamba baadhi ya mashine zimeshafunguliwa na kupakiwa kwenye makontena tayari kwa safari ya Angola.

    Akizungumza na Mwananchi jijini Dar es Salaam jana, Meneja Uhusiano wa Tanesco, Badra Masoud alisema kampuni yake ilishavunja ndoa yao na Aggreko tangu Novemba 26 mwaka huu, hivyo kama walikuwa hawalipi kodi, Tanesco hawafahamu.

    Badra alifafanua kwamba, mpaka sasa hawana mpango wa kuendelea na mkataba na Aggreko, hivyo walitakiwa waondoe mitambo yao kutoka eneo hilo.

    "Wanatakiwa waondoe mitambo yao, kama walikuwa hawalipi kodi ya mapato sisi hatujui na wala hayatuhusu," alisema Masoud.

    Aliongeza kwamba, wao hawawezi kushirikishwa kwenye deni hilo kwa kuwa kila mmoja alikuwa na mkataba wake ambao ulikuwa unamfanya alipe kodi kulingana na maelezo ya mkataba huo, hivyo Aggreko walipaswa kulipa deni hilo kabla ya kuwa kubwa.

    Alisema tangu waanze kununua umeme Aggreko, hawajahi kukopa na hivyo kama wangekuwa wanalipa kodi, deni lisingekuwa kubwa hivyo.

    Naye Mkurugenzi Mkuu wa Majembe Auction Mart, Seif Moto alisema kuwa mgogoro wa TRA na Aggreko ni wa muda mrefu kutokana na kampuni hiyo ya ufuaji umeme kudai kuwa deni hilo ni la serikali na si la kwao.

    "Wanajua kama wanadaiwa, lakini ukiwafuata watakuambia deni hilo ni la serikali wao ndio wanaojua juu ya mitambo hii na kuchukua notisi hiyo bila ya kuifanyia kazi, hivyo hatuwezi kuwaruhusu waondoke bila ya kulipa," alisema Moto.

    Alituhumu kuwa Aggreko walitaka kuhamisha mitambo bila ya kulipa deni hilo, lakini wamebaini na hivyo watahakikisha wanalipa deni hilo kabla ya kuondoka.

    Kampuni ya Majembe ilifunga kufuli katika milango ya Aggreko kwa lengo la kuwataka wasiondoe mitambo hiyo mpaka watakapokamilisha deni hilo.

    Aggreko walivunja ndoa yao na Tanesco mwezi Novemba mwaka huu baada ya kuisha kwa mkataba wa ufuaji umeme wa dharura.

    Serikali ilisaini mkataba na Aggreko tangu Aprili 2006. Katika mkataba huo Wacanada hao walitakiwa kuzalisha umeme ambao utakidhi mahitaji ya wananchi.

    Kuvunjwa kwa ndoa ya Aggreko na Tanesco ni mwendelezo wa mikakati ya serikali ya awamu ya nne, chini ya Rais Jakaya Kikwete, kutengua mikataba yote mibovu isiyonufaisha nchi. Tayari mkataba wa Dowans, ambayo ni mrithi wa Richmond, umesitishwa huku kukiwa na mchakato wa kuvunja mkataba na IPTL.

    Aggreko ni kampuni makini najua watakuwa na Investors Certificate lakini kwenye VAT sidhani kama kuna mjadala unless viongozi wetu wa Energy & Minerals katika kuwapa Richmond mkataba wa kifisadi walisahau na kuwasainisha Aggreko kataba huo huo kwi kwi

    Also TRA wanaweza kutuambia Richmond/Dowans na wao vipi?? walikuwa wanalipa hiyo VAT au????

    Kuna mambo yanafanyika nchi hii ya kustaajabisha mno. Inawezekanaje hawa hawajahi kulipa kodi? Mswahili na kikampuni chake akichelewa kulipa kodi, atatozwa fidia, au sivyo?

    Mpaka 'mwekezaji' anaanza kuihamisha mitambo yake ndiyo tunashtuka....
    Kweli kuna watu wanaweza kuthubutu!

    Well, tangia tusahau what it all meant na kupoteza uelekeo tusitegemee kupata anything better!! Hivi mnajua kuna watoto wapo sekondari na hawajui hata kuimba wimbo wa taifa wanabaki wanamumunya maneno? Zamani hii ilikuwa ni bakora kwa kwenda mbele....

    Ministry now intervenes in Tanesco-Aggreko tax row

    The Ministry of Energy and Minerals has has formed a committee to look into a power supply contract between Aggreko and the Tanzania Electric Supply Company (Tanesco).

    Minister William Ngeleja told reporters in Dar es Salaam yesterday that the committee would seek to establish circumstances that led to a tax dispute with the Tanzania Revenue Authority (TRA) to find out whether Aggreko or Tanesco was wrong and what should be done to end the standoff.

    However, he said the ministry was not involved in the contract and therefore it should not be viewed as a party to the dispute.

    The row over more than Sh10 billion in taxes broke out last week with a dramatic seizure by a court broker of the power company�s turbines.

    The broker, acting on behalf of the TRA, sent its agents with a court order to block Aggreko from moving the turbines from the site at Ubungo power station in Dar es Salaam, where the company has been producing power for the past two years until the disputed tax is fully paid.

    TRA is accusing Aggreko of planning to relocate the turbines out of the country without paying tax, a move that was also hotly contested by the company whose contract with Tanesco expired last month.
    Mr Ngeleja said the committee would review legal aspects of the Aggreko contract before announcing its findings and recommendations.

    "If Aggreko owes TRA, then it should clear the debt because the task of TRA is to collect public tax revenue," he said.

    The dispute is similar to another one by a different independent power producer, Alstrom Power Rentals Limited of US that is also involved in a tax row with TRA.

    Alstroms case is still pending even as TRA moved to attach the Aggreko equipment.

    Aggreko is one of the companies that came into the country at the height of a power crisis in early 2006 and entered into a one-year contract to supply 40MW of power to Tanesco starting November of that year.

    The contract was renewed for another year before expiring in November.

    There was no official comment from Aggreko or TRA yesterday on the progress being made to solve the row involving the two parties.

    there you are. na hawa TRA walikuwa wapi muda wote toka 2006? Aggreko walikuwa hawa-file returns TRA? TRA walitakiwa kufuatilia toka day one kwa sababu kampuni hii ilikuja kuzalisha umeme wa dharura hivyo ilikuwa nchini temporarily. TRA pia wanawajibika kwa kutokusanya kodi mapema toka kwa hawa jamaa.

    Aggreko backs down in tax tussle

    A private power company, Aggreko, which is entangled in a protracted tax evasion dispute with the Tanzania Revenue Authority (TRA), has finally agreed to settle its unpaid dues to put an end to a year-long tussle.

    TRA is accusing the United Arab Emirates based power producer of not remitting tax amounting to Sh10 billion to the Government since 2006.

    The Government, through Tanesco, contracted Aggreko to produce 40MW electricity in the country at the height of the 2006 power crisis.

    But since then, the tax collection body claims, the Scottish company evaded tax despite several reminders to do so.

    Aggreko had been declining to pay the demanded amount on grounds that in its two-year contract with Tanesco, the latter is responsible for all taxes and other related costs.

    It also argues that it could not have made profits within two years attracting such huge taxes from TRA.

    The dispute took a new twist last week when the company moved to the Tax Revenue Appeals Board (Trab) to oppose the tax evasion claims and compel TRA determine and admit a notice of objection it filed late August this year.

    This was after TRA had secured a court injunction barring the company from relocating its properties and offices from Ubungo.

    Court brokers seized Aggreko�s turbines at the Ubungo (Tanesco) Power Plant after TRA alleged that the private power company was attempting to take them out of the country without settling its unpaid taxes.

    Following this development, the power company decided to seek the intervention of the tax appeals board.

    But before the appeals board had determined the matter, Aggreko made a surprise about turn and approached TRA seeking an amicable resolution of the dispute.

    The company undertook to pay Sh5.1 billion- about half of the disputed sum- which includes Sh2.7 billion in unpaid taxes plus a penalty of Sh2.4 billion.

    The Sh2.7 billion is the sum of unpaid pay as you earn (PAYE); and skills and development levies.

    On Friday, Trab blessed the agreement between the two but ordered the company to refrain from moving its turbines and other equipment from Ubungo until an objection to the assessment of the demanded taxes was determined and taxes were paid in full.

    In addition, the board ordered Aggreko to give TRA officers access to its premises and plants to conduct inspections.

    Prior to last Friday's order, TRA officials were not allowed to enter the power company's premises.

    Apparently, TRA is taking a cautious route after the Scottish company allegedly backed down on its earlier promises to have settled the money by end of November, this year.

    However, the board ordered TRA to lift a Warrant of Distress it had issued against Aggreko earlier this month subject to conditions that the company first settled the agreed amount.

    The tax agency was also told to acknowledge Aggreko's notice of objection to the Sh10 billion assessed for 2006 and 2007; and to determine it accordingly under conditions that the amount agreed by the parties was first settled.

    In its argument against paying the taxes, Aggreko has been citing Clause 3.4 of its contract with Tanesco, which states that the latter is responsible for all taxes and any other related charges.

    According to the company, negotiations of the contract and all matters agreed under it, including charges, fees and costs of the company were done with reference to and in consideration of the said clause.

    The agreement, Aggreko argued, was to ensure the availability of power to people at the lowest possible cost. For this reason, the company said tax demands for 2006 and 2007 income were "unjustified".

    It also said Tanesco did not dispute its contractual obligation to pay all the taxes as stated under the contract, and that it had evidence the state-run power utility repeatedly admitted in writings its obligation.

    Aggreko's attempts to have TRA take the tax issue with Tanesco have been without success, although it says sometimes Tanesco paid the disputed taxes.

    And on the removal of turbines from Ubungo the company said: "We performed our part of the contract successfully and as the contract period expired, we were in the process of decommissioning the plant pursuant to clause 3.10 of the contract."

    Aggreko, Glasgow-based temporary power firm said it had signed a deal with the Tanzania Electric Supply Company to provide 100MW of power for 12 months.

    Aggreko will supply two 50MW diesel-powered plants at Ubungo and Tegeta, as well as manage fuel supply.

    Aggreko said the exact value of the contract would depend on the monthly price of diesel and the amount of power generated. The firm will charge "a small fee" for managing the fuel supply.

    The Scottish firm said the addition of 100MW of power would help stabilise the country's power supply and support continued economic growth while the Tanzania Electric Supply Company worked to implement long-term solutions to improve power generation and distribution.

    Aggreko chief executive, Rupert Soames, said: "Having successfully delivered 40MW of emergency power between 2006 and 2008, we are delighted that - following a competitive tender process - we have once again been selected to be of service to Tanzania." This latest contract will take Aggreko's order intake in the first six months of 2011 to at least 630MW.

    Miezi michache iliyopita nchi imekosa mapato ya shilingi bilioni 500 kwa uzembe wa TRA baada ya Airtel kuinunua Zain lakini wako kimyaaaa!!! Pesa hii ingetosha kabisa kununulia mtambo kama wa Dowans ili kuiwezesha TANESCO kufua umeme wake wenyewe na kuachana na hii mikataba iliyojaa ufisadi, lakini TRA hawasemi chochote kuhusu uzembe huo wa hali ya juu lakini wameshupalia posho ya Dr Slaa ya shilingi milioni 7 na laki tano!
