Kenya agrees to buy Iran oil, silent on sanctions





NAIROBI (Reuters) - Kenya has agreed to import 4 million tonnes of Iranian crude oil per year, a senior Kenyan energy official said on Monday.


Patrick Nyoike, permanent secretary at the energy ministry, said the two governments signed the memorandum of understanding on the oil last month. He did not say how many years the agreement covered.
"The details will come later," Nyoike told Reuters by telephone, declining to comment on how the deal sits with U.S. and European Union (EU) sanctions against Iranian oil exports.

Most other importers of Iranian crude oil have sharply reduced purchases to earn exemptions from U.S. financial sanctions.


The European sanctions - including a ban on imports of Iranian oil by EU states and measures that make it difficult for other countries to trade with Iran - came into effect on Sunday.


Lawmakers from the U.S. House of Representatives and Senate are meanwhile working to finalise a new package of sanctions aimed at further reducing oil and other revenues used by Iran to further its nuclear program.


Nyoike said the crude would total about 30 million barrels over one year, equivalent to around 80,000 barrels per day.

Kenya's only refinery said last month it would start buying its own crude oil. It processes 1.6 million tonnes a year.


Kenya has signed similar memorandums deals before.


Under President Mwai Kibaki, the east African nation has increasingly turned to new economic partners, forging close ties with nations like China and Libya under Muammar Gaddafi's leadership.


The shift in foreign policy stance has sometimes caused unease among its traditional western allies. Kenya is a key strategic ally in the U.S. led fight against militant Islam

NAIROBI, Kenya – Kenya on Wednesday cancelled a deal to import Iranian oil hours after the U.S. warned the country that it risked being penalized if it sees through the deal which would breach U.S. and European union sanctions, a government official said.

The sanctions are meant to deprive funding for the Iranian government and what is believed to be an effort by Iran to build nuclear weapons.

Kenya's Energy Permanent Secretary Patrick Nyoike said Kenya had not signed an agreement but had a memorandum of understanding with Iran to import its oil and was complying with international sanctions on Iran.
"There is an embargo on Iranian oil and on that note it has been decided that the M.O.U. will be terminated," Nyoike said.

The U.S. announced in December that it would penalize banks that do oil deals with Iran, giving countries and the oil markets until the end of June to adjust.

A statement from the U.S. State Department said Wednesday that sanctions will be implemented fully, and they include sanctions against financial institutions from any country, without an exception, if they are found to conduct sanctionable transactions, including those with the Central Bank of Iran.

Nyoike had been quoted this week saying that Kenya has signed an agreement to buy millions of barrels of Iranian oil.
He said he was not aware of the U.S. warning to Kenya about oil deals with Iran. Nyoike said the cancellation of the memorandum with Iran had nothing to do with accusations that two men believed to be agents of a secretive unit in the Iranian armed forces were planning to bomb American, Israeli, British and Saudi Arabian targets.

Kenyan security forces arrested the Iranians on June 19 and were then led to 15 kilograms (33 pounds) of RDX, a powerful explosive that could have been used against multiple targets or concentrated in one large bomb. If used together, the explosives could have leveled a medium-sized hotel, officials told AP.

The two suspects — Ahmad Abolfathi Mohammad and Sayed Mansour Mousavi — appeared in a Kenyan court last week, where Mohammad said he had been interrogated by Israeli agents. Israel's embassy said it had no comment.
In Israel, the office of Prime Minister Benjamin Netanyahu told the AP that "there are no limits to the Iranian terror."
The U.S., which does not purchase Iranian oil, announced sanctions in December that would prohibit the world's banks from completing oil transactions with Iranian banks.

That would make it more difficult for Iran to sell its crude on the open market. The oil in a single tanker can be worth $100 million. The U.S. sanctions took effect on June 28.Europe announced in January it would prohibit imports of Iranian crude by July 1. It had been satisfying about 3 percent of its demand with oil from Iran. Europe also is prohibiting firms from insuring shipments of Iranian oil.

In recent years, Iran has exported 2.5 million barrels of oil per day, about 3 percent of world supplies. About 500,000 barrels have gone to Europe and most of the rest to China, India, Japan and South Korea. Iranian fields produce a type of oil known as heavy, sour crude. This is a common type of crude that contains more sulfur than so-called light, sweet crude. Heavy crudes are harder and more expensive to refine into valuable fuels such as gasoline and therefore generally command a lower price.

Kenya, under pressure from the US and in the midst of security concerns, has cancelled an oil deal with Iran.

The Nation learnt on Wednesday that a meeting held at the Office of the President decided that the MoU with Iran for the annual purchase of oil annually should be cancelled.

The official reason, according to Energy Permanent Secretary Patrick Nyoike, was that the deal was not favourable, because it did not come with any price discount and Iran was only allowing a 90-day credit period.

Official feeling was also that this was not the first time that the government had signed such a deal with Iran, with no success.

According to government sources, the agreement was first signed in 2009 and then in 2010 but both agreements lapsed since Kenya could not find a bank to secure the deal.

However, the more immediate reason appears to pressure by western governments, particularly the US.

“There is an embargo on Iranian oil. We don’t want to get involved in the intricacies of international inter-governmental issues,” Mr Nyoike was quoted by Reuters.

This is the latest development in a series of events which have put Kenya in the middle of the conflict between the West and Iran.

Kenya has cancelled plans to import crude oil from Iran following threats of sanctions, an official at the Kenyan energy ministry hassaid. The outline deal signed last month was to import about 4m tonnes of oil from the Iranian National Oil Company. But the US embassy in Nairobi had warned it was important to cut revenue to the Iranian government. The US and the European Union have just tightened sanctions on Iran over concerns about its nuclear programme.

"Because of international pressure, we have withdrawn that understanding," AFP news agency quotes Patrick Nyoik, the energy ministry's permanent secretary, as saying. On Sunday, a complete European Union oil embargo on Iran came into effect - in response to US legislation, which sanctions any entity that deals with Iran's Central Bank.

"There are sanctions that are in place for people that are buying oil and products from Iran - there would be repercussions," outgoing US ambassador to Kenya Scott Gration warned earlier on Wednesday about Kenya's oil importation plans. Last month, Kenya's only refinery said that it would start buying its own crude oil, Reuters news agency
reported.

According to Kenya's Business Daily newspaper, under the proposed contract Tehran had been offering Kenya an extended credit facility of 90 days.
