      The Hon. Chief Justice Mohamed C. Othman.

      At this time in the country's history it is hard to believe that there is an independent and working judicial system, it is hard to believe there is a system of courts that interprets and applies the law in the name of the state and it is hard to believe that there is a judiciary that interprets the law and applies it to the facts thus ensuring equal justice to all under law.

      Hon.
      Chief Justice Mohamed Chande Othman, under the doctrine of separation of powers, may I take this opportunity to remind you that it is the judiciary that interprets and implements the constitution through judicial reviews. Further to this my lord, the judiciary has power to annul the laws and rules of the state when it finds them incompatible with a higher norm.

      However, Hon. Chief Justice Mohamed Chande Othman, under you the judiciary appears to have abandoned one if its primary function as the guardian of the Fundamental Rights of the citizens of the United Republic of Tanzania and also of the Constitution thus giving room for the government to suppress the constitution through political malpractice and intolerance.

      Why, Mheshimiwa have you allowed the judiciary to be used by those in power as an organ of suppression? Why is judiciary used to silence the voices of dissent and in so doing denying the citizens of this country their basic right to be heard, to voice their opposition to injustice? As the Chief Justice, the silence you exhibit frightens the hell out of the majority of us.

      The judiciary and police are among the most corrupt institutions in this country, this is according to PCCB (a toothless and corrupt body itself). Only a naive person will expect such institutions to act fairly and accordingly.

      There is no rule of law in this country, an anarchy of some sort prevails, where the amount of money in your pockets and your political connections dictate the number of laws you can freely and easily break, not even bend. The Chief Justice knows this, not unless he lives in another country.

      And now, our beloved country and the government are in shambles. The government seem to either be in denial about this fact, fast asleep or has no solution, and so they resort to the police and judiciary to wipe out/silence their opponents.

      Those in power, from the president, former presidents, ministers, army generals, judges, shoddy CEOs, drug lords, businessmen and their extended families and friends – the whole multiplier effect, will do anything at any cost to protect their ill-gotten gains.

      This is just the preview of what’s in store come 2015.

      1. Mahakama kutoa order ambayo nafikiri haiwezi kusimamiwa kwa mafano unaweza kutoa order kuwa mtu arudi au afanye kazi ? Je utaisimamiaje . mimi nadhani unaweza kutoa order mtu asifanye kazi na kuisimamia maana utaweka askari au utafunga milango . Lakini ya kufanya kazi itasimamiwaje.

      Waangalie mahakama isigeuzwe mahakama za siasa, na wakakuta wanafanya siasa watakuja hukumiwa vibaya kwa matendo yao. wambie tena waelewe muda si mrefu ni soon tu!

      Pasco, there is ample evidence available in Tanzania right now that our judiciary does not stand for change and more often than not goes to great length in support of the status quo. Our judiciary, under Chief Justice Hon. Mohamed Chande Othman, lacks creativity and it comes as no surprise that it cannot cope with the fast pace of justice expected of it...it is compliant and executive-minded to the detriment and at the expense of individual rights.

      Tindu Lisu couldnt have been more right in his assertion that many of our top judges including the Chief Justice lack the necessary requisite required right now to fast-track a judicial process that will keep pace with our current situation. No, Hon. Mohamed Chande Othman, you lack the drive, the courage and the confidence and I believe you are the stumbling block and so the only gift that you can give us as a nation is to retire honourably.

      Let me put it this way... we need a clear confrontation between the ruling party and the judiciary. When that hapoens then we will know that finally the judiciary is taking or rather claiming its rightful place. So far, the two are lying under yhe same blanket! Don't ask me what they are doing under there!

      Mwanakijiji, whatever it is that they are doing under the blanket smells to high heaven and, without mincing words, has to be far from healthy...chuck, chuck, chuck!

      One thing however troubles me...I know the police can enforce a gag order but the order has to be given by the court, am I wrong here? Just out of curiosity may I be told if Kova, for example, can just out of nowhere give such an order just because some thug has been taken to court? Can the Speaker stop any debate simply because a matter is in court? Okay let us assume that it is so, why did Kova call a press conference in the first place if the matter was already in court?

      This brings me back to my original plea to the Chief Justice Hon. Mohamed Chande Othman, what is his role in all this? Mbona kama yupo yupo tu? Since when have the police become the mouthpiece of Mahakama. Since when has Makinda become the mouthpiece of Mahakama? I would have thought that the court would have to give the gag order first before implementation, am I wrong here? Can anybody enlighten me please!

      Kwa mfano kwenye issue gani ambapo High court imeharibu? Maana kilichoandikwa hapo ni sawa na girlfriend wako akikuambia "Mbona unanifanyia hivyo?" ..... sasa mtu atajibu vipi swali hilo? Be open, give us a couple of cases.

      Hiki kitendo cha kukimbilia kupeleka kesi ya mshtakiwa wa utekaji nyara wa Dr. ulimboka mahakamani kabla uchunguzi haujakamilika unalenga maslahi ya watu/ kikundi fulani. mbona kuna kesi nyingi za rada, epa, deep green, dowans, ripoti za CAG, ambazo zina ushahidi wa kujitosheleza na hazipelekwi mahakamani?
      Kama lengo ni kuzuia watanzania kupitia wabunge wao kujadili swala la ulimboka, basi niwazi kuna watu wanataka kuficha ukweli.
      Licha ya hivyo inabidi wanasheria watufafanulie kuhusu hiki kipengele kinachokataza kujadili kesi zilizo mahakamani. Mbona tunaona kesi za kina Charles Taylor (kwa Ocampo), zinajadiliwa kwenye mabunge na vyombo mbalimbali vya habari, kesi ya muuaji wa Norway mbona imejadiliwa hadharani CNN,BBC..... Marekani tumeshuhudia kesi za kina O.J simpson, Michael Jackson na zingine zikijadiliwa waziwazi huku zikiwa zinaendelea mahakamani.
      Watanzania tusifanwe mambumbumbu wa sheria. Hebu wanaojua sheria waweke wazi swala hili.
      Kwa mtazamo wa kitoto inaonekana wazi kuna maslahi ya watu fulani ambao wanauwakilishi mzito kwenye mihimili yote mitatu katika nchi hii.
      Haiingii akilini serikali kukimbilia mahakamani si kwa lengo la kutafuta haki bali kwa lengo la kuwanyima haki wananchi wake kujadili maswala msingi kwa mustakhabali wa usalama wa nchi yao. Hii ni aibu ya karne. Nilishangaa sana pale spika alipo kataa wabunge kujadili mgomo wa madaktari eti swala liko mahakamani. ajabu kituko hicho kemrudiwa tena jana.
