Sakata la upandaji holela wa bei ya mafuta ya petroli nchini sasa hivi limefikia sura mpya, ambapo inaonekana dhahiri kwa Serikali kuzidiwa kete na wauzaji wa mafuta haya, kwa kile kinachoonekana kwamba Serikali imeshindwa kudhibiti soko hilo “huria”.
Kwa upande mmoja, Wakala wa Nishati na Maji (EWURA) imepewa uwezo wa kudhibiti bei za mwisho – kwa mnunuzi – za maji na nishati (zikiwemo umeme, petroli, dizeli, mafuta ya taa, gesi, n.k.), lakini kwa upande mwingine, Serikali ilikwishatamka na kujitoa katika kudhibiti bei ya nishati hii muhimu ya mafuta, kwa kigezo kwamba, bei hiyo ingepangwa na “soko huria”. Huo ndio mkanganyiko wa kisheria ambao sasa umekuwa kitendawili, kutokana na kuonekana kwamba hata agizo la Waziri wa Fedha, Mhe. Zakia Meghji, kutotiliwa maanani, pale alipoagiza kuwachukulia hatua za kisheria wauzaji wa mafuta ya petroli ambao wangeuza mafuta hayo kwa zaidi ya bei ambayo Serikali ilikuwa imeridhia. Ni nini kinachowapa kiburi wauzaji hawa wa mafuta? Kwa mfano, Waziri Meghji alisema waziwazi kwamba, kabla ya Serikali kutangaza rasmi ongezeko jipya la kodi kwenye mafuta ya petroli, tayari kulikuwa na shehena ya mafuta ambayo ingeweza kutumika kwa muda wa miezi mitatu, ambayo tayari ilikuwa imekwishalipiwa kodi zote zilizotakiwa! Hii haikuwa shehena mpya, kwa hiyo, kwa uhalali kabisa, wauzaji hawa wa mafuta hawakupaswa kupandisha bei kwa kisingizio cha kodi mpya iliyotajwa! Lakini walifanya hivyo, kinyume cha sheria, na walipaswa kushtakiwa kwa mujibu wa sheria za nchi. Kwa nini hili halikufanyika, Wizara ya Fedha, na hususan Mamlaka ya Mapato Tanzania, wana mengi ya kutueleza kwa nini walanguzi hawa wasichukuliwe hatua za kisheria, kwani, huu ni wizi wa mchana! Lakini kwa mtazamo wangu, nionavyo mimi, walanguzi – lazima niwaite kwa jina hilo, kwa kuwa ndilo linalowafaa – hawa wameweza kupanga na kupangua bei za mafuta ya petroli kwa kuwa sisi raia, wananchi wa kawaida, ni wajinga. Ndio, sisi ni wajinga. Lakini ujinga wetu huu kwa sasa lazima uishe, kwani, jambo ambalo hatulijui, sasa linaonekana wazi kutuumiza kwa kiwango kikubwa. Ujinga wetu ni, kwanza, kutokujua Sheria inayodhibiti uagizaji wa mafuta ya petroli pamoja na kodi zote zinazotozwa, na pili, kodi zote zinazotozwa na Serikali Kuu, Mikoa na Tawala za Mitaa, katika kila lita moja ya mafuta. Kimsingi, hatuzijui. Wauzaji mafuta wanaposema na kulia kuna kodi nyingi na wao hawapati faida, na kusema kwamba wanapata faida ya shilingi ishirini kwa kila lita, je, tuwaulize, ni shilingi ishirini kwa mauzo ya lita ngapi kwa siku, wiki hadi mwezi? Je, wewe ungeweza kuendesha biashara ambayo haina faida? Kama hiyo shilingi ishirini haitoshi, si wangeacha? Je, kama ni shilingi ishirini kwa mauzo ya lita milioni ishirini kwa mwezi, hizo si shilingi milioni mia nne (TShs 400,000,000/=) kwa mwezi? Na hiyo si faida tosha? Mimi ninatoa rai, kwa Mhe. Rais Jakaya Mrisho Kikwete, rais wetu mpendwa, kama unataka kutusaidia, utatoa agizo, Serikali yako ya Awamu ya Nne, iweke wazi, viwango vyote vya kodi zinazotozwa na Serikali na taasisi nyingine, kwenye kila lita moja ya mafuta ya petroli inayoingia hapa nchini. Ni dhahiri kwamba viwango hivi ni sawia kwa kila muagizaji wa mafuta hayo, hivyo, ushindani uliopo kwenye soko unategemea na fikra au mtazamo wa muuzaji mwenyewe, jinsi anavyopanga bei yake kwenye kituo chake cha mafuta. Tunataka kuujua mfumo mzima, tokea shehena ya mafuta inapopakuliwa bandarini na kupimwa kila lita moja ya ujazo, ni kiasi gani cha kodi kinachotozwa? Aidha, tunataka kujua, muuzaji wa rejareja anatozwa kiasi gani cha kodi na muuzaji wa jumla anatozwa kiasi gani cha kodi? Sidhani kama viwango hivi vya kodi ni “siri”, ila vimefanywa kuwa siri kwa kumlinda muuzaji, samahani, mlanguzi wa mafuta ya petroli, kwa lengo la kutuhujumu sisi walaji “wajinga”, yaani, mimi, wewe, huyu na yule. Zama za ujinga ziishie hapa, sasa tunataka kuelimika, tujue kinachokusanywa kwa niaba yetu. Ni haki yetu kujua, kwani sisi ndio walipa kodi hao! Sio wao wanaouza! SISI ndio tunalipa kodi hizo, kwa hiyo tuna haki zote za kujua, tunatozwa kodi kiasi gani? La sivyo tuitishe mgomo? Hadi kieleweke? Naomba kuwasilisha!

Umesema vema...
Suala jingine ni kwamba serikali iharakishe mpango wa kutumia TPDC kuagiza na kuuza mafuta. Sitashangaa kusikia kuwa hayo makampuni ya kuagiza mafuta (OMCs) yanakwamisha mpango huo - huenda kwa kuwahonga watendaji na warasimu wa serikalini (umechukua zaidi ya mwaka) kwa sababu yanajua TPDC ikirejea sokoni yatashindwa kutuibia kama yanavyofanya sasa. Ikibidi TPDC waanzishe na vituo vya kuuza rejareja. Madai ya kwamba serikali haipaswi kufanya biashara kwa mazingira ya nchi kama yetu katika zama hizi za soko huria inabidi yapuuzwe. Mafuta na nishati ni muhimu mno kwa maisha na uchumi kuachiwa walanguzi peke yao! Serikali ijifunze kutokana na makosa.

New proposal to raise water tariffs: DAWASCO move stopped in its tracks
-Told to first show how it has improved services to justify such a hike MBARAKA ISLAM Dar es Salaam THE Energy and Water Utilities Regulatory Authority (EWURA) has rejected outright plans by the Dar es Salaam Water and Sewerage Corporation (DAWASCO) to hike water tariffs in the country’s commercial capital. The industry regulator blocked proposals for an increase in water charges on grounds that DAWASCO failed to clearly indicate how it has so far improved the quality of its services for Dar es Salaam consumers to justify such a hike. EWURA Director General Haruna Masebu confirmed to THISDAY yesterday that the regulator would not consider the application filed by the Dar es Salaam Water and Sewerage Authority (DAWASA) on behalf of DAWASCO. Masebu explained that EWURA last year gave the water utility a set of instructions to fulfil before submitting a new proposal for tariff increases. Under tariff guidelines set by the industry regulator, energy and water utility companies looking to raise tariffs have a burden of proof to ’’demonstrate to EWURA’s satisfaction the reasonableness of any proposed tariff or adjustment to a tariff.’’ To this effect, EWURA will approve new tariffs and tariff-setting formulae only after evaluating applications and satisfying itself that the proposals are reasonable enough. As standard practice, all tariffs approved by EWURA are supposed to clearly reflect prudently-incurred costs of providing the utility service for which the tariffs are imposed. These costs include depreciation, interest expense and a reasonable return on invested capital for facilities that are used in providing the utility service. DAWASCO is currently operating under the same terms of a previous lease agreement between DAWASA and City Water, a British-German-Tanzanian consortium, before the government decided to terminate the controversial contract in May 2005. City Water was kicked out just two years into the ten-year, $102m (approx. 122bn/-) water privatisation contract, on grounds that it had failed to make even half the required investment or improve water services in Dar es Salaam. According to Masebu, DAWASA’s application on behalf of DAWASCO for approval of an upward adjustment of tariffs charged on domestic water supply and sewerage water disposal did not comply with the conditions implied in the lease agreement. ’’In their lease agreement, there is a specific formula and conditions for tariff adjustment,’’ he told THISDAY in an interview. He said DAWASCO had simply complied with the formula used for computing power tariffs, but failed to meet other aspects, ’’such as how they have improved the quality of their services.’’ ’’In our preliminary evaluation, we found that their application was not even worth considering and forwarding to the next stage. We told them to go and fill the gaps which include an explanation on the aspect of service improvement,’’ Masebu said. He added that DAWASCO would be allowed to resubmit its application for a tariff increase only after meeting the said conditions. The Energy and Water Utilities Regulatory Authority Act of 2001 requires the regulator to conduct a public inquiry after considering the application - but in this case it did not even warrant consideration at this stage. Despite DAWASCO’s various attempts to overhaul the city’s dilapidated water supply network, a good number of Dar es Salaam residents still have little or no access to water services. Available statistics show that at least 9.8 million Tanzanians (about 27 per cent of the population) countrywide do not have access to safe water, and 40 per cent of children under the age of five tend to suffer from diarrhoea as a result. Before privatisation, the water system in Dar es Salaam and many other parts of the country was in poor shape, mainly due to the failure of relevant authorities to improve its infrastructure in tandem with the rapid population increase. In 2003, only about four per cent of households in the city had direct water connections, and 74 per cent of water was being lost through leaks or illegal connections. It was against this background that international development partners and aid suppliers began to push for the privatisation of Dar es Salaam’s water system. However, the privatisation exercise went awry after the government ditched City Water, resulting in a protracted legal battle currently before the International Court for Settlement of Investment Disputes (ICSID). An affiliate of the World Bank, the ICSID headquartered in Washington DC was also asked to intervene in the wrangle between the Tanzania Electric Supply Company Limited (TANESCO) and Independent Power Tanzania Limited (IPTL) over their infamous 1995 power supply agreement. |
