At this time in the country's history it is hard to believe that there is an independent and working judicial system, it is hard to believe there is a system of courts that interprets and applies the law in the name of the state and it is hard to believe that there is a judiciary that interprets the law and applies it to the facts thus ensuring equal justice to all under law.
Hon. Chief Justice Mohamed Chande Othman, under the doctrine of separation of powers, may I take this opportunity to remind you that it is the judiciary that interprets and implements the constitution through judicial reviews. Further to this my lord, the judiciary has power to annul the laws and rules of the state when it finds them incompatible with a higher norm.
However, Hon. Chief Justice Mohamed Chande Othman, under you the judiciary appears to have abandoned one if its primary function as the guardian of the Fundamental Rights of the citizens of the United Republic of Tanzania and also of the Constitution thus giving room for the government to suppress the constitution through political malpractice and intolerance.
Why, Mheshimiwa have you allowed the judiciary to be used by those in power as an organ of suppression? Why is judiciary used to silence the voices of dissent and in so doing denying the citizens of this country their basic right to be heard, to voice their opposition to injustice? As the Chief Justice, the silence you exhibit frightens the hell out of the majority of us.
