    Ndugu wapedwa kaka na dada wasomi.nimeandika kichwa cha habari hicho nikiomba ufafanuzi wenu wa kisheria kuhusu matamko ya wanasiasa yanayotolewa kwa watu waliojenga kwente ama hifadhi za barabara au maeneo mengine yasioruhusiwa lakini idara husika zimekuwa kimya hata baada ya kupita miaka zaidi ya 12 na daabaye wanaibukia na kuwaabia watu hao waondoke au kuwavunjia bila fidia je ni sahihi?

    Mkuu kwenye kila wilaya au mji au jiji kuna ramani ambayo ni master plan ya jiji au mji au wilaya nzima
    Master plan hiyo inaonyesha maeneo yote ikiwemo hifadhi za barabara, maeneo ya wazi, viwanja vya shule au maeneo ambayo ni proposed schools or college or hospital
    Sasa kabla ya kujenga au kununua kiwanja wataalam wanashauri kwanza kufanya due diligence ya eneo husika
    Ujue mipaka yake na matumizi yake na ndo maana muuzaji wa kiwanja anakuuzia "as it is" na anakuambia wazi kuwa yale aliyokuambia ndo anayoyajua na ni ya kweli
    Kama kuna mengine wewe wapaswa kuchunguza
    Sasa unaponunua sehem au kurithi sehem ambayo may be ni hifadhi ya barabara, wenye ardhi ambao ni serikali wanajua kuwa wewe ushafanya due diligence ukajua kuwa hili ni eneo la hifadhi ya barabara na uko pale kama mkaaji wa muda tuu na muda wowote unaweza kuondolewa watakapohitaji barabara au eneo lao
    Maeneo haya hio issue ya adverse possession haiapply kwa kuwa toka mwanzo eneo sio lako na you can not claim what you dont have
    So la kukushauri hapo ni kuwa makini sana unapouziwa eneo fanya uchunguzi wako binafsi kabla ya kukubali kununua eneo hilo kutoka kwenye ngazi zinazohusika maana usije ukaishia kutamani cake ambayo sio yako toka mwanzo
