      Kabogo ‘slapped Mercy Keino during party’

      Juja MP William Kabogo slapped university student Mercy Keino before she stormed out of a party and subsequently met her death, an inquest has been told.

      Ms Scolastica Namwai Kamemba, Ms Keino’s friend, was the last person to see the University of Nairobi student alive on the fateful night of June 17, 2011.

      Ms Kamemba told the inquest that the MP got annoyed when Ms Keino started shouting and moving about the Wasini Luxury Homes where the party was being held and broke some glasses after taking too much wine.

      He slapped her several times, stated Ms Kamemba. “Mr Kabogo started slapping her while asking who had brought her to the party. Mercy got very scared and wanted to run away but some security officers and the MP’s bodyguards grabbed her and took her to the gate,” Ms Kamemba said.       She followed Ms Keino to the gate and tried to calm her down, but she ran towards Waiyaki Way in Westlands.

      Ms Kamemba said the MP’s bodyguards agreed to help her bring back Ms Keino. They followed the student and found her standing in the middle of the road.

      When they got back to Wasini Luxury Homes, the security guards denied them entry and they sat on the pavement.

      Ms Kamemba said she then tried to ask Ms Keino for her phone to call her boyfriend, but she shoved her aside and took off. And that was the last time she saw her friend alive.

      Ms Kamemba testified that she returned to the party and that when she asked Mr Kabogo to assist her trace where Ms Keino had run to, he refused, saying he was fed up with her behaviour.

      The MP then told her to board a pick-up to drop her home. She then called Ms Keino’s boyfriend, but he said they would look for her the next day if she did not find her way back to the hostels.

      Ms Keino did not show up and the next day they looked for her at three police stations but did not find her. Their search ended at City Mortuary where they found her body.

      Asked if she knew what killed her friend, Ms Kamemba said that they were told by a doctor who did the post-mortem examination that a vehicle ran over her.

      Ms Kamemba contradicted Ms Keino’s father who testified last week that his daughter did not take alcohol.

      Asked how they ended up at the party, Ms Kamemba said a friend had invited her and she decided to go with Ms Keino.

      “It was at my behest that Mercy went to the party. We were not aware who would be in attendance and just met Mr Kabogo after which we started general discussions before the night that turned tragic,” she said.

      She said she had not met Mr Kabogo before and that it was after he joined them at their table that she was informed he was an MP. The hearing continues on Tuesday.

      Police reconstruct student’s last moments




      Ms Mercy Keino, a student at the University of Nairobi died on Friday June 17 2011. Her body was found on Nairobi's Waiyaki way.

      The last moments of a university student whose body was found on a busy highway were on Wednesday re-enacted by police boss Mathew Iteere.

      Ms Mercy Keino, 25, whose death resulted in Juja MP William Kabogo being questioned by the police, was last seen walking towards the highway alone, Mr Iteere said.

      “Well past midnight, Ms Keino decided to leave and efforts by her cousin to stop her failed. She disappeared towards Waiyaki Way alone,” Mr Iteere said.

      The police report indicates Ms Keino was drunk on wine and whiskey, which was plentiful at the June 17 party also attended by the MP.

      The information is based on witness statements, including that of her cousin, Ms Scolastica Namwai Kamemba.

      On a statement by a motorist, Mr Iteere said: “He was driving to Uthiru to drop a friend and spotted a woman on the other side of the road frantically waving down a car. On coming back, he saw a body at almost the same spot where the lady was.”

      The party was at Wasini Luxury Homes on Church Road, Westlands, about 100 metres from Waiyaki Way.

      Twenty one people were at the party, 12 of them women aged between 20 and 25, according to the police.

      “Witnesses at the party said Ms Keino took a lot of wine and whisky, resulting in her shouting at everybody and breaking glasses.

      Twice she was thrown out of the venue,” Mr Iteere said. The investigation has so far not established how she died.

      “In the meantime, the investigation team has been boosted by two senior prosecutors appointed by the DPP to offer technical and legal advice,” Mr Iteere said.

      The investigation established how she happened to be at the party.

      Her cousin, Ms Kamemba, called and invited her at 6.30pm. Ms Kamemba had also been invited by a friend identified as Jacky.

      The cousins met in Hurlingham, caught a matatu and arrived in Westlands at 7pm.

      They were met at a petrol station by Jacky and two men who were strangers to the cousins.

      “One of the men took the names of the ladies, saying they would be required to enter,” Mr Iteere said.

      Mr Kabogo arrived later in the company of a man identified as Joram, according to the police.

      Earlier reports had indicated the body had been tossed out of a vehicle.

      Said Mr Iteere: “The vehicle has been traced and the owner says he spotted the body and slowed down to avoid running over it.”

      The police said the vehicle was inspected and found to neither have a dent nor repainted.

      Mercy Keino was killed elsewhere, inquest told

      NAIROBI; KENYA: University student Mercy Keino may have been murdered elsewhere and her body dumped on the road to fake an accident, an inquest into her death heard.

      A police officer who was the first to arrive at the scene yesterday told the court that when he reached the location, it gave an impression that a fatal accident had occurred but on further investigation the findings told a different story.

      The officer, Thomas Obogi, explained he realised that several things did not add up and concluded that there was foul play.

      “In the event of an accident, especially where a person has been hit by a vehicle, the scene normally has a pool of blood due to the impact. But in this case it was different since there was no blood at the scene,” he said.

      The investigating officer added that many accident scenes are usually strewn with personal properties and effects of the victims, which was not the case.

      “The skull of the deceased had also been ripped off. It appeared like the deceased had been killed elsewhere and her body dumped on the busy highway to make it look like an accident,” he told the court.

      The lawyers cross-examining the officer had asked him whether he had explored the possibility that the student had been hit by a speeding vehicle and flung several metres away from the exact scene of the accident, to which he responded he had covered a wide area surrounding the scene.

      No blood found

      “I surveyed the scene of the accident and its environs by walking for over 100 metres but there was no trace of blood anywhere and there was no sign of the missing skull,” he said.

      The officer added that in an ideal situation, two police officers are supposed to go to an accident scene but in that particular case he took a breakdown operator to check the reported incident.

      Obogi explained that on arriving at the scene and conducting preliminary investigations, he called for an ambulance to collect the varsity student’s body and take it to the mortuary. He corroborated the report by the breakdown operator that he (the operator) assisted the police officer to carry the body into an ambulance from the scene.

      “When the ambulance arrived I asked the breakdown operator to help me carry the body into the vehicle. The body was taken to City Mortuary,” he said.

      Juja MP William Kabogo, his driver and aides have been adversely mentioned in the student’s death, whose body was discovered on Waiyaki Way.

      Prosecutor in Mercy Keino inquest threatened

      The Deputy Director of Public Prosecution Moses O’mirera has said his life is in danger.

      Moses O’mirera, who is the prosecutor in the inquest into the death of university student Mercy Keino, told the inquest team he was being pushed to call witnesses who had been adversely named in the suit even before those who witnessed or had first account of the incident testified.

      O’mirera explained that rules of natural justice dictate that those adversely mentioned should be the last to testify.


      “I made this request at the beginning of the inquest to call witnesses adversely mentioned at the end of the inquiry. I feel intimidated. My life is in danger,” he said.

      He claimed some forces were pushing to have him out of the suit.

      The deputy DPP reminded the inquiry that the on-going probe was not a trial where the prosecution was determined to prove a case and added that he did not have a personal interest in the matter.

      At the beginning of the inquest, the prosecutor rejected attempts by lawyers representing aides of Juja MP William Kabogo who had been adversely mentioned take the witness stand.

      O’mirera claimed the defense was pushing him to take up witnesses when he was not ready.

      “We have all the contacts for the witnesses. We have tried to trace some of them but in vain while others are not picking calls. We have done everything humanly possible and it is evident we are not dragging this case,” he said.

      After mechanic Paul Ouma finished giving his evidence on Tuesday, the DPP sought for adjournment but lawyers representing Juja MP rejected the application. An attempt by Kabogo’s bodyguard to take to the witness stand created confusion as O’mirera said he had not asked him to because he was not ready to take his evidence.

      Kabogo, his driver and aides have been adversely mentioned in the death of the student whose body was discovered on Waiyaki Way.

      I had no role in Mercy Keino death - Kabogo

      Kiambu Governor William Kabogo yesterday denied any involvement in the mysterious death of Mercy Keino.

      Kabogo told a public inquest into the death of the slain University of Nairobi student that he did not insult her and claims by witnesses that he slapped her are “outrageous” and meant to “damage his character”.

      “I would have no reason to mishandle a lady . I tapped her on her face after she broke glasses and picture frames,” he said.

      Keino’s body was found on Waiyaki Way, less than two kilometres from Wasini Luxury Homes in Westlands where she had hang out with friends and Kabogo on the night of June 17 2011.

      Police were unable to solve the death mystery and an inquest was ordered by the Director of Public Prosecutions.

      Two witnesses had previously said in court that the governor slapped Mercy before she was ejected from a private apartment where he and three other girls were drinking.

      On September 11 2012, the caretaker of Wasini Apartments, Charles Macharia, said Keino was not able to walk by herself after Kabogo had slapped and stepped on her.

      He said Keino was carried out of the room bleeding from the mouth after being assaulted by Kabogo.

      Macharia said he came into the room with Kabogo’s guards and found Keino lying facing up on the floor.

      "She was was crying while the other girls pleaded with Mheshimiwa to stop,” Macharia said.

      Scolastica Namwai , Keino's cousin, also told the inquest that she invited her to the party and all was well until the 25-year-old got drunk and uncontrollable and Kabogo became “furious” when she started breaking things.

      "Kabogo was very angry. He stood up and grabbed her and asked her why she was throwing things. He slapped her couple of times on her face. It was very intense and Mercy got very scared." Namwai said.

      However yesterday, Kabogo said any allegation that he assaulted the lady is shocking and politically motivated.

      The governor said it was unfortunate Keino died and empathised with the family for losing a daughter who had a promising future.
