Baada ya kulikoroga na huku akijua wazi kwamba sheria za kuanzishwa SUMATRA na EWURA ambazo zilibarikiwa na yeye mwenyewe kama Mbunge na mmoja wa vingunge wa Cabinet, leo hii anasukumia lawama kwa EWURA ambayo haina meno kutokana na ubutu wa sheria yake. In any case regulation haina maana ya kupanga bei, bali ni kusimamia shughuli za hiyo biashara. Meghji ameangalia kipengele cha shilingi 100 aliyoongeza kwenye mafuta pekee, lakini makampuni ya mafuta wana gharama nyingine za ziada. Mishahara ya wafanyakazi inapanda, gharama za uendeshaji zinapanda na thamani ya shilingi nayo inacheza mdumange, halafu mwisho wa siku anataka aweke price ceiling! Naona hapa tunarudi kule kule kwenye zama za Price Commission ambayo ilikuwa inapanga bei za bidhaa zote!

Wapinzani waliwaambia hiyo kodi italeta balaa, lakini hawakusikia. Baada ya kuona bei zinachumpa na kuashiria kupanda kwa mfumko wa bei (inflation), waziri amewageukia TRA, SUMATRA na EWURA kwamba wasikwepe wajibu. Kichekesho ni kwamba wiki iliyopita waziri Meghji alidai kwamba wauzaji wa mafuta wanachaji bei ghali kwenye mafuta ambayo yalilipiwa ushuru wa mwaka wa fedha uliopita, impliedly anakubali kwamba bei ya mafuta lazima itapanda pindi wakianza kulipa ushuru mpya.

Mfanyabishara yeyote yupo kwa ajili ya kutengeneza faida na pindi anapopata mwanya wa kutengeneza faida kubwa, anafanya kweli. Lakini hayo ndiyo matunda ya ubishi wa serikali na kugoma kuchukua ushauri wa wapinzani hata pale inapodhihirika wazi kwamba wapinzani wana hoja nzito kama jinsi walivyopendekeza kwenye bajeti mbadala ambayo ilionyesha vyanzo vingi vya mapato ambavyo serikali ya CCM kwa sababu zao wenyewe wanajifanya hawavioni, aidha kwa kuwa vyanzo hivyo vinagusa biashara zao/biashara za wafadhili wa CCM au wamekula rushwa na hivyo hawawezi kuziingilia kwa kuweka fees au kodi!!!

Mwambieni Hata Ulaya mtindo ni huo huo, Ukitangaza kupanda kwa kodi wauza mafuta hawasubiri mafuta yakauke ktk mapipa ndipo wajaze mapya yenye bei mpya!...

Na hata siku moja asifikirie Kuongezeka kwa kodi kwa wafanya biashara ili kutunisha mfuko wa serikali hakuna madhara kwa wananchi wake!. Mfanya biashara siku zote ni mkusanyaji kodi toka mifuko ya wananchi kwa niaba ya serikali kwa hiyo kila kodi inayopangwa na serikali, muathirika ni mwananchi! any aditional tax kwa mfanyabiashara ni mfereji huishia kwa mlalahoi!.

Hivi Dada/Mama Meghiji akiwa kwenye vikao vya cabinet kupitisha biashara huria au kuanzishwa kwa hizo taasisi kama EWAR na Sumatra anakuwa amelala au hajui subject on the table.
Wazee walisha amua siku nyingi kuwa Bei za Usafiri zitatokana na nguvu ya soko.
Nakumbuka kuna wakati bei mpaka ilikubaliwa kuwa Tshs3 lakini kwa sababu ya nguvu ya soko wali maintain Tshs 1.50.
Sasa hata kama anakuwa haelewi au anakuwa anafikra tofauti wakati wa hivyo vikao , je hana Private Secretary au marafiki wakamsaidia kumuelewesha.
Kwamba EWARU hawana nguvu hizo

Default Usiri kwenye kodi za mafuta umefikia tamati

Sakata la upandaji holela wa bei ya mafuta ya petroli nchini sasa hivi limefikia sura mpya, ambapo inaonekana dhahiri kwa Serikali kuzidiwa kete na wauzaji wa mafuta haya, kwa kile kinachoonekana kwamba Serikali imeshindwa kudhibiti soko hilo “huria”.

Kwa upande mmoja, Wakala wa Nishati na Maji (EWURA) imepewa uwezo wa kudhibiti bei za mwisho – kwa mnunuzi – za maji na nishati (zikiwemo umeme, petroli, dizeli, mafuta ya taa, gesi, n.k.), lakini kwa upande mwingine, Serikali ilikwishatamka na kujitoa katika kudhibiti bei ya nishati hii muhimu ya mafuta, kwa kigezo kwamba, bei hiyo ingepangwa na “soko huria”. Huo ndio mkanganyiko wa kisheria ambao sasa umekuwa kitendawili, kutokana na kuonekana kwamba hata agizo la Waziri wa Fedha, Mhe. Zakia Meghji, kutotiliwa maanani, pale alipoagiza kuwachukulia hatua za kisheria wauzaji wa mafuta ya petroli ambao wangeuza mafuta hayo kwa zaidi ya bei ambayo Serikali ilikuwa imeridhia.

Ni nini kinachowapa kiburi wauzaji hawa wa mafuta? Kwa mfano, Waziri Meghji alisema waziwazi kwamba, kabla ya Serikali kutangaza rasmi ongezeko jipya la kodi kwenye mafuta ya petroli, tayari kulikuwa na shehena ya mafuta ambayo ingeweza kutumika kwa muda wa miezi mitatu, ambayo tayari ilikuwa imekwishalipiwa kodi zote zilizotakiwa! Hii haikuwa shehena mpya, kwa hiyo, kwa uhalali kabisa, wauzaji hawa wa mafuta hawakupaswa kupandisha bei kwa kisingizio cha kodi mpya iliyotajwa! Lakini walifanya hivyo, kinyume cha sheria, na walipaswa kushtakiwa kwa mujibu wa sheria za nchi. Kwa nini hili halikufanyika, Wizara ya Fedha, na hususan Mamlaka ya Mapato Tanzania, wana mengi ya kutueleza kwa nini walanguzi hawa wasichukuliwe hatua za kisheria, kwani, huu ni wizi wa mchana!

Lakini kwa mtazamo wangu, nionavyo mimi, walanguzi – lazima niwaite kwa jina hilo, kwa kuwa ndilo linalowafaa – hawa wameweza kupanga na kupangua bei za mafuta ya petroli kwa kuwa sisi raia, wananchi wa kawaida, ni wajinga. Ndio, sisi ni wajinga. Lakini ujinga wetu huu kwa sasa lazima uishe, kwani, jambo ambalo hatulijui, sasa linaonekana wazi kutuumiza kwa kiwango kikubwa. Ujinga wetu ni, kwanza, kutokujua Sheria inayodhibiti uagizaji wa mafuta ya petroli pamoja na kodi zote zinazotozwa, na pili, kodi zote zinazotozwa na Serikali Kuu, Mikoa na Tawala za Mitaa, katika kila lita moja ya mafuta. Kimsingi, hatuzijui. Wauzaji mafuta wanaposema na kulia kuna kodi nyingi na wao hawapati faida, na kusema kwamba wanapata faida ya shilingi ishirini kwa kila lita, je, tuwaulize, ni shilingi ishirini kwa mauzo ya lita ngapi kwa siku, wiki hadi mwezi? Je, wewe ungeweza kuendesha biashara ambayo haina faida? Kama hiyo shilingi ishirini haitoshi, si wangeacha? Je, kama ni shilingi ishirini kwa mauzo ya lita milioni ishirini kwa mwezi, hizo si shilingi milioni mia nne (TShs 400,000,000/=) kwa mwezi? Na hiyo si faida tosha?

Mimi ninatoa rai, kwa Mhe. Rais Jakaya Mrisho Kikwete, rais wetu mpendwa, kama unataka kutusaidia, utatoa agizo, Serikali yako ya Awamu ya Nne, iweke wazi, viwango vyote vya kodi zinazotozwa na Serikali na taasisi nyingine, kwenye kila lita moja ya mafuta ya petroli inayoingia hapa nchini. Ni dhahiri kwamba viwango hivi ni sawia kwa kila muagizaji wa mafuta hayo, hivyo, ushindani uliopo kwenye soko unategemea na fikra au mtazamo wa muuzaji mwenyewe, jinsi anavyopanga bei yake kwenye kituo chake cha mafuta. Tunataka kuujua mfumo mzima, tokea shehena ya mafuta inapopakuliwa bandarini na kupimwa kila lita moja ya ujazo, ni kiasi gani cha kodi kinachotozwa? Aidha, tunataka kujua, muuzaji wa rejareja anatozwa kiasi gani cha kodi na muuzaji wa jumla anatozwa kiasi gani cha kodi? Sidhani kama viwango hivi vya kodi ni “siri”, ila vimefanywa kuwa siri kwa kumlinda muuzaji, samahani, mlanguzi wa mafuta ya petroli, kwa lengo la kutuhujumu sisi walaji “wajinga”, yaani, mimi, wewe, huyu na yule. Zama za ujinga ziishie hapa, sasa tunataka kuelimika, tujue kinachokusanywa kwa niaba yetu. Ni haki yetu kujua, kwani sisi ndio walipa kodi hao! Sio wao wanaouza! SISI ndio tunalipa kodi hizo, kwa hiyo tuna haki zote za kujua, tunatozwa kodi kiasi gani?

La sivyo tuitishe mgomo? Hadi kieleweke?

Umesema vema...

Suala jingine ni kwamba serikali iharakishe mpango wa kutumia TPDC kuagiza na kuuza mafuta. Sitashangaa kusikia kuwa hayo makampuni ya kuagiza mafuta (OMCs) yanakwamisha mpango huo - huenda kwa kuwahonga watendaji na warasimu wa serikalini (umechukua zaidi ya mwaka) kwa sababu yanajua TPDC ikirejea sokoni yatashindwa kutuibia kama yanavyofanya sasa. Ikibidi TPDC waanzishe na vituo vya kuuza rejareja.

Madai ya kwamba serikali haipaswi kufanya biashara kwa mazingira ya nchi kama yetu katika zama hizi za soko huria inabidi yapuuzwe. Mafuta na nishati ni muhimu mno kwa maisha na uchumi kuachiwa walanguzi peke yao! Serikali ijifunze kutokana na makosa.

THE Energy and Water Utilities Regulatory Authority (EWURA) has rejected outright plans by the Dar es Salaam Water and Sewerage Corporation (DAWASCO) to hike water tariffs in the country’s commercial capital.

The industry regulator blocked proposals for an increase in water charges on grounds that DAWASCO failed to clearly indicate how it has so far improved the quality of its services for Dar es Salaam consumers to justify such a hike.

EWURA Director General Haruna Masebu confirmed to THISDAY yesterday that the regulator would not consider the application filed by the Dar es Salaam Water and Sewerage Authority (DAWASA) on behalf of DAWASCO.

Masebu explained that EWURA last year gave the water utility a set of instructions to fulfil before submitting a new proposal for tariff increases.

Under tariff guidelines set by the industry regulator, energy and water utility companies looking to raise tariffs have a burden of proof to ’’demonstrate to EWURA’s satisfaction the reasonableness of any proposed tariff or adjustment to a tariff.’’

To this effect, EWURA will approve new tariffs and tariff-setting formulae only after evaluating applications and satisfying itself that the proposals are reasonable enough.

As standard practice, all tariffs approved by EWURA are supposed to clearly reflect prudently-incurred costs of providing the utility service for which the tariffs are imposed.

These costs include depreciation, interest expense and a reasonable return on invested capital for facilities that are used in providing the utility service.

DAWASCO is currently operating under the same terms of a previous lease agreement between DAWASA and City Water, a British-German-Tanzanian consortium, before the government decided to terminate the controversial contract in May 2005.

City Water was kicked out just two years into the ten-year, $102m (approx. 122bn/-) water privatisation contract, on grounds that it had failed to make even half the required investment or improve water services in Dar es Salaam.

According to Masebu, DAWASA’s application on behalf of DAWASCO for approval of an upward adjustment of tariffs charged on domestic water supply and sewerage water disposal did not comply with the conditions implied in the lease agreement.

’’In their lease agreement, there is a specific formula and conditions for tariff adjustment,’’ he told THISDAY in an interview.

He said DAWASCO had simply complied with the formula used for computing power tariffs, but failed to meet other aspects, ’’such as how they have improved the quality of their services.’’

’’In our preliminary evaluation, we found that their application was not even worth considering and forwarding to the next stage. We told them to go and fill the gaps which include an explanation on the aspect of service improvement,’’ Masebu said.

He added that DAWASCO would be allowed to resubmit its application for a tariff increase only after meeting the said conditions.

The Energy and Water Utilities Regulatory Authority Act of 2001 requires the regulator to conduct a public inquiry after considering the application - but in this case it did not even warrant consideration at this stage.

Despite DAWASCO’s various attempts to overhaul the city’s dilapidated water supply network, a good number of Dar es Salaam residents still have little or no access to water services.

Available statistics show that at least 9.8 million Tanzanians (about 27 per cent of the population) countrywide do not have access to safe water, and 40 per cent of children under the age of five tend to suffer from diarrhoea as a result.

Before privatisation, the water system in Dar es Salaam and many other parts of the country was in poor shape, mainly due to the failure of relevant authorities to improve its infrastructure in tandem with the rapid population increase.

In 2003, only about four per cent of households in the city had direct water connections, and 74 per cent of water was being lost through leaks or illegal connections. It was against this background that international development partners and aid suppliers began to push for the privatisation of Dar es Salaam’s water system. However, the privatisation exercise went awry after the government ditched City Water, resulting in a protracted legal battle currently before the International Court for Settlement of Investment Disputes (ICSID).

An affiliate of the World Bank, the ICSID headquartered in Washington DC was also asked to intervene in the wrangle between the Tanzania Electric Supply Company Limited (TANESCO) and Independent Power Tanzania Limited (IPTL) over their infamous 1995 power supply agreement.

Kwa upande mmoja, Wakala wa Nishati na Maji (EWURA) imepewa uwezo wa kudhibiti bei za mwisho – kwa mnunuzi – za maji na nishati (zikiwemo umeme, petroli, dizeli, mafuta ya taa, gesi, n.k.), lakini kwa upande mwingine, Serikali ilikwishatamka na kujitoa katika kudhibiti bei ya nishati hii muhimu ya mafuta, kwa kigezo kwamba, bei hiyo ingepangwa na “soko huria”. Huo ndio mkanganyiko wa kisheria ambao sasa umekuwa kitendawili, kutokana na kuonekana kwamba hata agizo la Waziri wa Fedha, Mhe. Zakia Meghji, kutotiliwa maanani, pale alipoagiza kuwachukulia hatua za kisheria wauzaji wa mafuta ya petroli ambao wangeuza mafuta hayo kwa zaidi ya bei ambayo Serikali ilikuwa imeridhia.

Ni nini kinachowapa kiburi wauzaji hawa wa mafuta? Kwa mfano, Waziri Meghji alisema waziwazi kwamba, kabla ya Serikali kutangaza rasmi ongezeko jipya la kodi kwenye mafuta ya petroli, tayari kulikuwa na shehena ya mafuta ambayo ingeweza kutumika kwa muda wa miezi mitatu, ambayo tayari ilikuwa imekwishalipiwa kodi zote zilizotakiwa! Hii haikuwa shehena mpya, kwa hiyo, kwa uhalali kabisa, wauzaji hawa wa mafuta hawakupaswa kupandisha bei kwa kisingizio cha kodi mpya iliyotajwa! Lakini walifanya hivyo, kinyume cha sheria, na walipaswa kushtakiwa kwa mujibu wa sheria za nchi. Kwa nini hili halikufanyika, Wizara ya Fedha, na hususan Mamlaka ya Mapato Tanzania, wana mengi ya kutueleza kwa nini walanguzi hawa wasichukuliwe hatua za kisheria, kwani, huu ni wizi wa mchana!

Lakini kwa mtazamo wangu, nionavyo mimi, walanguzi – lazima niwaite kwa jina hilo, kwa kuwa ndilo linalowafaa – hawa wameweza kupanga na kupangua bei za mafuta ya petroli kwa kuwa sisi raia, wananchi wa kawaida, ni wajinga. Ndio, sisi ni wajinga. Lakini ujinga wetu huu kwa sasa lazima uishe, kwani, jambo ambalo hatulijui, sasa linaonekana wazi kutuumiza kwa kiwango kikubwa. Ujinga wetu ni, kwanza, kutokujua Sheria inayodhibiti uagizaji wa mafuta ya petroli pamoja na kodi zote zinazotozwa, na pili, kodi zote zinazotozwa na Serikali Kuu, Mikoa na Tawala za Mitaa, katika kila lita moja ya mafuta. Kimsingi, hatuzijui. Wauzaji mafuta wanaposema na kulia kuna kodi nyingi na wao hawapati faida, na kusema kwamba wanapata faida ya shilingi ishirini kwa kila lita, je, tuwaulize, ni shilingi ishirini kwa mauzo ya lita ngapi kwa siku, wiki hadi mwezi? Je, wewe ungeweza kuendesha biashara ambayo haina faida? Kama hiyo shilingi ishirini haitoshi, si wangeacha? Je, kama ni shilingi ishirini kwa mauzo ya lita milioni ishirini kwa mwezi, hizo si shilingi milioni mia nne (TShs 400,000,000/=) kwa mwezi? Na hiyo si faida tosha?

Mimi ninatoa rai, kwa Mhe. Rais Jakaya Mrisho Kikwete, rais wetu mpendwa, kama unataka kutusaidia, utatoa agizo, Serikali yako ya Awamu ya Nne, iweke wazi, viwango vyote vya kodi zinazotozwa na Serikali na taasisi nyingine, kwenye kila lita moja ya mafuta ya petroli inayoingia hapa nchini. Ni dhahiri kwamba viwango hivi ni sawia kwa kila muagizaji wa mafuta hayo, hivyo, ushindani uliopo kwenye soko unategemea na fikra au mtazamo wa muuzaji mwenyewe, jinsi anavyopanga bei yake kwenye kituo chake cha mafuta. Tunataka kuujua mfumo mzima, tokea shehena ya mafuta inapopakuliwa bandarini na kupimwa kila lita moja ya ujazo, ni kiasi gani cha kodi kinachotozwa? Aidha, tunataka kujua, muuzaji wa rejareja anatozwa kiasi gani cha kodi na muuzaji wa jumla anatozwa kiasi gani cha kodi? Sidhani kama viwango hivi vya kodi ni “siri”, ila vimefanywa kuwa siri kwa kumlinda muuzaji, samahani, mlanguzi wa mafuta ya petroli, kwa lengo la kutuhujumu sisi walaji “wajinga”, yaani, mimi, wewe, huyu na yule. Zama za ujinga ziishie hapa, sasa tunataka kuelimika, tujue kinachokusanywa kwa niaba yetu. Ni haki yetu kujua, kwani sisi ndio walipa kodi hao! Sio wao wanaouza! SISI ndio tunalipa kodi hizo, kwa hiyo tuna haki zote za kujua, tunatozwa kodi kiasi gani?

Default Mzimu wa Buzwagi wamvaa Mramba-Alitoa msamaha wa kodi ya mafuta ‘milele’

Msamaha huo wa kodi umetolewa kwa makampuni yanayochimba madini ya dhahabu pekee na unalenga kuzuia utekelezaji wa Sheria ya Ushuru wa Barabara na Mafuta ya mwaka 1985 (The Road and Fuel Tolls Act, 1985) inayohusu utozwaji wa ushuru kwa magari na mafuta yote yanayotumika nchini.

Habari zinaeleza ya kuwa Mramba alifanya uamuzi huo Aprili 2005, kipindi ambacho viongozi wa serikali walikuwa ‘likizo’ wakiwa katika harakati za uchaguzi ikiwa ni siku chache kabla ya Chama cha Mapinduzi (CCM) kufanya mkutano wake mkuu uliomteua Jakaya Kikwete kuwa mgombea wake wa urais.


Kwa mujibu wa tangazo la serikali (GN) namba 99, lililochapishwa katika gazeti rasmi la serikali la Aprili 15, 2005, Mramba alitoa nafuu hiyo ya kodi, “kwa kipindi chote cha Mkataba wa Uendelezaji Madini (MDA) ama uhai wa mgodi husika au chochote kitakachotangulia kati ya mambo hayo mawili.”

Ofisa mmoja mwandamizi wa serikali aliliambia Raia Mwema kwamba, msamaha huo ni matokeo ya udhaifu wa sheria hiyo inayompa mamlaka Waziri wa Fedha kutoa msamaha “anapojisikia kufanya hivyo” hali ambayo inaweza kutumika vibaya na kiongozi dhaifu.

Wakati kifungu cha 7 (2) kinaeleza wazi kwamba ushuru huo unapaswa kulipwa na mtu yeyote anayenunua mafuta, sehemu ya 8 inampa mamlaka makubwa Waziri wa Fedha kuweza kutoa msamaha wa kodi kwa jinsi atakavyoona inafaa.

“Waziri anaweza, kwa kutangaza katika gazeti la serikali (Government Gazette) kutoa msamaha kwa mtu ama chombo chochote (taasisi ama kampuni) ama gari lolote kuguswa na kifungu cha sheria ya ushuru wa barabara na mafuta, msamaha ambao unaweza kuwa wa jumla jumla ama unaweza kupangiwa kipindi maalumu kulingana na waziri atakavyoona inafaa,” inaeleza sehemu ya 8 ya sheria hiyo.

Anayetajwa kuanza kutumia mamlaka hayo kutoa msamaha kwa makampuni ya uchimbaji dhahabu alikuwa Daniel Yona, akiwa Waziri wa Fedha, siku ya kuadhimisha miaka 22 ya kuzaliwa kwa CCM, Februari 5, 1999, lakini yeye alitoa msamaha huo kwa mwaka mmoja wa kwanza tu baada ya kuanza rasmi kwa uzalishaji wa dhahabu.

Habari zinasema kwamba Mramba ‘alimzidi kete’ Yona, kwa yeye kuamua kutoa msamaha huo kwa kipindi chote cha uhai wa migodi ya dhahabu, jambo ambalo limeanza kugusa hisia za watendaji serikalini wakiwamo wajumbe wa kamati iliyoundwa awali kwa maelekezo ya Rais Kikwete kupitia upya mikataba ya madini.


Kamati hiyo iliyoongozwa na aliyekuwa Naibu Waziri wa Nishati na Madini, Laurence Masha, ilionyesha wazi kutoridhika na kipengele hicho na kupendekeza mabadiliko makubwa katika kutolewa kwa misamaha hiyo.

Wajumbe wengine wa kamati hiyo walitoka Ofisi ya Makamu wa Rais, Wizara ya Mipango na Uchumi na Uwezeshaji, Wizara ya Fedha, Tawala za Mikoa na Serikali za Mitaa, Wizara ya Nishati na Madini, Wizara ya Sheria na Katiba, Mamlaka ya Mapato Tanzania (TRA), Idara ya Jiolojia, Benki Kuu na STAMICO.

Kamati hiyo ilielezea jinsi ambavyo makampuni mengi ya madini yanatumia mafuta mengi kutokana na kutotumia umeme wa gridi na badala yake wanatumia jenereta za dizeli wakati wote na kushauri kuwapo kwa marekebisho katika misamaha ya kodi kwa makampuni ya madini.

Mtaalamu mmoja wa uchumi alilieleza Raia Mwema kwamba kwa siku makampuni ya mafuta hutumia zaidi ya lita 300,000 za mafuta kwa uzalishaji, kiwango ambacho husamehewa kiwango kikubwa cha fedha kwa kila lita kinachokadiriwa kuwa takriban Sh bilioni 46 kwa mwaka.

Hata hivyo, Waziri wa Nishati na Madini, Nazir Karamagi, hakuzingatia kabisa ushauri huo wa kamati alipokwenda kusaini mkataba wa mgodi wa dhahabu wa Buzwagi kati ya serikali na kampuni ya Pangea Minerals Limited, kampuni tanzu ya Barrick. Katika mkataba wa Buzwagi kifungu cha 4.4.3 kimeweka wazi kwamba Pangea hawatawajibika kulipa ushuru wa mafuta kwa kuzingatia marekebisho yaliyofanywa na Waziri Mramba.

Karamagi aliliambia Bunge mjini Dodoma kwamba mkataba wa Buzwagi umezingatia mapendekezo ya kamati ya madini iliyoundwa kwa maelekezo ya Rais.

Kwa mujibu wa kumbukumbu rasmi za Bunge (hansard) akijibu bungeni hoja ya Mbunge wa Kigoma Kaskazini, Zitto Kabwe, aliyetaka kuundwa kwa Kamati Teule ya Bunge kuhusu kusainiwa kwa mkataba wa Buzwagi, Waziri Karamagi alisema mapendekezo ya kamati ya Rais yametekelezwa katika kusaini mkataba wa Buzwagi.

“Mheshimiwa Kabwe Zitto, anasisitiza kuwa zoezi la kudurusu mikataba bado linaendelea. Mtoa hoja labda anachanganya tena zoezi la kudurusu mikataba na zoezi linaloendelea na kudurusu Sheria ya Madini ya Mwaka 1998 na Sheria zinahusu mfumo wa kodi katika sekta ya madini; kitu ambacho ni kipana zaidi na kinawahusu wadau wote yaani, wawekezaji wakubwa, wawekezaji wadogo na wote wanaojihusisha na utafiti katika sekta ya madini. Akielewa hili mtoa hoja atabaini kuwa maagizo ya (kamati ya) Rais yalitekelezwa kikamilifu na matokeo yake yameshaanza kujitokeza,” alisema Karamagi.

Mbali na msamaha katika ushuru wa mafuta, Mkataba wa Buzwagi pia umepingana na ushauri wa Kamati ya Masha iliyoundwa kwa maelekezo ya Rais kuhusu ulazima wa makampuni ya madini kuishirikisha Benki Kuu ya Tanzania (BoT) katika ufunguaji wa akaunti katika offshore banks za nje. Mbali ya kuonyesha wasiwasi wake kuhusu makampuni mengi ya madini kutozingatia kipengele hicho, Kamati ya Masha ilipendekeza kufanyika kwa uchunguzi wa kina chini ya usimamizi wa pamoja wa Wizara ya Nishati na Madini na BoT.

Mkataba wa Buzwagi uliosainiwa na Karamagi nchini Uingereza, unazingatia kuwapo kwa kibali cha BoT katika kipengele cha 5.1 lakini katika kipengele cha 5.2 mkataba huo unaweka wazi kwamba BoT itakaposhindwa ama kukataa kutoa ruhusa hiyo katika kipindi cha siku 30, kampuni husika itaendelea na mpango wake wa kufungua akaunti bila kuhitaji ruhusa hiyo. Sakata la Buzwagi liliibuka bungeni baada ya Zitto kuhoji, pamoja na mambo mengine, usiri wa mkataba huo ambao ulisainiwa nchini Uingereza, lakini Karamagi alitetea kwa nguvu zote akidai kwamba hakukua na ukiukwaji wowote wa sheria na taratibu na ulizingatia maslahi ya taifa.

Katika kuhoji kwake, Zitto alitoa maelezo akitaka kuundwa kwa kamati teule ya Bunge kuchunguza suala hilo, lakini hoja yake ilishindwa kwa kura na wabunge wa CCM japo sasa wengi wanaona walifanya makosa kuzuia hoja hiyo.

Hoja hiyo pia ilimponza Zitto kwani Mbunge wa Mchinga kupitia CCM, Mudhihir Mohamed Mudhihir, aliwasilisha hoja akidai kwamba Zitto alisema uongo wakati akimtuhumu Karamagi, na kupendekeza afungiwe.

Bunge kwa kura nyingi za wabunge wa CCM walipitisha uamuzi wa kumfungia Zitto, kifungo kilichomalizika katikati ya Novemba, baada ya kuigharimu CCM kwa kiasi kikubwa kutokana na wananchi wengi kuonekana kumuunga mkono Zitto na hata kuwazomea viongozi wa serikali na wale wa CCM.

Kabla hata ya Zitto kumaliza ‘kifungo’, Rais Kikwete aliunda kamati ya kupitia mikataba na sheria za madini, huku mbunge huyo kijana akiwa mmoja wa wajumbe wa kamati hiyo na kuzua maswali mengi kuhusu msimamo wa Rais kuhusu suala hilo.
