      Learned bro and sisters, naombeni msaada wenu. Kwa mujibu wa sheria za kazi, mwajiri anaweza kuongeza muda wa kufanya kazi mwajiriwa wake? MATHALANI, muda wa kutoka kazini kwa kawaida ni saa tisa na nusu mchana, je mwajiri anauwezo wa kuamua kuwa watumishi wawe wanatoka saa kumi na moja?

      Asant for the comment. lakini concern yangu kubwa ni kwamba; sheria za kazi kwa nini zisiwekwe wazi kwa kila mfanyakazi kuzijua? sio hizo tu but also very useful documents za serikali na wananchi kama vile katiba, seria mbalimbali na kadhalika? naomba tupate kwa uwazi hizi docs.

      the whole process ya exposing documents za muhimu za nchi nadhani nayo iwekewe mkakati wa kundwa upya kama ulivyo mkakati wa sasa wa katiba. hali hii haitavumilika tena hata kidogo kwani haki nyingi za wasiojua haki zinachakachuliwa na wao wanakosa haki zao za msingi! na kwa kuwa watu hao wanashida ya kazi na wanaogopa kufukuzwa, wananyamaza tu huku wanaumia na viroho vinawadunda ti ti ti!

      Je sheria ya kazi inasemaje kuhusiana na suala la mahudhurio ya kila siku kazini kuwa yanakuwa yanatumwa kwa kila mfanyakazi kupitia emails zao. Taarifa hiyo kwa siku inakuwa inajumuisha kusema nani anaumwa, nani ana likizo, nani kafukuzwa kazi na nani hajafika kazini bila taarifa yoyote.

      Pia je kuna kifungu chochote kastika ELRA 2004 ambapo inampa mwajiri madaraka ya kuwataarifu wafanyakazi wake kama kuna mwajiriwa kafukuzwa kazi na sababu za kufukuzwa kazi na kuendelea kuwajulisha kwamba hata wao yanaweza wakuta hayo kama watashindwa kufuata sheria zilizowekwa sehemu za kazi?

      Nilikua nimeajiriwa ktk kampuni fulani kwa muda wa miaka miwili ila si kwa kampuni mama bali ktk kitengo mojawapo walichokua wakikitegemea kwa mapato, na maana kua kitengo hicho kilikua kikijishughulisha na biashara ya maswala ya IT information technology. kufikia october mwaka jana wakatoa sababu kwetu kua kwa kulingana na kazi wanazo zifanya za kuhudumia jamii(vijana na watotowalioko ktk mazingira magumu) haziendani na kitengo nilichokua nafanya kazi kwani chenyewe kimejikita zaidi ktk swala la biashara na hawataweza kusimamia kwa karibu zaidi.
      Waka terminate contracts zote kwa kigezo hicho ikiwa mkataba wangu ulikua una endelea mpaka tarehe 2/1/2012. kwenye barua ya temination walisema temination benefit zote zitatolewa ila walitoa tuu malipo ya muda nilio fanya kazi nao wa miaka mitatu kabla ambayo haikuzidi sh. 250,000 (kiinua mgongo kama wanavyo fahamu watu) swali kuu ni sahihi kwa namna walivyositisha mkataba niliokua nao?
      Kwa sababu kampuni wameiuza kwa mtu mwingine na tuko kwa mazoezi ya kazi tena kwa miezi mingine mitatu na wale walioonekana hawakua shupavu ktk utendaji wamesimamishwa kazi kabisa.

      Kuna umuhimu wa Mwajiri na Mwajiriwa wote kujua Sheria ya Ajira na Mahusiano Kazini Na 6/2004(ELRA) na Taasisi za Kazi Na 7/2004(LIA) zitaka nini: ni wazi kwamba sheria zote zimeanisha mambo ya kimsingi kwa uwazi. Lakini mahala pa kazi wengi hawapendi kuzijua na wala hawako tayari kupokea elimu juu ya misingi ya sheria hizo..

      Kwa vile hapa janvini tuna uhuru wa kudadafua mambo tutakua tunawaletea machache juu ya haki za kimsingi sitahiki kwa wafanyakazi na waajiri.

      Likizo ni haki ya kimsingi. Kuna aina zaidi ya tatu ambazo mfanyakazi anastaili:k
      1.Likizo ya mwaka
      2.Likizo ya uzazi
      3.Likizo ya ugonjwa
      Nina imani nitaendelea kuwaletea mambo zaidi ilo mradi tuwe pamoja

      Severance pay ni haki anayoipata mfanyakazi mara tu ajira inapokoma. Sifa ya kupata hiyo severance pay ni mpaka uwe umefanya kazi kwa muda wa mwaka au zaidi, na unalipwa si zaidi ya miaka kumi ktk utumishi wako. Kwa mshahala wa siku 7 kwa kila mwaka.

      Kwanza tunatakiwa kufahamu kwamba kuna aina mbalimbali za leave ambazo zimeainishwa katika ELRA 2004.


      1. Annual Leave (Likizo ya mwaka) -28 consecutive days
      2. Sick Leave (Ugonjwa) - 126 days in any leave cycle i.e. 36 months
      3. Maternity Leave - 84 days and if twins 100 days
      4. Paternity Leave - 3 days (Within 7 days of the birth of child)
      5. Compassionate Leave - 4 days with pay

      Kuhusiana na masaa ya kufanya kazi ni kwamba katika wiki mmoja mfanyakazi anatakiwa kufanya kazi kwa masaa yasiyozidi 45 na kama kutakuwa na overtime basi isizidi masaa 10 katika wiki hiyo. Hii ina maana kwamba kwa wiki ya kufanya kazi kwa siku tano basi utatakiwa kufanya kazi kwa masaa 9 kwa siku na kama una overtime basi isizidi masaa mawili.

      sasa wewe ndugu ndio unatakiwa uwahi kupata hiyo nakala ya ELRA usome na uelewe kipengele cha termination of employment kwani mle kuna sababu/mazingira mengi yanayopelekea muajiriwa kuachishwa kazi. Nakwambia ufanye haraka ili kama kuna any legal action you need to take isije kuwa timebarred, si unasikiaga mambo ya siku 30 mara siku 60. Alternatively consult a lawyer in the earliest possible time.
