Upande wa mashtaka uliambia mahakama kwamba mshtakiwa alinaswa Mei 9 kijiji cha Kiambogo, Laikipia Magharibi na maafisa wa polisi waliokuwa wakipiga doria baada yao kupashwa habari na umma kwamba alikuwa na bangi.

Alikamatwa na baada ya msako kufanywa nyumbani mwake gramu 500 za bangi zikapatikana. Hakueleza sababu za kupatikana na bangi hiyo na akafungiwa kituo cha polisi cha Kiambogo kabla ya kushtakiwa.

Kisa hicho kinatokea siku chache tu baada ya mwanamume mwengine kuwashangaza watu mahakamani Nakuru kwa kudai alinuia kupanda bangi ili kumaliza panya na fuko wanaomharibia mimea.

Mshtakiwa, Francis Irungu Kuria alisisitiza kuwa bangi hiyo iliyokuwa imefungwa na karatasi ya sukari ni yake na akasema yeye alipanga kupambana na panya na fuko shambani mwake na wala sio kuvuta.

Hakimu Mkuu Samwel Mungai aliamuru kesi itajwe baada ya wiki mbili ili ripoti ya kuthibitisha bidhaa hiyo ni bangi kuletwa mahakamani kabla yake kusoma hukumu.

Huku wengi waliokuwa kortini kusubiri mshtakiwa ajitetee, Irungu alisisitiza kuwa nia yake ni kutumia bangi hiyo kutafuta amani kwake shambani kwani amepoteza mazao kwa miaka nyingi na ndipo akaamua kuchukua hatua kali.

Alishtakiwa kuwa mnamo Mei 2, katika kijiji cha Wiyumimirie wilayani Milangine, alipatikana na misokoto mitano ya bangi yenye dhamani ya Sh100 ambayo haijatengenezwa kuwa dawa ya matumizi ya kila siku.

Irungu, alipoitwa jina, alivua koti lake na kusimama wima huku mashtaka yakisomwa kwa lugha ya Kiswahili na alikubali mashtaka hayo kwa kusema kwa sauti ya chini. Hapo aliombwa kuongeza sauti na akavalia korti lake kabla ya kusema ni fuko na panya waliomfanya kupanda bangi shambani

Kesi hiyo itatajwa Mei 17 wakati ripoti kuhusu uchunguzi wa bidhaa hiyo utawasilishwa kuonyesha korti ikiwa ilikuwa bangi au la.
